SPECIAL MEETING
PROCEEDINGS. OF THE -COMMON COUNCIL OF TNT
CITY OF RICHMOND, INDAINA, FEBRUARY 20, 1978
1 The Common Council of the City of Richmond, Indiana met in special
2 session February 20, 1978 immediately following the regularily
3 scheduled meeting in the Council Chambers in the Municipal Building
4 in said City. President Austerman .presided with.the following
5 members present: Messrs. Elstro, Williams, Ahaus, Merchanthouse,
6 Carter., Mills, Paust, and Welch. Absent: None. The following
7 business was had, to-wit:

10 President Austerman stated the purpose of this special meeting is to
11 consider on third reading Ordinance No. 3294-1977.

13 Councilman Mills moved to suspend the rules and read..Ordinance No.
14 3294-1977 on third reading by title only, seconded by Councilman
15 Ahaus and on unanimous voice vote the motion was carried.

17 The Clerk read on third reading by title only Ordinance No. 3294-1977.

19 In answer to Councilman Elstr.o`s question as to this meeting. being
20 legal, City Attorney Ed Anderson. stated in his opinion this is a
21 legal meeting.

23 President Austerman stated he called this. special meeting. He
24 notified the Clerk to send out notices of the special meeting, which
25 was done in the required time period. He further stated the Ordinance
26 is being reconsidered under Rule II number 21.

28 Councilman Ahaus .moved_ to allow Councilman Carter to disqualify himself
29 from voting on this Ordinance as he had done previously to comply with
30 State statute, seconded by Councilman Mills and on unanimous voice vote
31 the motion was carried.

33 President Austerman then asked if anyone in the audience who
34 qualifies would serve on Council. No one came forward.

36 Ordinance No. 3294-1977 was placed on final- passage or rejection and on
37 a call of the roll the following was recorded: Ayes: Ahaus, Mills,
38 Paust, Welch, and Austerman. Noes: Elstro, Williams, and Merchanthouse.
39 The vote being five (5) to three (3) in favor of passage of Ordinance
40 No. 3294-1977.

42 There being no further.business on motion duly made, seconded and
43 passed the meeting was adjourned.
