PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, AUGUST 21, 1978
1 The Common Council of the City of Richmond, Indiana met in regular session
2 August 21, 1978 at the hour of 7: 30 p.m. in the Council Chambers in the
3 Municipal Building in said City. President Austerman presided with the
III4 following members present: Messrs. Elstro, Williams, Ahaus, Merchanthouse,
5 Mills, Carter, Paust, and Welch. Absent: None. The following business
6 was had, to-wit:

8 Councilman Mills gave devotions.

10 President Austerman reported he was absent from the previous meeting due
11 to illness.

13 Councilman Williams moved to approve the minutes of the previous meeting,
14 as prepared, seconded by Councilman Mills and on unanimous voice vote, the
15 motion was carried.

17 Councilman Elstro requested the Board of Works check a sewer filled with
18 mud on S .W. "C" between 2nd and 3rd Streets.

20 Councilman Carter complimented the Board of Works for their action on
21 his request for repair work on N.W. 10th.

23 Councilman Mills moved to suspend the rules and read. Ordinance No. 72-1978
24 on first reading by title only, seconded by Councilman Welch and on
25 unaimous voice vote, the motion was carried.

27 The Clerk read on first reading by title only Ordinance No. 72-1978 - AN
28 ORDINANCE TO TRANSFER WITHIN THE PARK AND RECREATION FUND.

30 Councilman Mills moved to suspend the rules and read Ordinance No. 72-1978
31 on second reading, seconded by Councilman Paust and on unanimous voice vote,
32 the motion was carried.

36 Speaking for and explaining Ordinance No. 72-1978 was Park Superintendent
37 Don McBride.

39 Councilman Merchanthouse moved for engrossment of Ordinance No. 72-1978,
40 seconded by Councilman Elstro and on unanimous voice vote, the motion was
41 carried.

43 Councilman Elstro moved to suspend the rules and read Ordinance No. 72-1978
44 on third and final reading by title only, seconded by Councilman Merchanthouse
45 and on unanimous voice vote, the motion was carried.

47 The Clerk read on third reading by title only Ordinance No. 72-1978.

49 Ordinance No. 72-1978 was placed on final passage or rejection and on a
50 call of the roll the following was recorded: Ayes: Elstro, Williams,
51 Ahaus, Merchanthouse, Mills, Carter, Paust, Welch and Austerman. Noes:
52 None. The vote being nine (9) to zero (0), in favor of passage or Ordinance

55 President Austerman announced Ordinance Nos. 59-1978 through 65-1978 will
56 be held on second reading until the special meeting August 28, 1978.

61 FOR THE FISCAL YEAR BEGINNING JANUARY 1, 1979 AND ENDING DECEMBER 31, 1979,
62 INCLUSIVE, INCLUDING ALL OUTSTANDING CLAIMS AND OBLIGATIONS, AND FIXING
63 THE TIME WHEN THE SAME SHALL TAKE EFFECT .

1 Councilman Carter moved to cut 2610 Service Contractual City Controller's
2 Office by $2,000.00. This motion died for lack of a second.

4 Speaking for 2 - 26 Other Contractual Services Common Council was Attorney
5 Robert Hudson. This item is for codification of the Municipal Code and

6 - Mr. Hudson stated one hundred (100) volumes will be sold by the City.

8 Councilman Carter moved to delete $4,900.00 from this Common Council line
9 item at this time, seconded by Councilman Ahaus. The motion passed with
10 Councilmen Williams and Elstro voting no.

12 Speaking for the Art Association were Ms Hazel Pummerville, 1288 South 22nd
13 and Mr. Chuck Berberich, 3132 Forest Drive.

15 Speaking for the Animal Welfare League was Ms Carol Longer, 5309 National
16 Road East.

18 Councilman Carter moved to cut 5801 B/W Demolition to $1,000.00, seconded
19 by Councilman Ahaus. The motion failed with Councilmen Carter and Ahaus
20 voting aye.

22 Councilman Mills moved to cut 2212 Electric Current - Street Lights Board
23 of Public Works and Safety to $530,000.00, seconded by Councilman Carter.
24 On a call of the roll the following was recorded: Ayes: Ahaus, Mills,
25 Carter, Welch and Austerman. Noes: Elstro, Williams, Merchanthouse and
26 Paust. The vote being five (5) to four (4) in favor of passage of the
27 amended cut.

29 Councilman Carter moved to decrease 2211 Electric Current - City Building
30 by $4,000.00 making it $28,000.00, seconded by Councilman Mills and on a
31 call of the roll the following was recorded: Ayes: Mills, Carter and
32 Welch. Noes: Elstro, Williams, Ahaus, Merchanthouse, Paust, and Austerman.
33 The vote being three (3) to six (6) in favor of the motion; therefore, the
34 motion was defeated.

36 Councilman Carter moved to cut 2520 Repair of Equipment Board of Public
37 Works and Safety by $500.00. This motion died for lack of a second.

39 Councilman Carter moved to cut 2690 Other Contractual Services Board of
40 Public Works and Safety by $2,500.00. This motion died for lack of a
41 second. -

43 Councilman Carter moved to cut 4 - 43 Repair Parts Board of Public Works
44 and Safety by $1,000.00. This motion died for lack of a second.

46 Councilman Mills moved for a five minute recess, seconded by Councilman
47 Welch and on unanimous voice vote, the motion was carried.

49 Council reconvened at 9:05 p.m.

51 The Clerk read on second reading Ordinance No. 60-1978 - AN ORDINANCE TO
52 APPROPRIATE THE SUM OF SEVENTY-ONE THOUSAND AND FIFTY-FOUR DOLLARS ($71,054.00)
53 FROM THE MOTOR VEHICLE HIGHWAY SPECIAL DISTRIBUTION FUND OF THE CITY OF
54 RICHMOND, WAYNE COUNTY, INDIANA, FOR THE PURPOSE OF DEFRAYING THE EXPENSE OF

38 Councilman Mills moved to accept and file proof of publication for Ordinance
39 Nos. 66-1978, 67-1978 and 68-1978, seconded by Councilman Ahaus and on
40 unanimous voice vote, the motion was carried.

43 Department of Transportation Jerry Haynes.

45 Councilman Ahaus moved for engrossment of Ordinance No. 66-1978, seconded
46 by Councilman Welch and on unanimous voice vote, the motion was carried.

48 Councilman Welch moved to suspend the rules and read Ordinance No. 66-1978
49 on third and final reading by title only, seconded by Councilman Mills and
50 on unanimous voice vote, the motion was carried.

9 on unanimous voice vote, the motion was carried.

24 Councilman Mills moved to suspend the rules and read Ordinance No. 68-1978 on
25 third and final reading by title only, seconded by Councilman Welch and on
26 unanimous voice vote, the motion was carried.

36 Councilman Mills moved a special meeting be called for August 28, 1978, seconded
37 by Councilman Williams_ and on unanimous voice vote, the motion was carried.

39 Councilman Mills moved to have the regular Council meeting on Tuesday,
40 September 5, 1978 due to Labor Day, seconded by Councilman Ahaus and on
41 unanimous voice vote, the motion was carried.

43 Councilman Merchanthouse stated he has received complaints against the Gas
44 Company charging a deposit to customers who have made several late payments
45 during the past year. Mr. Meredith stated the Mayor has also received
46 complaints as well as other Councilmen.

48 There being no further business on motion duly made, seconded and passed,
49 the meeting was adjourned.
