The Richmond Sanitary District,Commonwealth Engineers,Inc.,and SME geotechnical engineers shall bear no risk or additional cost if the Contractor's proposed siphon river crossing method is utilized and is unsuccessful. • The Contractor shall construct the siphon river crossing during a river flow and weather period that the Contractor deems acceptable. The time frame shall also be acceptable to the Richmond Sanitary District. • If during construction the Contractor deems their proposed siphon river crossing method is not successful,the Contractor will(a)construct the certified cofferdam design provided in the Contract Drawings at no additional cost to the Richmond Sanitary District, Commonwealth Engineers,Inc.,and SME or(b)obtain the services of a professional geotechnical engineer licensed in the State of Indiana to provide an alternative certified siphon river crossing design,and construct the river crossing in accordance with the engineer's plans,at no additional cost to the Richmond Sanitary District, Commonwealth Engineers,Inc.,and SME. • This submittal review shall be subject to the approval of a change order by the Richmond Sanitary District and shall not be considered applicable until the change order is executed.
