HomeMy Public PortalAbout08-15-1977 283 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF`-RI:CHMOND,- INDIANA, 'AUGUST a 15,_19 7 7 1 The Common Council of the City of Richmond, Indiana met in regular 2 session August 15, 1977 at the hour of 7:30 p.m. in the Council 3 _ Chambers in the Municipal Building in said City. President Carter 4 presided with the following members present: Messrs. Elstro, 5 Williams, Austerman, Merchanthouse, Mills and Cornett. Absent: 6 Ahaus and Paust. The following business was had, to-wit: 7 8 Councilman Austerman gave devotions. 9 10 Councilman Williams moved to approve the minutes of the previous 11 meeting as prepared, seconded by Councilman Mills and on unanimous 12 voice vote the motion was carried. 13 14 Councilman Mills moved to suspend the rules and read Resolution No. 15 22-1977 by title only, seconded by Councilman Austerman and on 16 unanimous voice vote the motion was carried. 17 18 The Clerk read by title only Resolution No. 22-1977 - A RESOLUTION OF 19 THE CITY OF RICHMOND, INDIANA AMENDING AND SUPPLEMENTING A.CERTAIN 20 LEASE AGREEMENT BETWEEN THE CITY OF RICHMOND, INDIANA, AS LESSOR, 21 AND ELDER/WILBERT CORP., AS LESSEE, AND WILBERT, INC., AS GUARANTOR, 22 DATED AUGUST 6, 1974 AND A CERTAIN MORTGAGE AND INDENTURE OF TRUST 23 BY THE CITY OF RICHMOND, INDIANA TO THE SECOND NATIONAL BANK OF 24 RICHMOND, AS TRUSTEE, DATED AUGUST 6, 1974; AND AUTHORIZING AND 25 DIRECTING THE MAYOR AND CLERK OF THE CITY OF RICHMOND, INDIANA TO 26 EXECUTE AN AMENDMENT TO LEASE AGREEMENT AND TO MORTGAGE AND INDENTURE 27 OF TRUST TOGETHER WITH ANY OTHER DOCUMENTS WHICH MAY BE NECESSARY III 28 OR DESIRABLE TO COMPLETE SUCH AMENDMENT TO SAID LEASE AGREEMENT 29 AND MORTGAGE. AND INDENTURE OF TRUST. 30 31 Speaking for Resolution No. 22-1977 were Mr. Andrew Cecere, Attorney, 32 101 So. 10th and Mr. John Garman, Richmond Area Chamber of Commerce. 33 34 Councilman Mills moved for adoption of Resolution No. 22-1977, 35 seconded by Councilman Williams and on unanimous voice vote the 36 motion was carried. 37 38 Mayor Dickman welcomed Dayton Walther Co. to Richmond. The Mayor 39 backed up the Administration's feelings in the recent wage. negotiations 40 with. the Fire and Police and pointed out a few things in the new 41 budget, explaining why we are in a financial crunch. 42 43 City Controller Donald Meredith requested any Councilman who would 44 like any specific figures for budget meetings, please let him 45 know. Many Councilmen responded. 46 47 In response to a request. of Don Meredith at the previous meeting to 48 furnish a comparison-of the._number off employees this year to last 49 year, Mr. Meredith reported the number on Social Security on June 50 30, 1977 was 422 and on June 30, 1976 was 436. 51 52 Mr. Meredith noted a correction in the budget book on page 17, 53 second line from bottom should read $1,778,403.86. and the line 54 below should read $733,048.86. These figures are also carried on 55 Ordinance No. 3246-1977 and 3252-1977 and will, be corrected at the 56 next Council meeting. This correction will be in the newspaper 57 statement to be published August 18, 1977. 58 59 Councilman Mills moved to suspend the rules• and read.Ordinance. Nos,. 60 3246-1977, 3247-1977, 3248-1977, 3249-1977, 3250-1977, 3251-19.7.7 61 and 3252-1977 on first reading by title only. Then to read 62 Ordinance No. 3253-1977, 3254-1977, 3255-1977, 3256-1977, 3257-1977, 63 3258-1977and 3259-1977 on first reading by title only. AND FIXING THE TIME WHEN THE SAME SHALL TAKE EFFECT. 45 46 The Clerk read on "first reading by title only Ordinance No. 3252- 47 1977 - AN ORDINANCE FIXING THE RATE AND AMOUNT OF TAXES FOR MUNICIPAL 48 PURPOSES TO BE LEVIED ON PROPERTY WITHIN THE CITY OF RICHMOND, 49 WAYNE COUNTY, INDIANA, FOR THE YEAR 1978, AND PROVIDING FOR THE 50 TAKING EFFECT THEREOF. 51 52 President Carter announced these Ordinances all have to do with the 53 . budget and tax rate and have to be advertised. There will be a 54 meeting of the Committee of the Whole next Monday, August 22 in 55 the Board of Works room to study and cut this budget. 56 57 President Carter also announced there will be a meeting August 29 58 in Common Council Chambers for final approval of this budget. 59 60 The Clerk read on first reading by title only Ordinance No. 3253- 61 1977 - AN ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND. 62 63 Councilman Cornett moved to suspend the rules and read Ordinance No. 64 3253-1977 on second reading, seconded by Councilman Mills and on 65 unanimous voice vote the motion was carried. 2M11 Common Council Minutes Cont'd August 15, 1977 Page 3. 1 The Clerk read on second reading Ordinance No. 3253-1977. 2 3 Councilman Williams moved for engrossment of Ordinance No.II/ 3253- 4 • 1977, seconded by Councilman Mills and on unanimous. voice vote 5 the motion was carried. 