HomeMy Public PortalAbout20111109 admin minutesCITY COUNCIL ADMINISTRATION COMMITTEE MEETING MINUTES November 9, 2011 ATTENDEES- Council- Carrie Carroll, Ralph Bray, Shawn Schulte, Bob Scrivner; Staff- Gail Strope, Janice McMillan, Drew Hilpert, Nathan Nickolaus; News Tribune-Madeleine Leroux. Meeting came to order at 8:04 a.m. the minutes were approved with a motion by Schulte and a second by Bray. CHARTER PROVISIONS 2011 BILL (Police Department Employees): Bill presented by Drew Hilpert. This ordinance proposes revisions to the charter regarding the appointment of certain employees by Council. The first suggestion is in the Police Department. Animal Control is now under the Police Department and the Charter currently requires all Police Department employees to be appointed by the Council. Th is now includes record clerks, 911 operators, animal control officers, veterinarian, veterinarian assistants, etc. The second is in regards to Deputy Directors, the Charter provides that the Council cannot direct to anyone below the City Administrator. However, the Charter requires Deputy Directors to be appointed by the Council. The terminology is confusing and unclear since no one has those titles. Scrivner clarified that the hiring process has not changed and that this is a hold-over from a time when political appointments were made. A motion by Scrivner to send to the Council for April election with a second by Schulte, passed unanimously. CHARTER PROVISIONS 2011 BILL (Primary Election): Bill presented by Drew Hilpert. Council passed ordinance many years ago that said a primary is needed if 3 or more candidates file for a position. The County Clerk read our Charter and notified us it said a primary is needed if 2 or more candidates file for a position. Therefore, the Code and Charter are in conflict. Staff believes it is a better practice to hold a primary if there are 3 or more. Therefore, staff suggests recommending a Charter change. Members discussed the pro’s and con’s of the 2 systems. A motion was made by Bray to send to the Council with a second by Scrivner, passed unanimously. AMENDING THE CODE TO COORDINATE WITH MUNICIPAL COURT SOFTWARE BILL Bill presented by Drew Hilpert. The new court software has some coordinating issues with the Police Officers’ ticket writers. It would help to break some of the violations apart in the Code so they will be more accurately reflected on the tickets. Add itions recommended include adding a violation for allowing a person to set off fireworks on your property, open burning (currently this is only a Fire Code); added school zone violations and separated driving while revoked and driving while suspended. A motion was made by Scrivner to send to Council and a second by Schulte, passed unanimously.
