HomeMy Public PortalAbout01-03-1978 347 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, JANUARY 3, 1978 1 The Common Council of the City of Richmond, Indiana met in regular 2 session January 3, 1978 at the hour of 7:30 p.m. in the Council 3 Chambers in the Municipal Building in said City. President Carter 4 presided with the following members present: Messrs. Elstro, 5 Williams, Ahaus, Austerman, Mills, and Paust. Absent: Merchanthouse. 6 The following business was had, to - wit: 7 8 Councilman Ahaus gave devotions. 9 10 President Carter announced the election of a new President of Council 11 for the year 1978 and opened the floor for nominations. 12 13 Councilman Ahaus nominated Councilman Austerman for President, seconded 14 by Councilman Mills. 15 16 Councilman Mills moved the nominations be closed, seconded by Councilman 17 Ahaus and on unanimous voice vote the motion was carried. 18 19 On unanimous voice vote Councilman Ahaus' nomination of Councilman 20 Austerman for President was carried. 21 22 President Carter thanked all his fellow Councilmen for giving him the 23 privilege of serving as their President. 24 President Austerman ust erman appointed Councilman Paust as President Pro-Tem 26 of Council. 27 28 President Austerman Announced the following committees for the year 1978: III 29 Transportation, Community Development Pment and Community Service Committee: 31 Rich Ahaus, Chairman, Jim Carter and Marion Williams. 32 33 Parks & Recreation, Public Safety & Public Works and Sanitation: Ken 34 Paust, Chairman, Mills, Greg Merchanthouse, Jack Elstro, and the new 35 member to be selected. 36 37 Committee of the Whole and Finance Committee: Ken Mills, Chairman and 38 all Councilmen. 39 40 Laison to Reid Hospital - Tom Austerman; Art Association - Marion 41 Williams; Animal Welfare - Ken Paust; Park Board - Greg Merchanthouse; 42 Social Services Planning Board - Ken Mills; Airport Board - Rich Ahaus. 43 The election of a member to the Plan Commission will not be held until 44 there is a full Council. 45 46 Councilman Williams moved to approve the minutes of the previous meeting 47 as prepared, seconded by Councilman Mills and on unanimous voice vote, 48 motion was carried. 49 50 The Clerk read in full Resolution No. 1-1978 - A RESOLUTION RECOGNIZING 51 ROGER CORNETT FOR HIS CONTRIBUTION TO THIS COMMUNITY. III 52 53 Councilman Carter moved for adoption of Resolution No. 1-1978 with a 54 copy to go to Roger Cornett, seconded by Councilman Ahaus and on 55 unanimous voice vote, motion was carried. 56 Councilman Mills moved to s 57 uspend the rules and read Resolution No. 58 2-1978 by title only, seconded by Councilman Carter and on unanimous 59 voice vote, motion was carried. 348 Council Minutes Cont. January 3, 1978 Page 2 1 The Clerk read by title only Resolution No. 2-1978 - A RESOLUTION TO 2 TRANSFER WITHIN THE GENERAL FUND. 3 4 Speaking for Resolution No. 2-1978 was Chief of Police Charles Chris. 5 6 Councilman Mills moved for adoption of Resolution No. 2-1978, seconded by 7 Councilman Paust and on unanimous voice vote the motion was carried. 8 9 Councilman Williams moved to reconsider tabled Resolution No. 42-1977, 10 seconded by Councilman Mills and on unanimous voice vote the motion was 11 carried. 12 13 The Clerk read by title only Resolution No._-42-1977 - A RESOLUTION ADOPTING 14 A FISCAI PLAN AND FISCAL POLICY FOR THE PROVISION OF MUNICIPAL SERVICES 15 TO NEWLY ANNEXED TERRITORIES . 16 17 Councilman Paust moved for adoption of Resolution No. 42-1977, seconded by 18 Councilman Mills . The motion carried with Councilmen Elstro and Williams 19 voting no. 20 21 City Controller Don Meredith reported he checked with the Wayne County 22 Health Department concerning the air pollution of Kemper Brothers. He 23 was told that Kemper Brothers are complying with regulations of the County 24 and State Health Departments. 25 26 Mr. Meredith presented a petition from Charles Miles for street lights 27 to the Street Light Committee. 28 29 President Austerman requested the Transportation Committee study and 30 recommend the adult transportation system and report back no later than 31 the first Council meeting in March. 32 33 Councilman Mills announced there will be a meeting of the Finance and 34 Committee of the Whole on February 4 at the Holiday Inn in the Richmond 35 Room from 10:00 a.m. to 4:00 p.m. The purpose is to discuss with the 36 Departmat Heads and Administration the use of Revenue Sharing Funds. 37 38 councilman Mills moved to suspend the rules and read Ordinance Nos. 39 1-1978=,. 2-1978, and 3-1978 on first reading by title only, seconded by 40 Councilman Paust and on unanimous voice vote the motion was carried. 41 42 The Clerk read on first reading by title only Ordinance No. 1-1978 - AN 43 ORDINANCE AMENDING AMENDED ORDINANCE NO. 3238-1977 COMMONLY KNOWN AS THE 44 - SALARY AND POSITION ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED 45 AUGUST 1, 1977. 46 47 Councilman Mills moved to suspend the rules and read Ordinance No. 1-1978 48 on second reading, seconded by Councilman Williams and on unanimous voice 49 vote the motion was carried. 