HomeMy Public PortalAbout06-05-1978 391 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, JUNE 5, 1978 1 The Common Council of the City of Richmond, Indiana, met in regular session 2 June 5, 1978 at the hour of 7:30 p.m. in the Council Chambers in the 3 Municipal Building in said City. President Austerman presided with the 4 following members present: Messrs. Elstro, Williams, Ahaus, Merchanthouse, 5 Mills, Carter, Paust, and Welch. Absent: None. The following business 6 was had, to-wit: 7 8 Councilman Ahaus gave devotions. 9 10 Councilman Williams moved to approve the minutes of the previous meeting 11 as prepared, seconded by Councilman Mills and on unanimous voice vote, the 12 motion was carried. 13 14 Councilman Mills moved to suspend the rules and read Resolution Nos. 11-1978 15 and 12-1978 on first reading by title only, seconded by Councilman Paust 16 and on unanimous voice vote, the motion was carried. 17 18 The Clerk read by title only Resolution No. 11-1978 - A RESOLUTION 19 APPROVING THE RICHMOND AREA COMPREHENSIVE COMMUNITY ENERGY MANAGEMENT 20 PROGRAM AND REQUESTING FUNDS FOR ITS SUPPORT. 21 22 Speaking for and explaining Resolution No. 11-1978 was Ms Ann Cline, 2711 23 South "G" Street. 24 25 Councilman Williams moved for adoption of Resolution No. 11-1978, seconded 26 by Councilman Paust. The motion was carried with Councilman Carter voting 27 nay. 28 29 The Clerk read by title only Resolution No. 12-1978 - A RESOLUTION TO 30 TRANSFER WITHIN THE MUNICIPAL AIRPORT FUND. 31 32 Speaking for Resolution No. 12-1978 was Mr. Bob Brooks, 2747 Northmont 33 Blvd. 34 35 Councilman Elstro moved for adoption of Resolution No. 12-1978, seconded 36 by Councilman Williams and on unanimous voice vote, the motion was carried. 37 38 Mayor Clifford Dickman stated the energy study that is being made could 39 not be made without the resources available in the community. He 40 praised Ann Cline, Howard Haworth, RP&L, Departments of the City, Richmond 41 Chamber of Commerce, Earlham College, IU East, industry, League of Women 42 Voters and the Wayne County Resource Inventory Council for their part in 43 this study. 44 45 The Mayor stated in answer to questions why N.W. 5th Street paving had 46 not been>eoritinued from the bridge to the railroad that other improvements 47 are planned for this section before paving is done. 48 49 Discussion was held on the crowded quarters in Council Offices due to 50 County Court. Mayor Dickman stated this is temporary until they can move 51 into the old Court House. It was requested they keep officesinEb-etter 52 or-der. ' ---I53 54 Department of Transportation Director Jerry Haynes stated, in answer to 55 Councilman Merchanthouse's inquiry as to why the gates on the North 7th 56 Street parking lot had not been in operation for a couple of days, he has 57 had problems with a loss and-.change in personnel and the siutation will 58 soon be corrected. 59 60 Councilman Williams requested Mr. Haynes to sweep North 8th Street as they 61 are having a clean-up, paint-up and fix-up. 392 Common Council Minutes Cont. June 5, 1978 Page 2 1 Councilman Ahaus announced his Committee met concerning Ordinance Nos. 2 34-1978 35-1978 and 36-1978 and recommend all three be adopted. Councilman 3 Ahaus stated the Mass Transit Committee had a meeting with Dr. George 4 Smerk, Professor of Transportation at Indiana University. 5 6 Councilman Paust announced the Snow Removal Committee has finalized all 7 their meetings. They are now writing their report and will present this 8 report to Council on June 19. Councilman Paust stated the Public Service 9 Committee has met concerning Ordinance No. 42-1978 and recommends approval 10 of this ordinance. 