HomeMy Public PortalAboutORD 02/01ORDINANCE NO. 02/1 AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AMENDING CHAPTER 30 OF THE TOWN CODE OF ORDINANCES RELATING TO TRAFFIC AND VEHICLES, CREATING A NEW SECTION 30 -4, ENTITLED PENALTIES FOR VIOLATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL OF ORDINANCES IN CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE TOWN COMMISSION OF THE TOWN OF GULF STREAM, PALM BEACH COUNTY, FLORIDA, AS FOLLOWS Section 1. The Town Code of Ordinances is hereby amended at Chapter 30, relating to Traffic and Vehicles, by creating a new Section 30 -4 to read as follows: (Words underlined are additions; words striskeR are deletions) "Sec. 30 -4. Penalties for Violation (a) It shall be unlawful for anv person to violate anv of the parking regulations of the Town and a fine of $25.00 shall be assessed for the foll_ o (1) Overtime parking (71 ParltinCJ'� e,rLn3;rin rJ{ c +ree� l3) Parkina at yellow curb (4) Blocking driveway (5) Parkina on Sidewalk (6) Trespassing by vehicle (7) No oarking (designated hours) 8) Parking too close to fire hydrant l9) No garkina an time (10) _ Double bark_inn (11) Obstructing traffic (121 Parkina in Inadinn zone _____L1 3) Vehicle parked across lines designated Parking space (14) Vehicle parked in wrong d irection on one way street (bl All other narking yioiations shall be as prescribed by aRpro riate state statute or other ordinance relating thereto and the fine for same shall bA25.00 unless othe ise specified therein -(c) Penalty for violating handicapped Parkina restrictions It is unlawful for anv erson to stop stand or park a vehicle within a Harkin" - .in space marked "Parking by Disabled Permit Only," unless such vehicle displays a parking permit issued pursuant to F S 320.0_48 and such vehicle is trans orting a person eligible for the narking Permit. The civil penalty for a violation of this section which would also be a violation of F.S. �$ 316.1955 and 31 1956 shall be 50 $� nn �++ i vv vv d) Delinquency payment for nonpayment of parking violation penalties Failure to pay penalties for violations of th s se t a� �� ��n� acs jo 1 willII11 /L hours from the time of issuance of the violation shall result in an additional delinquQ c penalty to the violator in the amount of $10.00. Failure to Hy the full penalty within five days of notice of such obligation may result in a summons being issued ordering and directing the violator to appear in county court or civil proceedings may be commenced to effectuate collection. The violator shall be responsible for all costs incurred by the Town to enforce the provisions of this section (e) Service charge for nonpayment--of parking violation enalties. Failure to pay penalties and delinquency assessments for violations of this section within 60 days of the issuance of the parking violation shall result in a service charge to the violator in the amount of X20.00 per citation in addition to the cost of the violation and delinquent penalty. Failure to -my penalties and delinquency assessments for violations of this section within 90 days of the issuance of the parking violation shall result in an additional service char e to the violator in the amount of $25 00 per citation in addition to the cost of the violation the original delinquent penalty and service charge." Section 2. Severability. If any provision of this Ordinance or the application thereof is held invalid, such invalidity shall not affect the other provisions or applications of this Ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions of this Ordinance are hereby declared severable. Section 3. Repeal of Ordinances in Conflict. All other ordinances of the Town of Gulf Stream, Florida, or parts thereof which conflict with this or any part of this Ordinance are hereby repealed. E Section 4, Codification. This Ordinance shall be codified and made a part of the official Code of Ordinances of the Town of Gulf Stream. Section 5. Effective Date. This Ordinance shall take effect immediately upon its passage and approval, as provided by law. PASSED AND ADOPTED in a regular, adjourned session on first reading this 12th day of April , 2002, and for a second and final reading on this loth day of may 2002.