50 51 The Clerk read on second reading Ordinance No. 1-1978. 52 53 Councilman Mills moved for engrossment of Ordinance No. 1-1978, seconded11/ 54 by Councilman Paust and on unanimous voice vote the motion was carried. 55 56 The Clerk read on third reading by title. only Ordinance No. 1-1978. 349 Council Minutes Cont. January 3, 1978 Page 3 1 Ordinance No. 1-1978 was placed on final passage or rejection and on a 2 call of the roll the following was recorded: Ayes: Elstro, Williams, 3 Ahaus, Mills, Carter, Paust, and Austerman. Noes: None. The vote being 4 seven (7) to zero (0) in favor of passage of Ordinance No. 1-1978. 5 6 The Clerk read on first reading by title only Ordinance No. 2-1978 - AN 7 ORDINANCE TO APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST FUND. 8 9 President Austerman announced Ordiance No. 2-1978 has to be advertised. 10 11 The Clerk read on first reading by title only Ordinance No. 3-1978 - AN 12 ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING 13 ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 14 15 President Austerman announced Ordinance No. 3-1978 is referred to the Plan 16 Commission for their study and recommendation. 17 18 The Clerk read on second reading Ordinance No. 3296-1977 - AN ORDINANCE 19 AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF 20 THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 21 22 Councilman Paust moved to dispense with the reading of the letter from•the 23 Plan Commission noting their vote of six (6) to zero (0) recommending 24 approval seconded by Councilman Mills and on unanimous voice vote the 25 motion was carried. 26 27 Councilman Mills moved far engrossment of Ordinance No. 3296-1977, seconder 28 by Councilman Elstro and on unanimous voice vote the motion was carried. 29 - 30 Councilman Mills moved to suspend the rules and read Ordinance No. 31 3296-1977 on third and final reading by title only, seconded by 32 Councilman Paust and on unanimous voice vote the motion was carried. 33 34 The Clerk read on third reading by title only Ordinance No. 3296-1977. 35 36 Ordinance No. 3296-1977 was placed on final passage or rejection and on 37 a call of the roll the following was recorded: Ayes: Ahaus, Mills, Carter, 38 Paust, Elstro, Austerman. The vote being six (6) to one 39 (1) in favor of passage of Ordinance No. 3296-1977. 40 41 The Clerk read on second reading Ordinance No. 3308-1977 - AN 42 ORDINANCE AUTHORIZING A RESIDENTIAL DEVELOPMENT UNIT PROJECT PURSUANT TO 43 ARTICLE 45 OF ORDINANCE 2325-1968, AND PROVIDING FOR A SPECIAL USE 44 PURSUANT TO ARTICLE 48 OF ORDINANCE 2325-1968 COMMONLY CALLED THE 45 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA APPROVED JUNE 3, 1968. 46 47 Councilman Ahaus moved to dispense with the reading of the letter from 48 the Plan Commission, seconded by Councilman Elstro and on unanimous voice 49 vote the motion was carried. The Plan Commission voted six (6) to zero ;(0) 50 to recommend approval. 51 52 Speaking for Ordinance No. 3308-1977 was Mr. Gayle Gardner, Attorney with 53 Harrington, Gardner, Maley and Sayre, 304 Peoples Building and Pastor 54 Paul Knecht. 55 56 Councilman Williams moved for engrossment or Ordinance No. 3308-1977, seconded 57 by Councilman Elstro and on unanimous voice vote the motion was carried. 58 59 Councilman Williams moved to suspend the rules and read Ordinance No. 60 3308-1977 on third and final reading by title only, seconded by Councilman 61 Elstro and on unanimous voice vote the motion was carried. 350 Council Minutes Cont. The vote 6 being seven (7) to zero (0) in favor of passage of Ordinance No. 3308-1977 7 8 The Clerk read on second reading Ordinance No. 3309-1977 - AN ORDINANCE 9 REZONING A PART OF THE NORTHEAST QUARTER OF SECTION NINE (9) , TOWNSHIP 10 THIRTEEN (13) NORTH, RANGE ONE WEST FROM R-2 (SINGLE FAMILY RESIDENTIAL) 11 TO C-1 (NEIGHBORHOOD BUSINESS) CLASSIFICATION PROVIDING FOR A NEIGHBORHOOD 12 COMMERCIAL CENTER PURSUANT TO ARTICLE 45 OR ORDINANCE NO. 2325-1968 COMMONLY 13 CALLED THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA APPROVED JUNE 3, 1968. 14 - 15 Councilman Williams moved to dispense with the reading of the letter from the 16 Plan Commission noting their vote of six (6) to zero (0) for approval, 17 seconded by Councilman Elstro and on unanimous voice vote the motion was 18 carried. 19 20 Councilman Elstro moved for engrossment of Ordinance No. 3309-1977, 21 seconded by Councilman Mills and on unanimous voice vote the motion was 22 carried. 23 24 Councilman Elstro moved to suspend the rules and read Ordinance No. 3309-1°77 25 on third and final reading by title only, seconded by Councilman Mills and 26 on unanimous voice vote the motion was carried. 27 28 The Clerk read on third reading by title only Ordinance No. 3309-1977. 29 30 Ordinance No. 3309-1977 was placed on final passage or rejection and on 31 a call of the roll the following;:was recorded: Ayes: Elstro, Williams, 32 Ahaus, Mills, Carter, Paust, and Austerman. Noes: None.
