HomeMy Public PortalAbout04-03-1978 375 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, APRIL 3, 1978 1 The Common Council of the City of Richmond, Indiana met in regular session 2 April 3, 1978 at the hour of 7:30 p.m. in the Council Chambers in the 3 Municipal Building in said City. President Austerman presided with the 4 following members present: Messrs. Elstro, Williams, Ahaus, Merchanthouse, 5 Mills, Carter, Paust and Welch. Absent: None. The following business 6 was had, to-wit: 7 8 Councilman Paust gave devotions. 9 10 Councilman Merchanthouse reported he was absent from the previous meeting 11 as he was out of town on business. 12 13 Councilman Williams moved to approve the minutes of the previous meeting 14 as prepared, seconded by Councilman Mills and on unanimous voice vote, 15 the motion was carried. 16 • 17 Councilman Mills moved to suspend the rules and read Resolution No. 18 9-1978 by title only, seconded by Councilman Williams and on unanimous 19 voice vote, the motion was carried. 20 21 The Clerk read by title only Resolution No. 9-19787' A RESOLUTION'TO = 22 TRANSFER'WITHIN THE GENERAL FUND. 23 24 Councilman Merchanthouse moved for adoption of Resolution No. 9-1978, 25 seconded by Councilman Mills and on unanimous voice vote, the motion was 26 carried. 27 28 Mayor Clifford Dickman announced that today begins the Spring clean-up 29 for the City. 30 31 There was discussion of the condition of the surface of the pavement, 32 lack of sidewalks, and standing water on Southeast Parkway. There are 33 no major plans for this area other than standard maintenance. Mr. George 34 Webb stated Dr. Fox is making a deceleration lane for his new development. 35 36 Councilman Williams requested the Board of Works examine the bus route in 37 North Richmond. He further requested the Board to find out why the 38 street in the 600 block of Northwood Drive was torn up. 39 40 City Controller Don Meredith stated that the new computer housed in the 41 City Building will be used in issuing the next pay checks. 42 43 Councilman Paust reported the Parks & Recreation, Public Safety and Public 44 Works & Sanitation Committee met and recommend passage of Ordinance Nos. 45 16-1978, 17-1978, 18-1978, and 19-1978. 46 47 Councilman Mills stated there will be a meeting of the Committee of the 48 Whole on April 10, 1978 at 7: 30 p.m. in the Board of Works room. This 49 meeting will be to discuss the Social .Services Planning report and 50 Ordinance No. 20-1978. 51 52 Councilman Paust announced the next meeting of the Snow Removal Committee 53 will be on, April 11, 1978 at 6:00 p.m. in the Board of Worksr.00m. 54 55 President Austerman announced a meeting for April 27, 1978 at 4:00 p.m. 56 in the Board of Works Room with the Chamber. of Commerce. 57 58 President Austerman announced a meeting for April 12, 1978 at 7:30 p.m. at 59 the Park Office with the Park hoard and concerned citizens with regards 60 to plans for the Whitewater Gorge Project. 37(i Common Council Minutes Cont. April 3, 1978 Page 2 1 Councilman Mills moved to suspend the rules and read Ordinance Nos. 20-1978, 2 21-1978, 22-1978, 23-1978, and 24-1978 on first reading by title only, 3 seconded by Councilman Ahaus and on unanimous voice vote the motion was 4 carried. 5 6 The Clerk read on first reading%by title only Ordinance No. 20-1978 - 7 AN ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 8 9 President Austerman announced Ordinance No. 20-1978 is referred to the 10 Committee of the Whole and has to be advertised. 11 12 The Clerk read on first reading by title only Ordinance No. 21-1978 - 13 AN ORDINANCE TO APPROPRIATE WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 14 15 President Austerman announced Ordinance No. 21-1978 is referred to the 16 Committee of the Whole and has to be advertised. 17 - 18 The Clerk read on first reading by title only Ordinance No. 22-1978 - 19 A SPECIAL ORDINANCE AUTHORIZING A "SPECIAL USE" FOR 2050 CHESTER RLVD. 20 SITUATE IN AN R-2 DISTRICT, TO BE A NURSING HOME. 21 22 President Austerman announced Ordinance No. 22-1978 is referred to the Plan 23 Commission. 24 25 The Clerk read on first reading by title only Ordinance No. 23-1978 - 26 AN ORDINANCE AUTHORIZING A "SPECIAL USE" IN AN R-2 DISTRICT. BEING AN 27 ACCESS DRIVE TO A C-2 COMMUNITY BUSINESS SITUATED ON PART OF LOTS 6, 8, 28 AND 9 GLEN HEIGHTS AND 80 FEET SE 1/4, 34-14-1. 29 30 President Austerman announced Ordinance No. 23-1978 is referred to the 31 Plan Commission. • 32 33 The Clerk read on first reading by title only Ordinance No. 24-1978 - 34 AN ORDINANCE TO APPROPRIATE FROM THE CUMULATIVE CAPITAL IMPROVEMENT FUND 35 (CIGARETTE TAX) : 36 37 President Austerman announced Ordinance No. 24-1978 is referred to the 38 Committee of the Whole and has to be advertised. 