HomeMy Public PortalAbout02-20-1978 361 PROCEEDINGS OF .THE COMMON COUNCIL..OF. _THE CITY OF RICHMOND, INDIANA, FEBRUARY 20, 1978 1 The Common Council of the City of Richmond, Indaina met in regular 2 session February 20, 1978 at the hour of 7:30 p.m. in the Council • 3 Chambers in the Municipal Building. in said City. President Austerman 4 presided with the following .members present: Messrs. Elstro, Williams, 5 Merchanthouse, Carter, Mills, Paust, and Welch. Absent: None. The 6 following business was had, to-wit: 7 8 - Councilman Elstro gave devotions. .9 10 Councilman Williams moved to approve the minutes of the previous meeting 11 as prepared, seconded by Councilman Mills and on unanimous voice vote 12 the motion was carried. 13 14 Councilman Mills moved to suspend the rules and read Resolution No. "15 5-1978 by title only, seconded by Councilman Williams and on unanimous 16 voice vote the motion was carried. 17 18 The Clerk read -by title only Resolution No. 5-1978 - RESOLUTION 19 AUTHORIZING THE FILING. OF AN.APPLICATION WITH- .THE .DEPARTMENT OF 20 HOUSING AND URBAN DEVELOPMENT, FOR COMMUNITY DEVELOPMENT..BLOCK GRANT 21 FUNDS, AS PROVIDED IN TITLE I OF THE COMMUNITY DEVELOPMENT ACT 1974, 22 P .L. 93-383. 23 24 Community Development Director Tim Ryder explained this is. a 25 procedural step to apply for the fourth year Community Development 26 Block Grant Funds totaling $933,000. 27 28 Councilman Merchanthouse moved for adoption of Resolution No. 5-1978, 29 seconded by Councilman Williams and on unanimous voice vote the motion 30 was carried. . 31 32 President Austerman announced he is adding Councilman Welch to the 33 Community Development, Community Service and Transportation Committee. 34 35 President Austerman stated he had asked Councilman Williams to serve 36 on the Public Safety Committee to study and recommend more effective 37 ways of removing the ice and snow as Councilmen. Merchanthouse and 38 Elstro have declined. Councilman Williams made a statement declining. 39 40 Councilman Austerman requested Councilman Welch. serve on the Public 41 Safety Committee. Councilman Welch consented to serve on this 42 Committee.. 43 44 Councilman Ahaus reported the Transportation, Community Development 45 ' and Community Service Committee. is in the process of 'raking a study 46 of public transportation system and .the Transportation. Advisory 47 Committee is meeting with. specific, objectives in mind and will give 48 recommendations March 3, 1978 at 10:00 a.m. in the Board of Works Room. 49 50 Councilman Mills moved to suspend the rules and read Ordinance Nos. 51 12-1978 and 13-1978 on first reading by title only, seconded by 52 Councilman Carter and on unanimous voice vote the motion was carried. 53 54 The Clerk read on first reading by title only Ordinance No. 12-1978 - 55 AN ORDINANCE AMENDING ORDINANCE NO.. 2325-1968, COMMONLY KNOWN AS THE 56 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 57 - 58 President Austerman announced Ordinance No. 12-1978 is referred to the 59 Plan Commission for their study and recommendation. 362 Common Council Minutes Cont. February 20, 1978 Page 2 1 The Clerk read on first reading by title only Ordinance No. 13-1978 - 2 AN ORDINANCE APPROVING RULES AND REGULATIONS FOR THE CURTAILMENT. OF 3 ELECTRIC SERVICE RENDERED BY THE MUNICIPAL UTILITY OF THE CITY. OF 4 RICHMOND, INDIANA, RICHMOND POWER AND LIGHT, TO ITS VARIOUS USERS OF 11/ 5 ELECTRIC POWER. 6 7 Councilman Ahaus moved to suspend the. rules and read Ordinance No. 8 13-1978 on seconded reading, seconded by Councilman Williams and on 9 unanimous voice vote the motion was carried. 10 11 The Clerk read on second reading Ordinance No. 13-1978. 12 13 Councilman Mills moved for engrossment of Ordinance No. 13-1978, 14 seconded by Councilman Williams and on unanimous voice vote the motion 15 was carried. 16 17 Councilman Mills moved to suspend the rules and read Ordinance No. 18 13-1978 on third and final reading by title only, seconded by 19 Councilman Williams and on unanimous voice vote the motion was carried. 20 21 The Clerk read on third reading by title only Ordinance No. 13-1978. 