HomeMy Public PortalAbout09-19-1977 305 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, SEPTEMBER 19, 1977 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session September 19, 1977 at the hour of 7:30 p.m. in the Council 3 Chambers. in the Municipal Building in said City. President Carter 4 presided with the following members present: Messrs. Elstro, 5 Williams, Ahaus, Austerman, Merchanthouse, Mills and Paust. 6 Absent: Councilman Cornett. The following business was had, to- 7 wit: 8 9 Councilman Carter gave devotions. 10 11 Councilman Mills reported he was absent from the last regular 12 meeting due to being on vacation. 13 14 Councilman Williams moved to approve the minutes of the previous 15 meeting as prepared, seconded by Councilman Mills and on unanimous 16 voice vote the motion was carried. 17 18 Councilman Mills moved to suspend the rules and read Resolution No. 19 26-1977 by title only, seconded by Councilman Williams and on 20 unanimous voice vote the motion was carried. 21 22 The Clerk read Resolution No. 26-1977 - A RESOLUTION CONCERNING THE 23 CHANGE IN THE POSTAL SERVICE IN THE CITY OF RICHMOND, INDIANA. 24 25 Councilman Ahaus moved to amend Resolution on #4 to strike the word 26 "uneconomical" and to read "has not been proven to, be more economical", 27 seconded.by Councilman Mills and on unanimous voice vote the 28 motion was carried. 29 30 Councilman Elstro moved for adoption of Resolution No. 26-1977, 31 seconded by Councilman Paust. The motion carried with Councilman 32 Austerman voting no. 33 34 Councilman Carter announced that Council is to elect three (3) 35 members to the Police Merit System and opened: the floor for 36 nominations. The names placed in nomination were Reverend O.W. 37 Barber, Jan Elsea, Dick Hamm and Marie Fredricks. 38 39 Councilman Williams moved to close the nominations and Councilman 40 Merchanthouse seconded. By secret ballot, the Councilman listed 41 their three (3) preferences, which were then counted by the 42 Clerk, the vote being Dick Hamm receiving eight (8) votes, 43 Marie Fredricks, seven (7) votes, Elsea, five (5) votes, and 44 Barber with three (3) votes. 45 46 Councilman Merchanthouse called for a public vote on the Police 47 Merit System Commission. Councilman Elstro stated that he voted 48 for Barber and Hamm, Councilman Williams voted for Barber, Hamm 49 and Fredricks, Councilman Ahaus voted for Elsea, Fredricks and 50 Hamm, Councilman Austerman voted for Elsea, Fredricks and Hamm, 51 Councilman Merchanthouse voted for Barber, Hamm and Fredricks, 52 Councilman Mills voted for Fredricks, Elsea and Hamm, Councilman 53 Paust voted for Fredricks,- Elsea and Hamm, and Councilman Carter 54 voted for Fredricks, Elsea and Hamm. 55 56 Mrs. Minnie Madden of 237 South 3rd Street stated that the house 57 next door at 241 South 3rd Street, which has been vacant for 5 58 years, has weeds and rats and needs attention by the City. Mr. 59 Roberts of the Bureau of Buildings, said he will take care of it. 60 61 Councilman Elstro requested the Board of Works look into the 62 operation of Roy Cates Auto Service. There is a fence around 63 his place of business; however, he is going outside these 64 confines and parking vehicles improperly. He requested in 65 writing rules, zones, etc. from the City Attorney. 30€ Council Minutes Cont'd September 19, 1977 Page 2.. 1 Councilman Williams requested a check on property at 411 South 9th 2 Street. He reported the weeds were cut only once and the house is 3 vacant. 4 5 Councilman Paust stated he received a petition from Norma Duffin for 6 a stop light at South 14th and "A". This matter will be referred to 7 the State. 8 9 Councilman Mills moved to suspend the rules and read Ordinance Nos. 10 3264-1977, 3265-1977 and 3266-1977 on first reading by title only, 11 seconded by Councilman Paust and on unanimous voice vote the motion 12 was carried. 13 14 The Clerk read on first reading by title only Ordinance No. 3264- 15 . 1977 - AN ORDINANCE AUTHORIZING A "SPECIAL 'USE" IN A C-3 CENTRAL 16 BUSINESS DISTRICT, OF ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE 17 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 18 1968. 