Bal Harbour Village Hall • 655 - 96th Street • Bal Harbour • Florida 33154 CALL TO ORDER/ PLEDGE OF ALLEGIANCE - Mayor Packer called the meeting to order at 7:01 P.M. The following were present: Mayor Martin Packer Councilman Gabriel Groisman Councilman Seth Salver Councilman Jaime Sanz The following were not present: Assistant Mayor Patricia Cohen Also present: Jorge M. Gonzalez, Village Manager Dwight S. Danie, Village Clerk Richard Weiss, Village Attorney Stephanie Marquez, Deputy Village Clerk Mayor Packer asked Council Groisman to lead the Pledge of Allegiance and congratulated him on the recent birth of his daughter. REQUESTS FOR ADDITIONS, WITHDRAWALS AND DEFERRALS PRESENTATIONS AND AWARDS Mr. Danie, and Richard Carmenaty, IT Support, provided a brief demonstration of the newly upgraded and audio/video equipment for the Chamber and Mr. Gonzalez commended Ramiro Inguanzo, John Oldenburg and the rest of Village Staff for Council Chamber renovations. VOTE: the Motion passed by unanimous voice vote (4-0). ******************* R5 - ORDINANCES (TO BE CONSIDERED AFTER THE FIRST BUDGET HEARING) R5A AN ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA; AMENDING THE BAL HARBOUR VILLAGE CODE OF ORDINANCES BY AMENDING DIVISION III "ARCHITECTURAL REVIEW BOARD" OF ARTICLE III "BOARDS, COMMITTEES AND COMMISSIONS" OF CHAPTER 2 "ADMINISTRATION" AUTHORIZING A FEE FOR APPLICATIONS TO THE ARCHITECTURAL REVIEW BOARD; AND AMENDING CHAPTER 6 "BUILDINGS AND BUILDING REGULATIONS" AMENDING PERMIT FEES; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. (FIRST READING) (BUILDING DEPARTMENT) Bal Harbour Village First Budget Hearing Minutes— September 13, 2016 2 Mr. Gonzalez summarized the item, stating the the current fees are out of balance fees, in that they do not cover the costs of the Building Department, resulting in the need for the General Fund to subsidize the costs. The current fee structure includes a $100 minimum permit fee and 1% of the value of the construction. He stated that the recommendation to the Council is: to increase the minimum permit fee to $150; to raise the percentage of the value of construction from 1 % to 2% for the first $1 million and, after $1 million, leave the percentage at 1 %; and to eliminate the surcharge for construction inside the Gated Community. He stated that this new structure is fair and would generate sufficient fees to cover the costs of the Building Department. MOTION: The Ordinance was moved for discussion by Councilman Seth Salver and seconded by Mayor Martin Packer. There was no public comment. Councilman Groisman commended Suramy Cabrera, Building Official, and Jorge Gonzalez. He commented that it was important to point out that the single family homes District has subsidized at least 20% of the cost of the Building Department. He stated that the suggested 150 lower and still not cover expenses recommend raise to $250 MOTION: A Motion to to amend the proposed ordinance to raise the minimum permit fee from $150 to $250 was Moved by Councilman Gabriel Groisman and seconded by Councilman Jaime Sanz. David Guela (10175 Collins Ave.) spoke against raising the minimum permit fees. Councilman Salver stated he was reluctant to further raise the fee in that it might become a barrier to compliance. VOTE: The motion amend failed by a tied voice vote (2-2) Mayor Martin Packer and Councilman Seth Salver voting in the positive and Councilman Jaime Sanz and Councilman Gabriel Groisman voting in the negative. Mr. Gonzalez summarized the item explaining that the Florida Statutes allow municipalities to amend business tax receipts, but only every other year, and if increasing, no greater that 5%. He stated that all of the fees would be increasing 5%. Sanz X ******************* FIRST BUDGET HEARING AGENDA R7 - RESOLUTIONS R7A A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR VILLAGE, FLORIDA, ADOPTING THE PROPOSED MILLAGE RATE OF THE VILLAGE FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2016 THROUGH SEPTEMBER 30, 2017, PURSUANT TO SECTION 200.065, FLORIDA STATUTES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. PUBLIC HEARING (FINANCE DEPARTMENT) Mr. Gonzalez read the State required millage rate statement into the record, stating that the proposed millage rate for Fiscal Year 2016-2017, while maintaining the existing rate, is 1.9654 mils, which is 11.45% higher than the State rollback rate of 1.7635 mils. He stated that this is the third lowest millage rate in Miami -Dade County and that the millage rate is set appropriately for the fiscal year. Sanz X ******************* R7B A RESOLUTION OF THE VILLAGE COUNCIL OF BAL HARBOUR, VILLAGE, FLORIDA, APPROVING AND ADOPTING THE TENTATIVE BUDGET FOR BAL HARBOUR VILLAGE FOR FISCAL YEAR 2016-17; PROVIDING FOR EXPENDITURE OF FUNDS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. PUBLIC HEARING (FINANCE DEPARTMENT) Mr. Gonzalez introduced the item stating that the proposed budge for Fiscal Year 2016-2017 is $14,767,000 for the General Fund, $3,706,000 for Resort Tax, $7,804,500 for the Water and Wastewater Utility Fund: $26,880,000 overall. He added that the goals are to enhance community policing efforts, to improve the beauty of public spaces, continue to invest in information technology, expand communication with residents and visitors establish and keep sustainable fiscal policies and plan for future capital. MOTION: A Motion to approve the resolution was moved my Mayor Martin Packer and seconded by Councilman Gabriel Groisman. Councilman Groisman commended the members of the Budget Advisory Committee for their efforts and input into the formulation of the budget. There were no public comments. Sanz X Bal Harbour Village First Budget Hearing Minutes— September 13, 2016 ******************* R7C A RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA, RELATING TO THE COLLECTION AND DISPOSAL OF SOLID WASTE AND RECYCLABLE MATERIALS IN BAL HARBOUR VILLAGE, FLORIDA; ESTABLISHING THE RATE OF ASSESSMENT; IMPOSING SOLID WASTE SERVICE ASSESSMENTS AGAINST ASSESSED PROPERTY LOCATED WITHIN BAL HARBOUR VILLAGE, FLORIDA; APPROVING THE ASSESSMENT ROLL; CONFIRMING THE INITIAL ASSESSMENT RESOLUTION; AND PROVIDING AN EFFECTIVE DATE. VOTE: The Motion passed by unanimous voice vote (4-0). ******************* R7D A RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA, RELATING TO THE PROVISION OF SECURITY AND LANDSCAPE SERVICES, FACILITIES AND PROGRAMS IN THE GATED RESIDENTIAL SECTION OF BAL HARBOUR VILLAGE, FLORIDA; ESTABLISHING THE RATE OF ASSESSMENT; IMPOSING SECURITY AND LANDSCAPE SERVICE ASSESSMENTS AGAINST ASSESSED PROPERTY LOCATED WITHIN THE GATED RESIDENTIAL SECTION OF BAL HARBOUR VILLAGE, FLORIDA; APPROVING THE ASSESSMENT ROLL; CONFIRMING THE INITIAL ASSESSMENT RESOLUTION; AND PROVIDING AN EFFECTIVE DATE. PUBLIC HEARING (FINANCE DEPARTMENT) Mr. Gonzalez - Summarized the item stating that the proposed unchanged rate would be $1,802 per single family residence, $901 for unimproved property and $7,208 for private recreational facilities, generating $424,000. MOTION: A Motion to approve the resolution was moved by Councilman Gabriel Groisman and seconded by Councilman Seth Salver. David Guela (10175 Collins Ave.) inquired why residents outside the Gated Community could not walk their dogs in the Gated Community, to which Mr. Weiss responded that the streets in the Gated Community were determined by the plat to be private. Bal Harbour Village First Budget Hearing Minutes —September 13, 2016 Page ******************* REGULAR COUNCIL MEETING AGENDA R7E A RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA, ESTABLISHING SANITARY SEWER AND WATER RATES FOR THE 2016-17 FISCAL YEAR; ESTABLISHING AN EFFECTIVE DATE. (FINANCE DEPARTMENT) Mr. Gonzalez summarized the item stating that the water rate would remain the same, but the sewer rate would be increased 2.3% as resulting from increases by the City of Miami Beach. (FINANCE DEPARTMENT) Mr. Gonzalez summarized the item stating that this item consolidated fees dispersed throughout Village Code. He indicated that most fees would remain unchanged, with the exception of the fees for Business Tax Receipts, which would be increasing 5%, as allowed by Florida Statues, and the elimination of the fee for alarm permits.
