HomeMy Public PortalAbout07-03-1978 401 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, JULY 3, 1978 1 The Common Council of the City of Richmond, Indiana met in_ regular session 2 July 3, 1978 at the hour of 7:30 p.m. in the Council Chambers in the Municip 1 3 Building in said City. President Austerman presided with the following membe s 4 present: Messrs. Elstro, Williams, Merchanthouse, Mills, Carter, Paust, 5 and Welch. Absent: Mr. Ahaus. The following business was had, to wit: 6 7 Councilman Carter gave devotions. 8 9 Councilmen Merchanthouse and Elstro reported they.were out of town on busines 10 at the previous meeting. 11 12 Councilman Williams moved to approve the minutes of the previous meeting as 13 prepared, seconded by Councilman Mills and on unanimous voice vote, the 14 motion was carried. 15 16 Mr. Don Meredith reported he turned Councilman Williams' weed complaint on 17 North "I" over to Mr. Charles Roberts who reported equipment to cut the weeds 18 cannot get into the area as the street is torn up. Mr. Roberts further 19 requests all weed complaints be given by specific addresses. Mr. Meredith 20 reported in answer to a request from Councilman Carter that Peacock Road 21 has been resurfaced and the sidewalk on N.W. 10th has been checked and is 22 not in as bad shape as other areas. Mr. Meredith reported he received a 23 report from the print shop in the City Building noting his June 1978 paper 24 usage on 123 work orders and he calculates the outside printing charges woul. 25 have been about $2,200.00 while his cost was $238.00. He calculates a savin:s 26 to date in 1978 of $12,579.08. Councilman Mills presented a letter to Mr. 27 Meredith concerning noise by motorcycles on South 15th Street. 28 29 Councilman Mills moved to suspend the rules and read Ordinance Nos.48-1978, 30 49-1978, 50-1978, 51-1978, 52-1978, 53-1978, and 54-1978 on first reading by 31 title only, seconded by Councilman Merchanthouse and on unanimous voice vote, 32 the motion was carried. 33 34 The Clerk read on first reading by title only, Ordinance No. 48-1978 - AN 35 ORDINANCE TO TRANSFER WITHIN THE MUNICIPAL AIRPORT FUND. 36 37 Councilman Mills moved to suspend the :.rules and read Ordinance No. 38 48-1978 on second reading, seconded by Councilman Welch and on unanimous 39 voice vote, the motion was carried. 40 41 The Clerk read on second reading Ordinance No. 48-1978. 42 43 Councilman Merchanthouse moved for engrossment of Ordinance No. 48-1978, 44 seconded by Councilman Welch and on unanimous voice vote, the motion was 45 carried. 46 47 Councilman Merchanthouse moved to suspend the rules and read Ordinance No. 48 48-1978 on third and final reading by title only, seconded by Councilman 49 Mills and on unanimous voice vote, the motion was carried. 50 51 The Clerk read on third reading by title only Ordinance No. 48-1978. 52 11/ 53 Ordinance No. 48-1978 was placed on final passage or rejection and on a 54 call of the roll, the following was recorded: Ayes: Elstro, Williams, 55 Merchanthouse, Mills, Carter, Paust, ,Welch, and Austerman. July 3, 1978 Page 2 1 Councilman Mills moved to suspend the rules and read Ordinance No. 49-1978 on 2 second reading, seconded by Councilman Paust and on unanimous voice vote, the 3 motion was carried. 4 5 The Clerk read on second reading Ordinance No. 49-1978. 6 7 Councilman Mills moved for engrossment of Ordinance No. 49-1978, seconded 8 by Councilman Paust and on unanimous voice vote, the motion was carried. 9 10 Councilman Mills moved to suspend the rules and read Ordinance No. 49-1978 11 on third and final reading by title only, seconded by Councilman Paust and 12 on unanimous voice vote, the motion was carried. 