HomeMy Public PortalAboutORD 03/09ORDINANCE NO. 03/9 AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AMENDING CHAPTER 66, ZONING, AT ARTICLE VIII, SUPPLEMENTARY DISTRICT REGULATIONS, TO INCLUDE A NEW DIVISION 8 REQUIRING UNDERGROUNDING OF UTILITIES; AMENDING CHAPTER 70, THE GULF STREAM DESIGN MANUAL, AT SECTION 70-99 AND AT SECTION 70-187, ITEM 2, SO AS TO PROVIDE FOR THE PROHIBITION OF METAL ROOFS, EXCEPT UNPAINTED COPPER ROOFS WHEN USED AS A DECORATIVE ACCENT OR ON MINOR ACCESSORY STRUCTURES AND FURTHER PROVIDING FOR A PROHIBITION ON ALL WHITE TILE ROOFS OTHER THAN FLAT CEMENT TILE; AMENDING CHAPTER 70, THE GULF STREAM DESIGN MANUAL, AT SECTION 70 -187, TABLE OF DISTRICT STANDARDS, ITEM 4 WALLS, ITEM 6 FENCES AND ITEM 7 WALLS AND FENCES, SO AS TO INCLUDE A PROVISION THAT THE MEASUREMENT OF ALL WALLS AND FENCES SHALL BE FROM THE LOWEST GRADE ADJACENT TO THE WALL; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS: Section 1. The Gulf Stream Code of Ordinances is hereby amended at Chapter 66, Zoning, Article VIII, Supplementary District Regulations, to include a new Division 8, Undergrounding of Utilities, to read as follows: ARTICLE VIII. SUPPLEMENTARY DISTRICT REGULATIONS "DIVISION 8. UNDERGROUNDING OF UTILITIES Sec. 66 -449. Underaroundina of utilities. All utility service lines shall be placed underground." Section 2. Chapter 70, the Gulf Stream Design Manual, is hereby amended at Article V, Areawide Standards, Section 70 -99, Roof Design, Slope and Materials, at item (3), to read as follows: Sec. 70 -99. Roof design, slope and materials. "(3) Prohibited. Asphalt shingles except on existing polo cottages and homes with existing asphalt or wood shingles Bright, unnaturalistic- looking roof material Flat roofs visible over ten percent of total roof area, except when used at peaks to reduce roof massing 1 Gambrel roofs Glazed skylights on the streetside Inconsistent roofing materials visible from the exterior of the property, except approved accent materials Mansard roofs Metal roofs (except unpainted copper when used as a decorative accent or on minor accessory structures) Non - earthtone colors (except white), for example: blue, peach, pink, teal or yellow Primary color tiles and shingles Roll tile and similar tile styles in all districts except Place Au Soleil S -Tile in all districts except Place Au Soleil Solar panels on the street side Unnecessary complex or monolithic roof design White barrel tole All white tile other than flat cement tile" Section 3. Chapter 70, the Gulf Stream Design Manual, is hereby amended at Article VI, District Standards, Section 70 -187, Table of District Standards, at item 2, Roofs, to read as follows: 2. ROOFS (Not applicable to decorative elements or roof features such as chimney caps, cupolas and dormers) Section 4. Chapter 70, the Gulf Stream Design Manual, is hereby amended at Article VI, District Standards, Section 70 -187, Table of District Standards, at item 4, Walls, to read as follows: "4. WALLS (Applicable to a II walls I ocated b etween t he street a nd minor a ccessory setback line. The measurement of all walls referenced herein shall be from the lowest grade adjacent to the wall.)' Section 5. Chapter 70, the Gulf Stream Design Manual, is hereby amended at Article VI, District Standards, Section 70 -187, Table of District Standards, at item 6, Fences, to read as follows: 2 Gulf Stream Core Ocean West Beachfront North /South Place au Soleil Prohibited Steep roofs (over S -tile and S -tile and 45 °) Roll tile Roll tile S -tile and Roll tile Mansard Non - earthtone colors (except white) Bright, un- naturalistic looking roof material Metal roofs' Primary color tiles /shingles Gambrel Flat (over 10% visible) All tole than flat tole white other cement Certain metal roofs determined by the Town to be appropriate to the structure and to the neighborhood may be approved only in instances of re- roofing of existing structures based upon an engineer's certification that the existing structure will not support a tile roof. Additionally. unpainted copper may be used either as a decQrative accent Q[ Qn minor accessory structures, Section 4. Chapter 70, the Gulf Stream Design Manual, is hereby amended at Article VI, District Standards, Section 70 -187, Table of District Standards, at item 4, Walls, to read as follows: "4. Section 5. Chapter 70, the Gulf Stream Design Manual, is hereby amended at Article VI, District Standards, Section 70 -187, Table of District Standards, at item 6, Fences, to read as follows: 2 "6. FENCES (Applicable to all fences located between the street and minor accessory setback line. The measurement of all fences referenced herein shall be from the lowest grade adjacent to the wall.)" Section 6. Chapter 70, the Gulf Stream Design Manual, is hereby amended at Article VI, District Standards, Section 70 -187, Table of District Standards, at item 7, Walls and Fences, to read as follows: 117. WALLS AND FENCES: ALONG SIDE AND REAR PROPERTY LINES AND LOCATIONS NOT VISIBLE FORM STREET (Outside of front setback area. The measurement of all walls and fences referenced herein shall be'from the lowest grade adjacent to the wall.)' Section 7. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions of this Ordinance are hereby declared severable. Section 8. Repeal of Ordinances in Conflict. All other ordinances of the Town of Gulf Stream, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. Section 9. Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Town of Gulf Stream. Section 10. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law.