6 7 'Councilman Williams moved to suspend the rules arid read Ordinance 8 No. 3253-1977 on third and final reading by title only, seconded 9 by Councilman Mills and on unanimous voice vote the motion was 10 carried. 11 12 The Clerk read on third reading by title only Ordinance No._ 3253- 13 1977. _ 14 • 15 Ordinance No. 3253-1977 -was placed on_ final passage or rejection and 16 on a call of the roll the following was recorded: Ayes: Elstro, 17 Williams, Austerman, Merchanthouse, Mills, Cornett and Carter. ' 18 Noes: None. The vote being seven (7) to zero (0) in favor of 19 passage of Ordinance No. 3253-1977. 20 21 The .Clerk read on first reading by title only Ordinance No. 3254- 22 -1977 - AN ORDINANCE TO TRANSEhR WITHIN THE GENERAL FUND. 23 24 Councilman Austerman moved to suspend .the rules and read Ordinance 25 No. 3254-1977 on second reading, seconded by Councilman Mills 26 and on unanimous voice vote the 'motion was carried. . 27 • III 28 The Clerk read on 'second reading Ordinance -No. 3254-1977. 29 30 Councilman Merchanthouse moved for,engrossment of Ordinance No. 31 3254-1977, seconded by Councilman Mills and on unanimous voice - 32 vote the motion was carried. 33 - - - 34 Councilman Merchanthouse moved to suspend the rules and read 35 Ordinance. No. 3254-1977 on third and final reading by title only, 36 seconded by Councilman Mills and on -unanimous voice-vote, the motion 37 was carried. • 38 39 The Clerk read on third reading by title only Ordinance No. 32554- 40 1977. ' 41 • 42 'Ordinance No. 3254-1977 was placed on final passage or rejection 43 and on a call of the roll the following was recorded: - Ayes: _ 44 Elstro, Williams, Austerman, Merchanthouse, Mills, Cornett -and 45 Carter. Noes: None. No. 325 5-19 717. 56 57 Councilman Mills moved for engrossment of Ordinance No. 3255- 58 1977; seconded by Councilman Cornett and on unanimous voice vote 59 the motion was carried. 60 61 Councilman Mills moved to suspend the rules and read Ordinance No. 62 3255-1977 on third and final reading by title only, seconded by 63 Councilman Cornett and' on unanimous voice .vote the motion was 64 carried. 65 66 • The' Clerk read on third reading by title only Ordinance. No. 3222-1977 - AN 36 ORDINANCE TO ANNEX TO THE CITY OF RICHMOND, INDIANA, CERTAIN 37 TERRITORY CONTIGUOUS THERETO, DESCRIBING THE SANE, PROVIDING FOR 38 THE PUBLICATION THEREOF, AND FIXING THE TINE WHEN THE SAME SHALL 39 TAKE EFFECT. 40 41 The Clerk read a letter from the Plan Commission stating they . 42 conducted a public hearing on June 28, 1977. This hearing was 43 closed after those present had been heard and the Commission voted 44 nine (9) to zero (0) to take this. Ordinance under advisement. On 45 July 26th the.: Commission voted six (6) to two (2) to recommend to 46 Council that this Ordinance be passed as amended. 47 48 Speaking for Ordinance No. 3222-1977 was Mr. Ed Nicholson, 881 49 Hidden Valley Lane representing Francis and Eleanor Robinson, owners 50 of the land. 51 52 Speaking against Ordinance No. 3222-1977 was Chuck Whitney, 801 53 Hidden Valley Drive, representing lists. of petitioners who requested 54 a traffic study be made in this area before an extended development 55 takes place. 11/ 56 57 Councilman Mills moved to amend.Ordinance No. 3222-1977 Section 2, 58 paragraph 2 to read "That the said real estate annexed hereby shall 59 be annexed into the City of Richmond, Indiana, and zoned R-2, 60 Single Family Residential", seconded by Councilman Cornett. 61 62 Councilman Merchanthouse stated he wishes to abstain from voting 63 on this Ordinance as he owns property in the area. 28714 Common Council Minutes Cont'd August 15, 1977 Page 5. 1 Councilman Mills moved Mr. Merchanthouse be permitted to abstain, 2 seconded by Councilman Cornett. The motion was carried with 3 Councilman Elstro voting no. 4 5 Councilman Merchanthouse abstained from voting on any issue on this 6 Ordinance. 7 8 A vote was called for Councilman Mills motion to amend Ordinance No. 9 3222-1977 and on unanimous voice vote the motion was carried. 10 11 Councilman Mills moved for engrossment of Ordinance No. 3222-1977, 12 seconded by Councilman Cornett and on unanimous voice vote the 13 motion was carried. 14 15 Councilman Mills moved to suspend the rules and read Ordinance No. 16 3222-1977 on third and final reading by title only. This motion 17 died for lack of a second. 18 19 Councilman Mills moved to hold the next regular Council meeting on 20 Tuesday, September 6, 1977, seconded by Councilman Elstro and on 21 unanimous voice vote the motion was carried. 22 23 There being no further business on motion duly.-made, seconded and 24 passed the meeting was adjourned. 25 26 James E.