13 14 The Clerk read on third reading by title only Ordinance No. 49-1978. 15 16 Ordinance No. 49-1978 was placed on final passage or rejection and on a call 17 of the roll, the following was recorded: Ayes: Elstro, Williams, Merchanthouse, 18 Mills, Carter, Paust, Welch, and Austerman. The vote being 19 eight (8) to zero (0) in favor of passage of Ordinance No. 49-1978. 20 21 The Clerk read on first reading by title only Ordinance No. 50-1978 - AN 22 ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND. 23 24 Councilman Mills moved to suspend the rules and read Ordinance No. 50-1978 25 on second reading, seconded by Councilman Paust and on unanimous voice vote, 26 the motion was carried. 27 28 The Clerk read on second reading Ordinance No. 50-1978. 29 30 Councilman Williams moved for engrossment of Ordinance No. 50-1978, seconded 31 by Councilman Welch and on unanimous voice vote, the motion was carried. 32 33 Councilman Williams moved to suspend the rules and read Ordinance No. 50-1978 34 on third and final reading by title only, seconded by Councilman Welch and 35 on unanimous voice vote, the motion was carried. 36 37 The Clerk read on third reading by title only Ordinance No. 50-1978. 38 39 Ordinance No. 50-1978 was placed on final passage or rejection and on a 40 call of the roll the following was recorded: Ayes: Elstro, Williams, 41 Merchanthouse, Mills, Carter, Paust, Welch, and Austerman. Noes: None. 42 The vote being eight (8) to zero (0) in favor of passage of Ordinance No. 43 50-1978. 44 45 The Clerk read on first reading by title only Ordinance No. 51-1978 - AN 46 ORDINANCE TO REPEAL ORDINANCE NO. 3289-1977. 47 48 Councilman Williams moved to suspend the rules and read Ordinance No. 49 51-1978 on second reading, seconded by Councilman Welch and on unanimous 50 voice vote, the motion was carried. 51 52 The Clerk read on second reading Ordinance No. 51-1978. 53 54 Councilman Paust moved for engrossment of Ordinance No. 51-1978, seconded 55 by Councilman Williams and on unanimous voice vote, the motion was carried. 56 57 Councilman Merchanthouse moved to suspend the rules and read Ordinance No. 58 51-1978 on third and final reading by title only, seconded by Councilman 59 Welch and on unanimous voice vote, the motion was carried. 403 Common Council Minutes Cont. Noes: None. 31 The vote being eight (8) to zero (0) in favor of passage of Ordinance 32 No. 52-1978. 33 34 The Clerk read on first reading by title only, Ordinance No. 53-1978 - AN 35 ORDINANCE TO APPROPRIATE FROM THE LOCAL ROAD AND STREET SPECIAL 36 DISTRIBUTION FUND. 37 38 President Austerman announced Ordinance No. 53-1978 has to be advertised. 39 40 The Clerk read on first reading by title only, Ordinance No. 54-1978 - AN 41 ORDINANCE AMENDING AMENDED ORDINANCE NO . 3238-1977 COMMONLY KNOWN AS THE 42 SALARY AND POSITION ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED 43 AUGUST 1, 1977. 44 45 Councilman Elstro moved to suspend the rules and read Ordinance No. 54-1978 46 on second reading,' seconded by Councilman Paust and on unanimous voice vote, 47 the motion was carried. 48 49 The Clerk read on second reading Ordinance No. 54-1978. 50 51 Councilman Elstro moved for engrossment of Ordinance No. 54-1978, seconded 52 by Councilman Welch and on unanimous voice vote, the motion was carried. 53 54 Councilman Elstro moved to suspend the rules and read Ordinance No. 54-1978 55 on third and final reading by title only, seconded by Councilman Welch, 56 and on unanimous voice vote, the motion was carried. • 57 58 The Clerk read on third reading by title only, Ordinance No. 54-1978. 