39 40 The Clerk read on second reading Ordinance No. 12-1978 - AN ORDINANCE 41 AMENDING ORDINANCE NO. 2325-1968 COMMONLY-KNOWN AS THE ZONING ORDINANCE 42 OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 43 44 Explaining Ordinance No. 12-1978 was City Plan Director Bob Goodwin. He 45 noted the Plan Commission voted 6 - 1 for passage of Ordinance No. 12-1978. 46 47 Councilman Elstro moved for engrossment of Ordinance No. 12-1978, seconded 48 by Councilman Paust and on unanimous voice vote, the motion was carried. 49 50 Councilman Elstro moved to suspend the rules and read Ordinance No. 12-1978 51 on third and final reading by title only, seconded by Councilman Williams, 52 and on unanimous voice vote, the motion was carried. 53 54 The Clerk read on third reading by title only Ordinance No. 12-1978. 55 56 Ordinance No. 12-1978 was placed on final passage or rejection and on a 57 call of the roll the following was recorded: Ayes: Elstro, Williams, 58 Ahaus, Merchanthouse, Mills, Carter, Paust, and Austerman. Noes: Welch. 59 The vote being eight (8) to one (1) in favor of passage of Ordinance No. 60 12-1978. 377 Common Council Minutes Cont. April 3, 1978 Page 3 1 The Clerk read on second reading Ordinance No. 16-1978 - AN ORDINANCE 2 CONCERNING NUISANCES AND TO FACILITATE THE REMOVAL THEREOF. 3 4 Councilman Paust moved for engrossment of Ordinance No. 16-1978, 5 seconded by CouncilmanWelch and on unanimous voice vote, the motion was 6 carried. 7 8 Councilman Paust moved to suspend the rules and read Ordinance No. 9 16-1978 on third and final reading by title only, seconded by Councilman 10 Williams and on unanimous voice vote the motion was carried. 11 12 The Clerk read on third reading by title only Ordinance No. 16-1978. 13 14 Ordinance No. 16-1978 was placed on final passage or rejection and on a 15 call of the roll the following was recorded: . Ayes: Elstro, Williams, 16. Ahaus, Merchanthouse, Mills, Carter, Paust, Welch, and Austerman. Noes: 17 - None. The vote bing nine (9) to zero (0) in favor of passage of Ordinance 18 No. 16-1978. 19 20 The Clerk read on second reading Ordinance No. 17-1978 - AN ORDINANCE 21 TO PROVIDE FOR PROCEDURES TO BE USED IN THE EVENT OF AN ALLEGED VIOLATION 22 OF AN ORDINANCE OF THE CITY OF RICHMOND BY WHICH A LICENSE OR PERMIT IS 23 ISSUED. 24 25 Councilman Williams moved for engrossment of Ordinance No. 17-1978, 26 seconded by Councilman Mills and on unanimous voice vote, the motion was 27 carried. 28 29 Councilman Mills moved to suspend the rules and read Ordinance No. 17-1978 30 on third and final reading by title only, seconded by Councilman Welch 31 and on unanimous voice vote, the motion was carried. 32 • 33 The Clerk read on third reading by title only Ordinance No. 17-1978. 34 35 Ordinance No. 17-1978 was placed on final passage or rejection and on 36 a call of the roll the following was recorded: Ayes: Elstro, Williams, 37 Ahaus, Merchanthouse, Mills, Carter, Paust, Welch, and Austerman. Noes: 38 None. The vote being nine (9) to zero (0) in favor of passage of 39 Ordinance No. 17-1978. 40 41 The Clerk read on second: reading Ordinance No. 18-1978 - AN ORDINANCE 42 TO FACILITATE THE REMOVAL AND DISPOSAL OF ABANDONED VEHICLES IN THE 43 CITY OF RICHMOND, WAYNE COUNTY, INDIANA. 44 45 Councilman Williams moved for engrossment of Ordinance No. 18-1978, 46 seconded by Councilman Welch. The motion was defeated. 47 48 Answering Councilmen's question concerning this Ordinance was Assistant 49 City Attorney Robert Hudson. 50 51 Councilman Mills moved for engrossment of Ordinance No . 18-1978, seconded 52 by Councilman Carter and on unanimous voice vote, the motion was carried. 53 54 Councilman Mills moved to suspend the rules and read Ordinance No. 55 18-1978 on third and final reading by title only, seconded by Councilman 56 Paust and on unanimous voice vote, the motion was carried. 57 58 The Clerk read on third reading by title only Ordinance No. 18-1978. 59 60 Ordinance No. 18-1978 was placed on final passage or rejection and on 61 a call of the roll, the following was recorded: Ayes: Elstro, 62 Williams, Ahaus, Merchanthouse, Mills, Carter, Paust, Welch, and Austerman. 63 Noes: None. April 3, 1978 Page 4 1 The Clerk read on second:. reading Ordinance No. 19-1978 - AN ORDINANCE 2 TO AMEND GENERAL PENALTY PROVISIONS OF THE MUNICIPAL CODE OF THE CITY OF 3 RICHMOND, INDIANA. 4 5 Councilman Mills .moved for engrossment of Ordinance No. 19-1978, seconded 6 by Councilman Paust, and on unanimous voice vote, the motion was carried. 7 8 Councilman Mills moved to suspend the rules and read Ordinance No. 19-1978 9 on third and final reading by title only, seconded by Councilman Paust, 10 and on unanimous voice vote, the motion was carried. 11 12 The Clerk read on third reading by title only Ordinance No. 19-1978. 13 14 Ordinance No. 19-1978 was placed on final passage or rejection and on a 15 call of the roll the following was. recorded: Ayes: Elstro, Williams, Ahaus, 16 Merchanthouse, Mills, Carter, Paust, Welch, and Austerman.
