PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, MAY 1, 1978
1 The Common Council of the City of Richmond, Indiana, met in regular
2 session May, l, 1978 at the hour of 7:30 p.m. in the Council Chambers in
3 the Municipal Building in said City. President Austerman presided with the
4 following members present: Messrs. Elstro, Williams, Ahaus, Merchanthouse,
5 Mills, Carter, Paust, and Welch. Absent: None. The following business
6 was had, to-wit:

8 A moment of silence was observed in remembrance of Lester Meadows, Mayor
9 of Richmond from' 1948 - 1955, who passed away last Saturday.

11 Councilman Mills reported he was absent from the last meeting as he was
12 on vacation and Councilman Merchanthouse reported he was absent due to
13 illness.

15 Councilman Williams moved to approve the minutes of the previous meeting
16 as prepared, seconded by Councilman Mills and on unanimous voice vote, the
17 motion was carried.

19 Councilman Mills. moved to suspend. .the -rules and read Resolution No.
20 10-1978 by title only, seconded by Councilman Paust and on unanimous voice
21 vote the motion was carried.

23 The Clerk read by title only Resolution No. 10-1978 -A RESOLUTION
24 AUTHORIZING AND APPROVING THE RELEASE OF CERTAIN REAL ESTATE IN THE CITY
25 OF RICHMOND, INDIANA.

27 Speaking for Resolution No. 10-1978 was Mr. Gayle Gardner, Attorney
28 representing Hoffco, Inc.

30 Councilman Mills moved for adoption of Resolution No. 10-1978, seconded
31 by Councilman Ahaus and on unanimous voice vote, the motion was carried.

33 Mayor Clifford Dickman noted the annual report for 1977 which was presented
34 to Council members is incomplete omitting the report from the
35 Sanitation Department.

37 Councilman Elstro presented twelve (12) or thirteen (13) complaints on junk
38 cars to the Board of Works. He stated _there are vehicles at South 16th
39 and "L" and Greenwood Apartments with no inspectionand. out of dateplates.
40 On South "P" between .13th and 14th a City truck got stuck and left ruts
41 in the yard of Mr. Albert Hale at this address.

43 Councilman Paust announced the Snow Removal Committee spent three (3) hours
44 looking at problem areas. There next meeting will be May 9 at 6:00 p.m.
45 in the Board of Works Room.

47 Councilman Ahaus announced the Transportation Committee is getting new
48 information and hope to have a recommendation in two to four weeks.

50 Councilman Mills moved to suspend the rules and read Ordinance Nos.
51 28-1978, 29-1978, 30-1978, .31-1978 and 32-1978 on first reading by title
52 only, seconded by Councilman Paust and on unanimous voice vote, the motion
53 was carried.

14 Councilman Merchanthouse moved to suspend the rules and read Ordinance
15 No. 30-1978 on second reading, seconded by Councilman Ahaus and on unanimous
16 voice vote, the motion was carried.

20 Councilman Mills moved for engrossment of Ordinance No. 30-1978, seconded
21 by Councilman Paust and on unanimous voice vote, the motion was carried.

23 Councilman Mills moved to suspend the rules and read Ordinance No. 30-1978
24 on third and final reading by title only, seconded by Councilman Paust and
25 on unanimous voice vote, the motion was carried.

38 Councilman Merchanthouse moved to suspend the rules and read Ordinance No.
39 31-1978 on second reading, seconded by Councilman Welch and on unanimous
40 voice vote, the motion was carried.

49 on unanimous voice vote, the motion was carried.

3 The Clerk read on second reading Ordinance No. 22-1978 - APiSPECIAL
4 ORDINANCE AUTHORIZING A SPECIAL USE FOR 2050 CHESTER BLVD. SITUATE IN AN
5 R-2 DISTRICT, TO RE A NURSING HOME.

7 Assistant Director of City Planning Dan Dooley stated the Plan Commission
8 conducted a public hearing on April 25, 1978 and voted six (6) to zero
9 (0) to allow this Special Use with the following conditions.
10
11 1. All surface and storm water drainage for the project be conducted
12 to the drainage swale at the west end of Heritage House property;
13 .2. that the engineering drawing for surface and storm water drainage
14 be prepared, by a professional engineer subject to the approval of
15 Friends Fellowship and the City Engineer's office; and,
16 3. after the construction of drainage swales and improvements, the
17 professional engineers shall certify to the City Planning
18 - Department all construction was done according to specifications
19 outlined in the plans and drawings.

22 of Heritage House of Richmond, Inc.

24 Councilman Merchanthouse moved for engrossment of Ordinance No. 22-1978,
25 seconded by Councilman Williams and on unanimous voice vote, the motion
26 was carried.

28 Councilman Carter stated he has a financial interest in this Ordinance and
29 requested he be allowed to abstain from voting.

31 Councilman Mills moved to allow Councilman Carter to abstain, seconded by
32 Councilman Paust and on unanimous voice vote, the motion was carried.

16 City Attorney Ed Anderson examined proof of publication for Ordinance No.
17 25-1978 and found it. to be in order. Councilman Mills moved it be
18 accepted and filed, seconded by Councilman Paust and on unanimous voice
19 vote, the motion was carried.

21 Councilman Paust moved for engrossment of Ordinance No. 25-1978, seconded
22 by Councilman Mills and on unanimous voice vote, the motion was carried.

24 Councilman Mills moved to suspend the rules and read Ordinance No. 25-1978
25 on third and final reading, seconded by Councilman Paust and on unanimous
26 voice vote, the motion was carried.

45 by Councilman Mills and on unanimous voice vote, the motion was, carried.