22 23 Ordinance No. 13-1978 was placed on final passage or rejection and 24 on a call of the roll the following was recorded: Ayes: Elstro, 25 Williams, Ahaus, Me-rchanthouse, Mills, Carter, Paust, Welch, and 26 Austerman. Noes: None. The vote being nine (9) to zero (0) in favor 27 of passage of Ordinance No. 13-1978. 28 29 The Clerk read on second;` reading Ordinance No.3294-1977 - AN 11/ 30 ORDINANCE TO REPEAL ORDINANCE NO. 3203-1977. 31 32 Councilman Welch moved to allow Councilman Carter to disqualify 33 himself from voting on this Ordinance as he had done previously to 34 comply with State statute, seconded by Councilman Ahaus and on unanimous 35 voice vote the motion was carried. 36 37 President Austerman opened nominations for an elector to replace 38 Councilman Carter. 39 40 Councilman Mills nominated Mr. Charles Howell to replace Councilman 41 Carter, seconded by Councilman Paust. Mr. Howell declined. 42 43 President Austerman then asked if anyone in the audience who qualifies 44 and would serve on Council. No one being willing, the public hearing 45 was held. 46 47 Speaking for Ordinance No. 3294-1977 was Director of the Department of 48 City Planning Robert Goodwin. 49 50 Speaking against Ordinance No. 3294-1977 was Mr. Robert Burton, 51 Attorney for Remonstrators, and Mr. Cedric Miller, 23rd and Wernle Road. 52 53 Councilman Mills. moved for engrossment of Ordinance No. 3294-1977, 54 seconded by Councilman Ahaus. The motion carried with Councilman 55 Merchanthouse voting no. 56 57 Councilman Mills moved to suspend the rules and read Ordinance No. 58 3294-1977 on third and final reading by title only, seconded by 59 Councilman Ahaus. Councilmen Elstro, Merchanthouse and Williams voted 60 no. 363 Common Council Minutes Cont. February 20, 1978 Page 3 1 The Clerk read on second reading Ordinance No. 8-1978 -- AN ORDINANCE 2 TO AMEND AMENDED ORDINANCE NO. 3267-1977 OF THE. CITY OF RICHMOND, 3 WAYNE COUNTY, INDIANA, KNOWN AS MASSAGE PARLOR ORDINANCE. 4 5 Councilman Mills reported the Committee of the Whole net concerning this 6 Ordinance Monday, February 13, 1978 and it is the recommendation of the 7 Committee to table this Ordinance. 8 9 Councilman Mills moved Ordinance No. 8-1978 be tabled, -seconded by 10 Councilman Merchanthouse and on unanimous voice vote the motion was 11 carried. 12 13 The Clerk read on second reading Ordinance No. 11-1978 - AN ORDINANCE 14 TO APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 15 16 City Controller Don Meredith. recommended Ordinance No. 11-1978 be 17 amended to be reduced by $75,000. for the Ordinance to read $325,000. 18 19 Councilman Mills_ moved to amend Ordinance No. 11-1978 to $325,000. 20 instead of $400,00., seconded by Councilman Paust and on unanimous 21 voice vote the motion was carried. 22 23 City Attorney Ed Anderson examined proof of publication for Ordinance 24 No. 11-1978 and found it to be in order. Councilman Mills moved the 25 proof of publication be accepted and filed, seconded by Councilman 26 Carter and on unanimous voice vote the motion was carried. 27 28 Councilman Mills .moved .for engrossment of_ Amended- Ordinance No. 29 11-1978, seconded by Councilman Williams and on unanimous voice vote 30 the motion was carried. 31 32 Councilman Mills moved to suspend the rules and read. Amended 33 Ordinance No. 11-1978 on third and final reading by title only, 34 seconded by Councilman Williams and on unanimous voice vote the motion 35 was carried. 36 37 The Clerk read on third reading by title only Amended Ordinance No. 38 11-1978. 39 40 Amended Ordinance No. 11-1978 was placed on final passage or rejection 41 and on a call of the roll the following was recorded: Ayes: Elstro, 42 Williams, Ahaus, Merchanthouse, Mills, Carter, Paust, Welch, and 43 Austerman. Noes: None. The vote being nine (9) to zero (0) in favor 44 of passage of Amended Ordinance No. 11-1978. 45 46 Councilman Elstro announced .Tabled Ordinance No. 3228-1977 will be put 47 off longer due to RP&L-being busy with the energy crisis. 48 . 49 There being no further business on motion duly made, seconded and 50 passed the meeting was adjourned. 51 52 Thomas L.