11 12 Councilman Mills moved to suspend the rules and read Ordinance Nos. 38-1978, 13 39-1978, 40-1978, 41-1978, 42-1978 and 43-1978 on first reading by title 14 only, seconded Councilman Ahaus and on unanimous voice vote, the motion was 15 carried. 16 17 The Clerk read on first reading by title only Ordinance No. 38-1978 - AN 18 ORDINANCE TO ANNEX TO THE CITY OF RICHMOND, INDIANA, CERTAIN CONTIGUOUS 19 TERRITORY, ADJACENT AND ABUTTING THERETO, DESCRIBING SAME, PROVIDING FOR 20 THE PUBLICATION THEREOF, AND FIXING THE TIME WHEN THE SAME SHALL TAKE EFFECT. 21 22 President Austerman announced Ordinance No. 38-1978 is referred to the Plan 23 Commission for their study and recommendation. 24 25 The Clerk read on first reading by title only Ordinance No. 39-1978 - AN 26 ORDINANCE OF THE CITY OF RICHMOND AUTHORIZING THE ACQUISITION AND COMPLETION 27 OF AN ECONOMIC DEVELOPMENT FACILITY, THE ISSUANCE AND SALE OF REVENUE BONDS 28 TO PAY THE COST THEREOF, AND THE LEASING OF SUCH FACILITIES TO DEVELOPMENT 29 CORPORATION OF RICHMOND, AND OTHER MATTERS RELATING THERETO. 30 31 Speaking for Ordinance No. 39-1978 was Attorney Andrew Cecere, 101 South 32 10th Street. 33 34 Councilman Mills moved to suspend the rules and read Ordinance No . 39-1978 35 on second reading, seconded by Councilman Ahaus and on unanimous voice. vote, 36 the motion was carried. 37 38 The Clerk read on second reading Ordinance No. 39-1978. 39 40 Councilman Mills moved for engrossment of Ordinance No. 39-1978, seconded 41 by Councilman Ahaus and on unanimous: voice vote, the motion was carried. 42 43 Councilman Mills moved to suspend the rules and read Ordinance No. 39-1978 44 on third and final reading by title only, seconded by Councilman Ahaus and 45 ' on unanimous voice vote, the motion was carried. 46 47 The Clerk read on third reading by title only Ordinance. No. 39-1978. 48 49 Ordinance No. 39-1978 was placed on final passage or rejection and on a 50 call of the roll the following was recorded: Ayes: Elstro, Williams, 51 Ahaus, Merchanthouse, Mills, Carter, Paus:t, Welch and Austerman. Noes: None. 52 The Vote being nine (9) to zero (0) in favor of passage of Ordinance No. 53 39-1978 54 55 Councilmen praised the Economic Development Commission for their efforts 56 and Mr. Alan Rosar, 4572 Greenmount Pike, thanked Council for their 57 cooperation. 393 Common Council Minutes Cont. June 5, 1978 Page 3 1 The Clerk read on first reading by title only Ordinance No. 40-1978 - AN 2 ORDINANCE TO APPROPRIATE THE SUM OF ONE HUNDRED FORTY TWO THOUSAND ONE 3 HUNDRED SEVEN DOLLARS AND SIXTY CENTS ($i42,107.60) FROM THE MOTOR 4 VEHICLE HIGHWAY SPECIAL DISTRIBUTION FUND OF THE CITY OF RICHMOND, WAYNE 5 COUNTY, INDIANA, FOR THE PURPOSE OF DEFRAYING THE EXPENSE OF THE MOTOR 6 VEHICLE HIGHWAY SPECIAL DISTRIBUTION FUND OF SAID CITY FOR THE BALANCE 7 OF THE CALENDAR YEAR 1978 BUDGETING THE SAME, LIMITING THE USE THEREOF AND 8 FIXING THE TIME WHEN SAME SHALL TAKE EFFECT. 9 10 President Austerman announced Ordinance No. 40-19'78 has to be advertised 11 and is referred to the Public Works and Sanitation Committee. 12 13 The Clerk read on first reading by title only Ordinance No. 41-1978 - AN 14 ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 15 16 President Austerman announced Ordinance No. 41-1978 has to be advertised. 