BACKGROUND: On October 12, 2021, pursuant to Elections Code section 10010(e)(3)(A), the City Council adopted Resolution No. 21-70 declaring its intent to transition from an at-large system for election of City Councilmembers to one based. on districts. The resolution also outlined specific steps to facilitate the transition. For more detail on the history leading to this decision, please see the Question/Answer sheet on the City's website created specifically to educate and inform the public on this subject. A link to the webpage is linked here: https://www.configuremillbrae .org/district-elections-fag Page I of4 18174503.1 Page 2 of 4 18174503.1 Currently, voters across the City of Millbrae vote "at-large" for all five Councilmembers. A “by-district” election is one in which the City is divided into separate districts, each represented by one City Councilmember who resides in that district and is chosen only by that district's voters. The first by-district City Council election will occur on the November 8, 2022 general municipal election, with the transition to district-based elections fully completed in the November 2024 general election. The City Council has held five public hearings for the City’s transition to by-district elections. At these hearings, the City's demographer made a presentation regarding the requirements for by-district elections, and the process for taking public input to help determine how the City Council districts might be constructed. The City Council then heard from the public on the various communities of interest that exist in the City, and how the districts might be drawn to recognize these communities of interest. The City Council and City Staff also sponsored several community workshops and outreach at community events in December and January. Although the law requires the City to hold five public hearings, the City Council will hold seven public hearings, as it desired to provide as many opportunities as possible for the public to comment. In addition to input on communities of interest and district composition, the City Council also invited input on whether to have four districts and an at-large directly-elected Mayor, or five districts with the Mayor selected by the City Council on a rotating basis. At the December 8, 2021 hearing, based on input from the public, the City Council voted to proceed with a five-district system with the mayoral rotation, and directed its demographer to draft maps that divide the City into five districts in preparation for the January 11, 2022 public hearing. At the January 11th and January 25th Public Hearings the City Council received, reviewed and heard public input in regards to the first and second set of draft maps that were presented by the City’s demographer. The purpose of this public hearing is to allow for additional discussion, receive community feedback and provide direction to the demographer on any revisions to be considered and presented at the final scheduled public hearing on February 22, 2022. The final set of draft maps is scheduled to be posted for public review by Tuesday February 15th pursuant to State law. At the February 22, 2022 public hearing, City Council is scheduled to adopt the final Council District map. By law, the Council has until March 1, 2022 as the final legal deadline to adopt the Council District boundary map and determine the order of election for each of the five (5) Council districts. DISCUSSION: District Formation Criteria In creating the district boundaries, the City must ensure compliance with the following criteria mandated by the CVRA and the Federal Voting Rights Act: •Each district must contain a nearly equal population (no more than a 10% variance but best practices are no more than a 5% population deviation); •The districting plan must be drawn in a manner that complies with the Federal Voting Rights Act and the Equal Protection Clause of the U.S. Constitution; and, •The districts must not be drawn with race as the predominant factor because the overall population balance between districts is the highest priority. Additionally, Election Code section 21601 requires general law cities like the City of Millbrae to adopt districts using the following criteria, which are set forth in order of priority: Page 3 of 4 18174503.1 •Districts shall be geographically contiguous. •To the extent practicable, the geographic integrity of any local neighborhood or local community of interest must be respected and maintained. A “community of interest” is a population that shares common social, economic and geographic interests that should be included within a single district for purposes of its effective and fair representation. •District boundaries should be easily identifiable and understandable. To the extent practicable, districts shall be bounded by natural and artificial barriers, by streets, or by the boundaries of the jurisdiction. •To the extent practicable, and where it does not conflict with the preceding criteria, districts shall be drawn to encourage geographical compactness. Considerations on Drawing the Draft Maps Taking all of the above considerations into account and the publics submitted draft maps, the City's demographer will be re-evaluating the City's data, will consider the public input received, and will draw new different draft maps that comply with California and Federal law criteria. These new draft maps will come before the City Council at the final public hearing on February 22, 2022. The City is using the latest 2020 Census data provided by the Statewide Database with the state prison population reallocated, as required under the Fair Maps Act. These maps will use the underlying Census tract geography to establish the boundaries of individual City Council districts. In drawing these maps, the utmost care will be taken to honor neighborhoods and communities of interest and the public input received. Furthermore, the districts drawn must have less than 10% population deviation – that is, the difference between the smallest and largest district. The ideal district size is 1/5 of the total City population. Simply put, the individual districts may not differ in population by more than 10%. For example, if the largest district is 5% larger than the ideal district population and the smallest district is 3% smaller than the ideal district population, then the total deviation is an allowable 8%. Because achieving near population equality among districts is the first and most critical criterion that must be met, some known neighborhoods likely are split between districts. The first set of draft maps A, B, C are outlined in Attachment 1. The second set of draft maps D,E,F are outlined in Attachment 2. Draft Maps submitted by the public are linked as Attachment 3. Each draft map provided by our Demographer (A,B,C,D,E,F) also includes population breakdowns for each of the drawn districts. The presentation of the draft maps is the second step in the ultimate adoption of a five-district electoral map for City Council elections. Part of the transition process to district elections is to hear from City residents and get public input on the draft maps. These maps all comply with both California and Federal law, but there are differences among them. As the City Council hears from residents, it may ask the City's demographer for new maps or amended maps, which then will be posted at least seven (7) days in advance of the next public hearing on February 22, 2022. Again, at that hearing, the City Council will listen to public input about the draft maps. This process will continue until the City Council selects one of the maps. At the January 11th, 25th and February 8th public hearing, the City Council continues to invite public input on the order of elections. There currently are 2 Councilmember seats on the ballot in November 2022, and the remaining 3 seats will be on the November 2024 ballot. In addition to selecting a map, the City Council Page 4 of 4 18174503.1 also will determine the order of elections – that is, which districts are on the 2022 and 2024 ballots. It is contemplated that these decisions will be made at the February 22, 2022 City Council meeting. Public Outreach In addition to the formal public hearing process, the City has been actively collecting public input during this process through a robust multilingual outreach campaign to encourage public participation and inclusivity as a part of the districting process. The City has: • Hosted a webpage dedicated to districting, which includes an explanation of the districting process, relevant demographic data, the process for getting public input (in all legally required languages), a calendar of public hearings, meetings, and/or workshop dates, the notice and agenda for each hearing/meeting/workshop, audio/video records of the hearings/meetings/workshops, a copy of the draft map(s) considered, and a copy of the final adopted map; and, • Provided the above referenced information to ensure active community engagement and outreach to a wide cross section of the community including minority groups and non-English speaking residents. The City also is providing multiple ways for the public to submit feedback through in-person and online submissions such as digital map submissions using an interactive mapping tool and forms in which to provide input on communities of interest. Materials are provided in English, Spanish, and Mandarin. City Staff also has hosted community workshops and solicited community input at additional meetings. As of February 4, 2022, the City has received 60 COI forms AND 27 Draft Maps . Public hearings, meetings, and workshops have also been open and available for City residents and will continue for each weekend until the final map is adopted by the City Council. FISCAL IMPACT: The City Council appropriated $175,000 to underwrite costs associated with undertaking and completing the transition to district-based elections for City Council elections with the actual cost estimate to be over $300,000 given legal and district formation requirements. COUNCIL ACTION: Provide specific direction on the following: • Determine any preferred map or amendments to any previously proposed map boundaries. • Determine if new maps should be drawn with different attributes for review and consideration for the next public hearing scheduled for February 22, 2022. • Order of elections for each of the five (5) new Council Districts (election cycle) for the general municipal elections of 2022 and 2024.
