HomeMy Public PortalAbout10-17-1977 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, OCTOBER 17, 1977 1 The Common Council of the City of Richmond, Indiana met in regular session 2 October 17, 1977 at the hour of 7:30 p.m. in the Council Chambers in the 3 Municipal Building in said City. President Carter presided with the 4 following members present: Messrs. Elstro, Williams, Ahaus, Austerman, 5 Merchanthouse., Mills, Cornett and Paust. Absent: None. The following 6 business was had, to-wit: 7 8 Councilman Elstro gave devotions. 9 - 10 Councilman Williams moved to approve the minutes of the previous meeting 11 as prepared, seconded by Councilman Mills and on unanimous voice vote the 12 motion was carried. 13 14 Councilman Mills moved to suspend the rules and read Resolution Nos. 15 27-1977, 28-1977, 29-1977, 30-1977 and 31-1977 by title only, seconded 16 by Councilman Williams and on unanimous voice vote the motion was carried. 17 18 The. Clerk read by title only Resolution No. 27-1977 - A RESOLUTION 19 _ AUTHORIZING THE EXECUTION OF A CERTAIN URBAN MASS TRANSPORTATION CAPITAL 20 GRANT CONTRACT. 21 22 Deputy Director of Community Development Matt Nepote explained this 23 authorizes the Mayor to sign-a contract with UMTA for a papitol grant. 24 25 Councilman Mills moved for adoption of Resolution No. 27-1977, seconded 26 by Councilman Williams. Motion carried with Councilman Cornett voting no. 27 28 The. Clerk read by title only Resolution No. 28-1977 - A RESOLUTION TO 29 TRANSFER WITHIN THE GENERAL FUND.. 30 . 31 Councilman Elstro moved for adoption of Resolution No. 28-1977, seconded 32 by Councilman Mills and on unanimous voice vote .the motion was carried. 33 34 The Clerk read by ti,tleoonly Resolution No. 29-1977 - A RESOLUTION TO 35 TRANSFER WITHIN THE GENERAL FUND. 36 37 Councilman Mills moved for adoption of Resolution No. 29-1977, seconded 38 by Councilman Williams and on unanimous voice vote.the motion was carried. 39 40 The Clerk read by title only Resolution No. 30-1977 - A RESOLUTION TO 41 TRANSFER WITHIN THE GENERAL FUND. 42 43 Councilman Mills moved for adoption of Resolution No. 30-1977, seconded 44 by Councilman Williams and on unanimous voice vote the motion was carried. 45 • 46 The Clerk read by title only Resolution No. 31-1977.-•A RESOLUTION ESTAB- 47 LI:SHING. ASSOCIATI.ONS TO WHICH DUES MAY BE PAID. 48 49 Councilman Ahaus moved for adoption of Resolution No. 31-1977, seconded 50 by Councilman Mills and on unanimous voice vote the motion was carried. 51 52 Mayor Dickman made. the following statement: 53 "Ih .-the. past=:`too. (2) weeks there has been much discussion con- 54 cerning the future of the Grant property that borders Salisbury 55 Road and U.. S. 40 and which .is a part of Ordinance No. 3235-1977 -- -56 involving annexation of a certain part of Center Township. The 57 City Administration is in favor of this parcel of land becoming 58 a part of the City. We do not wish for this_.area to become 59: entangled in possible litigations which.would stall the annexa- 60 tion of Ordinance No. 3235 in its entirety holding up annexation 61 of the Grant property; therefore, it is my recommendation that 62 - Ordinance No. 3235-1977 be returned to the City Plan Commission 63' for study of proper amendments and returned to this Council at 64 the earliest possible date for your consideration. Realizing 65 that this proposal causes an inconvenience for all concerned, I 314 Council Minutes Cont'd October 17, 1977 Page 2 1 feel that in the long run all will benefit and our best interest served. 2 I, too, am disappointed that this action is being taken, but after a 3 meeting at three o'clock this afternoon - with City Attorney Mr. Anderson, 4 this course of action was deemed necessary to pursue." 