17 18 The Clerk read on first reading by title only Ordinance No. 42-1978 - AN 19 ORDINANCE TO APPROPRIATE FROM THE CUMULATIVE CAPITAL BUILDING FUND. 20 21 President Austerman announced Ordinance No. 42-1978 has to be advertised and. 22 the Public Safety Committee has already met and made their recommendation 23 to approve this ordinance. 24 25 The Clerk read on first reading by title only Ordinance No. 43-1978 - AN 26 ORDINANCE TO APPROPRIATE WITHIN THE PARK AND RECREATION FUND. 27 28 President Austerman announced Ordinance No. 43-1978 has to be- advertised. 29 30 The Clerk read on second reading Ordinance No. 28-1978 - AN ORDINANCE 31 AUTHORIZING A SPECIAL USE IN AN R-3 DISTRICT . BEING A PARKING LOT 32 SITUATE ON LOT-38 JC. 33 34 Deputy Director of City Planning Dan Dooley stated the Plan Commission 35 conducted a public hearing on Ordinance No. 28-1978 and voted five (5) 36 to zero (0) to allow this Special Use with the following conditions: 37 1. The site plan accompanying the petition be identified as Exhibit "A" 38 and made a part of Ordinance No. 28-1978; and, 2. That the petitioner 39 consult with Richmond Power and Light to determine the appropriate type 40 and location of lighting for the off-street parking lot. 41 42 Speaking for Ordinance No. 28-1978 was Mr. Bob Beach, 200 North 13th Street 43 44 Councilman Mills moved for engrossment of Ordinance No. 28-1978, seconded 45 by Councilman Ahaus and on unanimous voice vote, the motion was carried. 46 47 Councilman Mills moved to suspend the rules and read Ordinance No. 28-1978 48 on third and final reading by title only, seconded by Councilman Elstro, 49 • and on unanimous voice vote, the motion was carried. 50 51 The Clerk read on third reading by title only Ordinance No. 28-1978. 52 53 Ordinance No. 28-1978 was placed on final passage or rejection and on a 54 call of the roll the following was recorded: Ayes: Elstro, Williams, 55 Ahaus, Merchanthouse, Mills, Carter, Paust, Welch and Austerman. Noes: 56 None. The vote being nine (9_) to zero (0) in favor of passage of 57 Ordinance No. 28-1978. 58 59 The Clerk read on second reading Ordinance No. 33-1978 - AN ORDINANCE 60 TO APPROPRIATE WITHIN THE MUNICIPAL AIRPORT FUND. 61 62 City Attorney Ed Anderson examined proof of publication of Ordinance No. 63 33-1978 and found it to be in order. Councilman Mills moved the proof 64 of publication be accepted and filed, seconded by Councilman Paust and on 65 unanimous voice vote, the motion was carried. 394 Common Council Minutes Cont. June 5, 1978 Page 4 1 Councilman Williams moved for engrossment of Ordinance No. 33-1978, seconded 2 by Councilman Ahaus and on unanimous voice vote, the motion was carried. 3 . 4 Councilman Williams moved to suspend the rules and read Ordinance. No. 33-1978 5 on third and final reading by title only, seconded by Councilman Paust and 6 on unanimous voice vote, the motion was carried. 7 8 The Clerk read on third reading by title only Ordinance No. 33-1978. 9 10 Ordinance No. 33-1978 was placed on final passage or rejection and on a call 11 of the roll the following was recorded: Ayes: Elstro, Williams, Ahaus, 12 Merchanthouse, Mills, Carter, Paust, Welch and Austerman. The 13 vote being nine (9) to zero (0) in favor of passage. of Ordinance No. 33-1978. 14 15 The Clerk read on second reading Ordinance No. 34-1978 - AN ORDINANCE TO 16 AMEND GENERAL ORDINANCE NUMBER 2282-1967 AS AMENDED TO AMEND THE MASTER PLAN 17 OF THE CITY OF RICHMOND TO INCLUDE A PART OF THE TWO (2) MILE FRINGE AREA 18 THEREOF. 19 20 Councilman Ahaus moved for engossment of Ordinance No. 34-1978, seconded by 21 Councilman Welch and on unanimous voice vote, the motion was carried. 