HomeMy Public PortalAbout10-03-1977 309 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RI:CHMOND, INDIANA, OCTOBER 3, 1977 1 The Common Council of the City of Richmond, Indiana met in regular 2 session October 3, 1977 at the hour of 7: 30 p.m. in the Council 11/ 3 Chambers in the Municipal Building in said City. President Carter 4 presided with the following members present: Messrs. Elstro, 5 Williams, Ahaus, Austerman, Merchanthouse, Mills, Cornett and 6 Paust. The following business was had, to-wit: 7 8 Councilman Cornett gave devotions. 9 "10 Councilman Williams moved to approve the minutes of the previous 11 meeting as prepared, seconded by Councilman Elstro and on unanimous 12 voice vote the motion was carried. 13 14 Councilman Mills questioned the lengths of the, terms of the 15 appointees to the Police Merit System by Council, as presented by 16 a letter from President Carter. Mr. Meredith will call a meeting 17 of the Police Nominating Committee and Common Council to resolve 18 the question concerning the interpretation of the rules govern- 19 ing the election. 20 21 Mayor Clifford Dickman made a statement on the City's stand 22 against new local so called businesses, stating that this- 23 Administration does not condone any action that works to destroy 24 the moral fibers of this community. He further stated the City 25 Attorney is working, along with the Police Department, to find 26 ways to eradicate these businesses. . There will be an ordinance 27 presented to Council on October 17 concerning the control of 28 such unwanted businesses. - 29 30 Reporting for the Board of Works, Mr. Don Meredith stated that a 31 letter has been sent from Mr. Goodwin of the Plan Department to 32 Mr. Roy Cates citing all violations occurring at his location and 33 this will be followed up by the Plan Department. The weeds at 34 411 South 9th have not been taken care of because there is 35 condemnation on that property and it is under order to be torn 36 down, pending word from a prospective buyer of the property. 37 The property at 241 South 3rd is under investigation by Mr. 38 Roberts, Commissioner of the Bureau of Buildings who notes the 39 owner has baited for rats and indication is that there are no 40 rats in that dwelling and rats are coming from somewhere else in 41 the area. 42 43 Councilman Elstro reported to the Board that the property at 44 South 9th and "E", currently under renovation, is blocking the 45 sidewalk with reconstruction and people are having to walk out 46 on 9th. - 47 48 Councilman Merchanthouse offered the services of the Computer 49 Committee to help review the bids for payroll services for the 50 City. 51 - 52 The Clerk read on second reading Ordinance No. 3235-1977 - AN 53 ORDINANCE ANNEXING CERTAIN CONTIGUOUS TERRITORY PLATTED AND 54 UNPLATTED, LEGALLY DESCRIBING THE ANNEXED TERRITORY, PROVIDING 55 FOR THE PUBLICATION THEREOF, AND FIXING THE TIME WHEN THE SANE 56 SHALL TAKE EF1TCT. 57 58 The Clerk read a letter from the Plan Commission stating their 59 vote .on :August 23, 1977 of five (5) to three (3). to recommend 60 approval to Common- Council and to recommend that Council adopt 61 by resolution the accompanying fiscal plan. 310 Council Minutes Cont'd October 3, 1977 Page 2. 1 Speaking in favor of Ordinance No. 3235-1977 was Mr. Robert Goodwin, 2 Director of Planning for the Department of City Planning. He 3 explained the study for annexation and the fiscal plan. 4 5 Speaking against Ordinance No. 3235-1977 was Mr. Robert Burton, 25 6 North 7th, -Attorney for the remonstrators. Mr. Burton stated he 7 would present numerous people who would discuss various areas. Mr. 8 Burton presented petitions signed by one thousand thirteen (1,013) 9 land owners which contained signatures of land owners of six hundred 10 (600) of the six hundred nineteen (619) separately owned parcels 11 in the proposed annexation area. 12 13 Mr. Burton introduced Ms. Mary Ferguson, 105 E. Crestwood Lane, 14 Co-Chairman of the Citizens Against Annexation who explained the 15 reasons for the formation of this organization; Mr. Bill Berry, 16 1630 Salisbury Road, South, Chief of Centerville Fire Department 17 Charles Killon, 110 Willow Grove Road Centerville and President 18 of Richmond Firefighters Local 1408 Duane Green, 340 So. 31st 19 Street who spoke on fire protection for the area; Superintendent 20 of Centerville-Abington School District Don Kehoe, R.R. 2, 21 Centerville; Sheriff of Wayne County John Catey and Mr. Keith 22 Dilworth, 4079 S. W. "M" on County police service and requirements 23 and functions of the Richmond Police Department; Mrs. Martha 24 Jennings, 1301 N.W. 19th, Buckholtz Addition and Mr. Larry Moore, 25 1600 Sylvan Nook Drive, Oak Park Addition on services to area 26 annexed in the past; Mr. Kent Shank, R.R. 1, Centerville on 27 historical and social development; Mr. James L. Good, 215 So. Ash, 28 Centerville presenting a Resolution against annexation from the 29 Town Board of Centerville; Ms. Pauline Rhoades, 308 S. Main, 30 Centerville presenting petitions of citizens of Centerville; Ms. 31 Judy Schlotterbeck, President of the Board of Directors of the 32 Centerville Youth League; Mr. Steve Martin, 3229 College Corner 33 Road and Mr. John Key 3339 N.W. "C", Comptroller at Perfect Circle 34 on taxes, revenues, fiscal plan and costs as proposed; and Mr. 35 Elmer Toschlog, 4 North Salisbury Road on transportation section. 