5 6' Mr. Anderson concurred with this statement. - 7 8 Mr. Mills moved to table all ordinances on first reading and go to Ordi- 9 nance No. 3235-1977 which is on second reading, seconded by .Councilman 10 Paust and on unanimous voice vote the motion was carried. 11 12 Mr. Don Meredith reported for the Board of Works concerning the Old Fire- 13 house. at South 9th that, during the. hours they are not working on re- 14 construction, the barricades will be removed so passage can be made through 15 there.. This request has been complied with. Mr. Roberts reported the 16 building permit is issued for one (1) year, but can be renewed. 17 18 Concerning Council's appointment to the Police Merit System, Councilman 19 Williams moved to nominate Rev. George White, associate minister of the 20 Second Baptist Church., seconded by Councilman Elstro. 21 22 The City Attorney recommended that first the nominee presented at a pre- 23 v :ous Council meeting be. withdrawn. 24 25 Councilman Williams. moved to remove the name of Marie Fredricks from the 26 category of any endeavor to serve on the Police Merit System, seconded 27 by Councilman Austerman and on unanimous voice vote the motion was carried. 28 29 Councilman Williams pointed out that Rev. White is a Democrat. 30 31 . Councilman Merchanthouse; moved the nominations be closed, seconded by Mr. 32 Williams and on unanimous voice vote the motion was carried. 33 34 - -A unanimous voice vote was recorded on Councilman Williams' motion nomina= 35 ting Rev. White. - 36 - 37 Councilman Mills moved to send Ordinance No. 3235-1977 back to the Plan 38 Commission for study,_ recommendation and possible amendments, seconded by 39 Councilman Ahaus. 40 41 Attorney Robert Burton spoke for the Citizens Against Annexation. 42 43 On Councilman Mills motion ayes carried with Councilman Elstro voting no. 44 45 Councilman Elstro moved to strike Ordinance.No. 3235-1977, seconded by 46 Councilman Williams. Councilman Paust called for a point of. order noting 47 this ordinance was no longer on the. agenda. City Attorney Ed Anderson 48 ruled against Councilman Elstro's motion. 49 50 Councilman Merchanthouse requested the Plan Commission act in due haste 51 concerning this ordinance. 52 53 Councilman Mills moved to bring the ordinances on 1st reading back on the 54 table, seconded by Councilman Paust and on unanimous voice vote the motion 55 was carried. - 56 57 Councilman Mills moved to read Ordinance Nos. 3267-1977 through 3284-1977 58 on first reading by title only, seconded by Councilman Ahaus and on 59 unanimous voice vote the motion was carried. 60 61 The Clerk read on first reading by title only Ordinance No. 3267-1977 - .. 62 AN ORDINANCE CONCERNING THE HEALTH, SAFETY AND WELFARE OF THE PEOPLE OF 63 THE CITY OF RICHMOND, INDIANA. • 3j5 Council.;Minutes Cont' d October 17, 1977 Page 3 1 President Carter referred Ordinance No. 3267-1977 to the. Committee of the 2 Whole for study and recommendation and possible amendments. President 3III Carter called a meeting of this committee for October 31 at 7:00 p.m. to 4 consider this ordinance. 5 6 Mr. Anderson requested this be an executive session as it might have some 7 bearing on litigation now pending in Court. 8 9 Councilman Austerman moved the meeting be open to the public, seconded by 10 Councilman Mills. The motion carried with Councilman Carter 51 voting no. 52 53 Councilman Mills moved to suspend the rules and read Amended Ordinance No. 54 3269-1977 on third and final reading by title only, seconded by Council- 55 man Austerman. Councilman Carter voted no. . 56 - 57 The. Clerk read on first reading by title only Ordinance No. 3270-1977 - 58 AN ORDINANCE TO AMEND ORDINANCE NO..:2858-1973 REGULATING SEWERS AND WASTE 59 WATER TREATMENT FOR THE RICHMOND SANITARY DISTRICT OF RICHMOND, INDIANA, 60 AND IMPOSING PENALTIES FOR VIOLATION THEREOF. 61 62 City Attorney Anderson stated an amendment to this ordinance.