22 23 Councilman Ahaus moved to suspend the rules and read Ordinance No. 34-1978 24 on third and final reading by title only, seconded by Councilman Merchanthous- 25 and on unanimous voice vote, the motion was carried. 26 27 The Clerk read on third reading by title only Ordinance No. 34-1978: 28 29 Ordinance No. 34-1978 was placed on final passage or rejection and on a call 30 of the roll the following was recorded: Ayes: Elstro, Williams, Ahaus, 31 Merchanthouse, Mills, Carter, Paust, Welch, and Austerman. Noes: None. 32 The vote being nine (9) to zero (0) in favor of passage of Ordinance No. 33 34-1978. 34 35 The Clerk read on second reading Ordinance No. 35-1978 - AN ORDINANCE 36 AMENDING CHAPTER 22 OF THE MUNICIPAL CODE COMMONLY KNOWN AS THE ZONING 37 ORDINANCE OF THE CITY OF RICHMOND, INDIANA ADOPTED JUNE 3, 1968. 38 39 Speaking on Ordinance No. 35-1978 were Deputy Director of City Planning 40 Dan Dooley, Mr. Robert Hudson, representing the City Attorney's Office and 41 City Plan Director Bob Goodwin. 42 _ 43 Councilman Ahaus moved for engrossment of Ordinance No. 35-1978, seconded 44 by Councilman Welch and on unanimous voice vote, the motion was carried. 45 46 Councilman Ahaus moved to suspend the rules and read Ordinance No. 35-1978 47 on third and final reading by title only, seconded by Councilman Elstro and 48 on unanimous voice vote, the motion was carried. 49 50 The Clerk read'. on third' reading by title only Ordinance No. 35-1978. 51 52 Ordinance No. 35-1978 was placed on final passage or rejection and on a call 53 of the roll the following was recorded: Ayes: Elstro, Williams, Ahaus, 54 Merchanthouse, Mills, Carter, Paust, Welch and Austerman. The vote being nine (9) to zero (0) in favor of passage of Ordinance 14 No. 36-1978. 15 16 The Clerk read on second reading Ordinance No. 37-1978 - AN ORDINANCE TO 17 ' APPROPRIATE FROM THE LOCAL ROAD AND STREET SPECIAL DISTRIBUTION FUND. 18 19 City Attorney Ed Anderson examined Proof of publication of Ordinance No. 20 37-1978 and found it to be in order. Councilman Mills moved the proof of 21 publication be accepted and filed, seconded by Councilman Williams. 22 23 Councilman Mills moved for engrossment of Ordinance No. 37-1978, seconded 24 by Councilman Elstro and on unanimous voice vote, the motion was carried. 25 26 Councilman Mills moved to suspend the rules and read Ordinance No. 37-1978 27 on third and final reading by title only, seconded by Councilman Paust 28 and on unanimous voice vote, the motion was carried. 29 30 The Clerk read on third reading by title only Ordinance No. 37-1978. 31 . 32 Ordinance No. 37-1978 was placed on final passage or rejection and on a 33 I call of the roll the following was recorded: Ayes: Elstro, Williams, Ahaus, 34 Merchanthouse, Mills, Carter, Paust, Welch, and Austerman. Noes: None. 35 The vote being nine (9) to zero (0) in favor of passage of Ordinance No. 36 37-1978. 37 38 President Austerman announced Ordinance No. 3228-1977 is referred to the 39 Plan Commission for their study and recommendation. 40 41 In answer to Councilman Merchanthouse's inquiry, Mayor Dickman stated the 42 City Building lawn is being treated with chemicals this year. 431 44 City Engineer ,George Webb presented an up-date of the striping program. 45 This will include thirty miles of City streets and will be totally 46 Federally funded. It was noted the State Highway is not fulfilling their 47 responsibility on repairs to highways located inside the City. 48 49 There being no further business on motion duly made, seconded and passed 50 the meeting was adjourned. 51 52 Thomas L.