59 60 Ordinance No. 54-1978 was placed on final passage or rejection and on a 61 call of the roll, the following was recorded: Ayes: Elstro, Williams, 62 Merchanthouse, Mills, Carter, Paust, Welch, and Austerman. July 3, 1978 Page 4 1 The Clerk read on second reading Ordinance No. 29-1978 - AN ORDINANCE AMENDING 2 ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY 3 OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 4 5 Deputy Director of City Planning Dan Dooley presented an amended ordinance 6 as amended by the Plan Commission. Councilman Welch moved to accept the 7 amended ordinance as submitted back from the Plan -Commission: on Ordinance 8 No. 29-1978, seconded by Councilman Paust and on unanimous voice vote, the 9 motion was carried. 10 11 Councilman Merchanthouse moved for engrossment of Amended Ordinance No. 12 29-1978, seconded by Councilman Paust and on unanimous voice vote, the 13 motion was carried. 14 15 Councilman Welch moved to suspend the rules and read Amended Ordinance No. 16 29-1978 on third and final reading by title only, seconded by Councilman 17 Mills and on unanimous voice vote, the motion was carried. 18 19 The Clerk read on third reading by title only, Amended Ordinance No. 29-1978. 20 21 Amended Ordinance No. 29-1978 was placed on final passage or rejection and 22 on a call of the roll the following was recorded: Ayes: Elstro, Williams, 23 Merchanthouse, Mills, Carter, Paust, Welch, and Austerman. Noes: None. 24 The vote being eight (8) to zero (0) in favor of passage of Amended Ordinance 25 No. 29-1978. 26 27 The Clerk read on. second reading Ordinance No. 38-1978 - AN ORDINANCE TO 28 ANNEX TO THE CITY OF RICHMOND, INDIANA, CERTAIN CONTIGUOUS TERRITORY, 29 ADJACENT AND ABUTTING THERETO, DESCRIBING SAME, PROVIDING FOR THE • 30 PUBLICATION THEREOF, AND FIXING THE TIME WHEN THE SAME SHALL TAKE EFFECT. 31 32 Councilman Welch moved for engrossment of Ordinance No. 38-1978, seconded 33 by Councilman Paust and on unanimous voice vote, the motion was carried. 34 35 Councilman Merchanthouse moved to suspend the rules and read Ordinance 36 No. 38-1978 on third and final reading by title only, seconded by 37 Councilman Carter and on unanimous voice vote, the motion was carried. 38 39 The Clerk read on third reading by title only Ordinance No. 38-1978. 40 41 Ordinance No. 38-1978 was placed on final passage or rejection and on a 42 call of the roll the following was recorded: Ayes: Elstro, Williams, 43. Merchanthouse, Mills, Carter, Paust, Welch, and Austerman. Noes: None. 44 The vote being eight (8) to zero (0) in favor of passage of Ordinance No. 45 38-1978. 46 47 The Clerk read on second reading Ordinance No. 44-1978 - AN ORDINANCE 48 AMENDING CHAPTER 22 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, 49 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, 50 ADOPTED JUNE 3, 1968. 51 52 Mr. Dooley stated the Plan Commission received aletter from Mr. Kent 53 Klinge, Agent in this matter, requesting the petition to rezone be 54 withdrawn. 55 56 Councilman Mills moved to strike Ordinance No. 44-1978, seconded by 57 Councilman Paust and on unanimous voice vote, the motion was carried. 58 59 The Clerk read on second reading Ordinance No. 47-1978 - AN ORDINANCE 60 AMENDING ORDINANCE NO. 1800-1960 COMMONLY KNOWN AS THE SUBDIVISION 61 ORDINANCE OF THE CITY OF RICHMOND, INDIANA. 62 63 Councilman Welch moved for engrossment of Ordinance No. 47-1978, seconded 64 by Councilman Paust and on unanimous voice vote, the motion was carried. 4OO5 Common Council Minutes Cont.