19 20 President Carter announced Ordinance No. 3264-1977 is referred to 21 the Plan Commission for study and recommendation. 22 23 The Clerk read on first reading by title only Ordinance No. 3265- 24 1977 - AN ORDINANCE TO APPROPRIATE FROM THE CUMULATIVE CAPITAL 25 IMPROVEMENT FUND ( CIGARETTE TAX) . 26 . 27 President Carter announced Ordinance No. 3265-1977 has to be 28 advertised. 29 30 The Clerk read on first reading by title only Ordinance No. 3266- 31 197.7 - AN ORDINANCE. TO TRANSFER. WITHIN THE PARK AND RECREATION FUND. 32 33 Speaking for Ordinance No. 3266-1977 was Park Superintendent Don 34 McBride. _ 35 . 36 Councilman Mills moved to suspend the rules and move Ordinance No. 37 3266-1977 to second reading, seconded by Councilman Paust and on 38 unanimous voice vote the motion was carried. 39 40 The Clerk read on second..reading Ordinance No. 3266-1977. 41 - 42 Councilman Mills moved for engrossment of Ordinance No. 3266-1977, 43 seconded by Councilman Paust and-on unanimous voice .vote the motion 44 was carried. 45 46 Councilman Mills moved to suspend the rules and read Ordinance No. 47 3266-1977 on• third and final reading by title only, seconded by 48 Councilman Ahaus and on unanimous voice vote the motion was carried. 49 50 The Clerk read on third reading by title only Ordinance No. 3266- 51 1977. 52 53 Ordinance No. 3266-1977 was placed on final passage or rejection 54 and on a call of the roll the following was recorded: Ayes: 55 Elstro, Williams, Ahaus, Austerman, Merchanthouse, Mills, Paust and 56 Carter. Noes: None. The vote being eight (8) to zero (0) in 57 favor of passage of Ordinance No. 3266-1977. 58 59 The Clerk read on second reading Ordinance No. 3262-1977 - AN 60 ORDINANCE TO APPROPRIATE WITHIN THE MOTOR VEHICLE HIGHWAY FUND. 61 62 Councilman Mills moved to accept and file proof of publication 63 for Ordinance No. 3262-1977, seconded by Councilman Austerman and 64 on unanimous voice vote the motion was carried. 307 Council Minutes Cont'd September 19, 1977 Page 3. 1 Councilman Mills moved for engrossment of Ordinance No. 3262-1977, 2 seconded by Councilman Ahaus and on unanimous voice vote the motion 3 was carried. 4 5 The Clerk read on second reading Ordinance No. 3263-1977 - AN 6 ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 7 8 Councilman Mills moved to accept and file proof of publication of 9 Ordinance No. 3263-1977, seconded by Councilman Paust and on 10 unanimous voice vote the motion was carried. 11 12 Councilman Mills moved for engrossment of Ordinance No. 3263-1977, 13 seconded by Councilman Paust and on unanimous voice vote the motion 14 was carried. 15 16 Councilman Mills moved to suspend the rules and move Ordinance No. 17 3263-1977 to third and final reading by title only, seconded by 18 Councilman Paust and on unanimous voice vote the motion was carried. 19 20 The Clerk read on third reading by title only Ordinance No. 3263- 21 1977. 22 23 Ordinance No. 3263-1977 was placed on final passage or rejection 24 and on a call of the roll 'the following was recorded: Ayes: 25 Elstro, Williams, Ahaus, Austerman, Merchanthouse, Mills, Paust and 26 Carter. Noes: None. The vote being eight (8) to zero (0) in 27 favor of passage of Ordinance No. 3263-1977. 111 28 29 Councilman Mills moved to suspend the. rules and read Ordinance No. 30 3186-1977 on third reading by title only, seconded by Councilman 31 Ahaus and on unanimous voice vote the motion was carried. 32 33 The Clerk read on third reading by title only Ordinance No. 3186- 34 1977 - AN ORDINANCE AUTHORIZING A "SPECIAL USE" IN A C-1 35 NEIGHBORHOOD BUSINESS DISTRICT, OF ORDINANCE NO. 2325-1968 36 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, 37 INDIANA, ADOPTED JUNE 3, 1968. 38 39 Councilman Austerman moved to strike Ordinance No. 3186-1977, 40 seconded by Councilman Paust and on unanimous voice vote the motion 41 was. carried. 42 43 There being no furiher business on motion duly made, seconded and 44 passed the meeting was adjourned. 45 46 James E.
