AN ORDINANCE OF THE BOROUGH OF CARTERET
ADOPTING THE INTERCHANGE 12 REDEVELOPMENT PLAN
WHEREAS, the Local Redevelopment and Housing Law, N.J.S.A. 40A: 12A -1 et
seq., as amended and supplemented (the "Redevelopment Laws') provides a process for
municipalities to participate in the redevelopment and improvement of areas in need of
redevelopment; and
WHEREAS, by Resolution No. 15 -056, duly adopted on February 26, 2015, the
Borough determined that the area consisting of Block 701, Lot I on the Official Tax Map
of the Borough constituted an "area in need of redevelopment" in accordance with the
Redevelopment Law (the "Redevelopment Area "); and
WHEREAS, the Carteret Planning Board (the "Planning Board "), at the direction
of the Borough, caused to be prepared a redevelopment plan for the Redevelopment Area
(the "Redevelopment Plan", a copy of which is attached hereto as Exhibit A ; and
WHEREAS, on May 27, 2013, the Planning Board adopted a resolution of
findings and conclusions endorsing and recommending the Redevelopment Plan; and
NOW THEREFORE, BE IT ORDAINED AND ENACTED, by the Borough
Council of the Borough of Carteret, Middlesex County, New Jersey, as follows:
Section 1. The recommendations of the Planning Board as set forth in its May
27, 2015 resolution are hereby accepted.
Section 2. The Redevelopment Plan is hereby adopted as the official
redevelopment plan for the Redevelopment Area.
Section 3. The zoning district map of the Borough's Land Development
Ordinance is hereby amended to reflect the applicability of the Redevelopment Plan to
the Redevelopment Area and the Borough's Land Development Ordinance as it affects
the Redevelopment Area is hereby superseded by the Redevelopment Plan to the extent
set forth therein.
Section 4. Any and all ordinance or resolutions of the Borough, or provision
thereof, inconsistent with the provisions of this Ordinance shall be and are hereby
repealed as to the extent of any such inconsistencies.

Section 5. If any section, subsection, part, clause or phrase of this Ordinance
Or the Redevelopment Plan shall be declared invalid by judgment of any Court of
competent jurisdiction, such section, subsection, part or phrase shall be deemed to
be severable from the remainder of this Ordinance or the Redevelopment Plan, as
applicable.
Section 6. This Ordinance shall take effect upon fmal passage and publication
in accordance with applicable law.
Section 7. Upon the final adoption hereof, the Borough Clerk shall forward
certified copies of this Ordinance to Matthew C. Karrenberg, Esq., DeCotiis, FitzPatrick
& Cole, LLP, Special Redevelopment Counsel to the Borough.