36 Also speaking against Ordinance No. 3235-1977 were Mr. Elmer 37 Davis, 901 Round Barn Road, South and Mr. Dale Sharitts, 1000 N.W. 38 "D" Street. 39 40 Mr. Burton spoke on various issues during the presentation and 41 summarized. 42 43 Mr. Bob Goodwin requested time to study the figures presented by 44 remonstrators, which are not the same as those compiled by the 45 Plan Department. 46 47 Chief of Police Charles Chris, 115 N.W. 16th Street, spoke on the 48 police figures presented by Mr. Dilworth. 49 50 Councilman Mills moved to take Ordinance No. 3235-1977 under 51 advisement, seconded by Councilman Paust. Motion carried with 52 Councilman Elstro voting no. 53 - 54 The Clerk read on second reading Ordinance No. 3264-1977 - AN 55 ORDINANCE AUTHORIZING A "SPECIAL USE" IN A C-3 CENTRAL BUSINESS 56 DISTRICT, OF ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING 57 ORDINANCE OF THE CITY OF RICHMOND„ INDIANA, ADOPTED JUNE 3, 1968. 58 59 The Clerk read a letter from the Plan. Commission stating they held 60 a public hearing on Tuesday, September 27, 1977 and the vote was 61 unanimous nine (9) to zero (0). in favor of recommending this 62 Special Use. 311 Council Minutes Cont'd October 3, 1977 Page 3. 1 Councilman Paust moved for engrossment of Ordinance No. 3264-1977, 2 seconded by Councilman Mills and on unanimous voice vote the motion 3 was carried. 4 5 Councilman Mills moved to suspend the rules and read Ordinance No. 6 3264-1977 on third and final reading by title only, seconded by 7 Councilman Paust and on unanimous voice vote the motion was carried. 8 9 The Clerk read on third reading by title. only Ordinance No. 3264- 10 1977. 11 12 Ordinance No. 3264-1977 was placed on final passage or rejection and 13 on a call of the roll the following was recorded: Ayes: Elstro, 14 Williams, Ahaus, Austerman, Merchanthouse, Mills, Cornett, Paust 15 and Carter. Noes: None. The vote being nine (9) to zero (0) in 16 favor of passage of Ordinance No. 3264-1977. 17 18 The Clerk read on second reading Ordinance No. 3265-1977 - AN 19 ORDINANCE TO APPROPRIATE FROM THE. CUMULATIVE CAPITAL IMPROVEMENT 20 FUND (CIGARETTE TAX) . 21 22 Councilman Mills moved to accept and file proof of publication of 23 Ordinance No. 3265-1977, seconded by Councilman Paust and on 24 unanimous voice vote the motion was carried. 25 26 Speaking in favor of and explaining Ordinance No. 3265-1977 was 27 Deputy Director of Community Development Matt Nepote. Mr. Nepote 28 explained the Urban Renewal Plan called for a five (5) block III 29 Promenade; however, the funds from the downtown and HUD only 30 completed four (4) blocks. This is for the completion of the plan. 31 32 Speaking in opposition to Ordinance. No. 3265-1977 were Ms. Pauline 33 Rhoades, 308 E. Main Centerville and Mr. Dale Sharitts, 1000 N.W. 34 "D". 35 36 Councilman Cornett moved for engrossment of Ordinance No. 3265-1977, 37 seconded by Councilman Austerman and on unanimous voice vote the 38 motion was carried. 39 40 Councilman Cornett moved to suspend the rules and read Ordinance 41 No. 3265-1977 on third and final reading by title only, seconded 42 by Councilman Paust and on unanimous voice vote the motion was 43 carried. 44 45 The Clerk read on third reading by title only Ordinance No. 3265- 46 1977. 47 48 Ordinance No. 3265-1977 was placed on final passage or rejection 49 and on a call of the roll the following was recorded: Ayes: 50 Elstro, Ahaus, Austerman, Merchanthouse, Cornett, Paust and Carter. 51 Noes: Williams and Mills. The vote being seven (7) to two (2) 52 in favor of passage of Ordinance No. 3265-1977. 53 54 Councilman Mills moved to suspend the rules and read Ordinance 55 No. 3262-1977 on third reading by title only, seconded by 56 Councilman Paust and on unanimous voice vote the motion was carried. 57 58 The Clerk read on third reading by title only Ordinance No. 3262- 59 1977 - AN ORDINANCE TO APPROPRIATE WITHIN THE MOTOR VEHICLE 60 HIGHWAY FUND. 61 62 Ordinance No. 3262-1977 was placed on final passage or rejection 63 and on a call of the roll the followingwas recorded: Ayes: Elstro, 312 Council Minutes Cont'd - - October 3, 1977 Page 4. 1 Williams, Austernman, Merchanthouse, 'Mills, Cornett, Paust and Carter. 2 Noes: Ahaus.
