HomeMy Public PortalAbout06-06-1977 247 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, JUNE 6, 1977 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session June 6, 1977, at the hour of 7:30 p.m. in the Council Chambers 3 in the Municipal Building in said City. President Carter presided with 4 the following members present: Messrs. Elstro, Williams, Ahaus, Auster- 5 man, Merchanthouse, Mills, Cornett and Paust. Absent: None. The 6 following business was had, to-wit: 7 8 Councilman Elstro gave devotions. 9 10 Councilman Williams moved to approve the minutes of the previous meeting, 11 as prepared, seconded by Councilman Mills and on unanimous voice vote 12 the :motion was carried. 13 14 Councilman Mills moved to suspend the rules and read Resolution 17-1977 15 by title only, seconded by Councilman Ahaus and on unanimous voice 16 vote the motion was carried. 17 18 The Clerk read by title only Resolution 17-1977 - A RESOLUTION TO AUTHO- 19 RIZE THE FILING OF AN APPLICATION FOR A BINDING CONTRACT FOR SERVICES 20 WITH THE STATE OF INDIANA ACTING BY AND THROUGH THE STATE PLANNING SER- 21 VICES AGENCY FOR THE 1977-78 FISCAL YEAR FOR A COMPREHENSIVE HISTORICAL ' 22 STRUCTURE SURVEY IN THE CITY-OF RICHMOND. 23 24 Speaking for and explaining this resolution was Mr. Tim Ryder, Director 25 of Community Development. 26 27 Councilman Elstro moved for adoption of Resolution 17-1977, seconded by 28 Councilman Cornett. The motion was carried with Councilman Williams 29 voting no. 30 31 Councilman Mills moved to suspend the rules and read Resolution 18-1977 32 by title only, seconded by Councilman Cornett and on unanimous voice 33 vote the motion was carried. 34 35 The Clerk read by title only Resolution 18-1977 - RESOLUTION APPROVING' 36 APPLICATION FOR PRELIMINARY LOAN FOR LOW-RENT PUBLIC HOUSING. 37 38 Speaking for and explaining this resolution was Executive Director of 39 the Richmond Housing Authority John Fienning, 218 So. 19th Street. 40 41 Councilman Williams moved for adoption of Resolution 18-1977, seconded 42 by Councilman Elstro and on unanimous voice vote the motion was carried. 43 44 Mayor Clifford Dickman spoke for Ordinance 3208-1977 which is for street 45 repair for the City. He stated, in part, paving has been decreasing in 46 the last several years and we need to get on a progressive paving program. 47 48 Board of Works President Don Meredith reported that, at the request of 49 Councilman Elstro, an inspection has been made of the north side of "J" 50 from 12th to 13th and this is not considered a high priority spot. 51 52 Mr. Meredith reported that six thousand eight hundred and thirty dollars 53 ($6,830.00) was realized from the auction of thirteen (13) city-owned cars. 54 55 Councilman Mills gave a letter to the Board of Works for their investi- 56 gation from Ms. Borton, 116 S. W. "F" Street. 57 58 Councilman Mills moved to suspend the rules and read Ordinances 3222-1977 59 and 3223-1977 on first reading by title only, seconded by Councilman 60 Austerman and on unanimous voice vote the motion was carried. 61 62 The Clerk read on first reading by title only Ordinance No. 3222-1977 63 AN ORDINANCE TO ANNEX TO THE CITY OF RICHMOND, INDIANA, CERTAIN TERRI- 64 TORY CONTIGUOUS THERETO, DESCRIBING THE SAME, PROVIDING FOR THE PUBLI- 65 CATION THEREOF, AND FIXING THE TIME WHEN THE SAME SHALL TAKE EFFECT. 248 Common Council Minutes Cont'd June 6, 1977 Page 2 1 President Carter announced Ordinance No. 3222-1977 is referred to the 2 Plan Commission for study and recommendation. 3 4 The Clerk read on first reading by title only Ordinance No. 3223-1977 - 5 AN ORDINANCE TO TRANSFER WITHIN THE PARK AND RECREATION FUND. 6 7 Councilman Mills moved to suspend the rules and read Ordinance No. 3223- 8 1977 on second reading, seconded by Councilman Ahaus and on unanimous 9 voice vote the motion was carried. 10 11 The Clerk read on second reading Ordinance No. 3223-1977. 12 13 Councilman Mills moved for engrossment of Ordinance No. 3223-1977, seconded 14 by Councilman Ahaus and on unanimous voice vote the motion was carried. 15 16 Councilman Mills moved to suspend the rules and read Ordinance No. 3223- 17 1977 on third and final reading by title only, seconded by Councilman 18 Austerman and on unanimous voice vote the motion was carried. 19 20 The Clerk read on third reading by title only Ordinance No. 3223-1977. 21 22 Ordinance No. 3223-1977 was placed on final passage or rejection and on 23 a call of the roll the following was recorded: Ayes: Elstro, Williams, 24 Ahaus, Austerman, Merchanthouse, Mills, Cornett, Paust and Carter. Noes: 25 None. The vote being nine (9) to zero (0) in favor of passage of 26 Ordinance No. 3223-1977. 27 28 The Clerk read on second reading Ordinance No. 3184-1977 - AN ORDINANCE 29 AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE 30 OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3' 1968. 31 32 The Clerk read a letter from the Plan Commission stating they voted 33 eight (8) to one (1) in favor of this petition at their third meeting 34 on this petition as the first two meetings received tie votes. 35 36 Explaining this Ordinance was City Plan Director Bob Goodwin. 37 38 Councilman Cornett moved for engrossment of Ordinance No. 3184-1977, sec- 39 onded by Councilman Ahaus and on unanimous voice vote the motion was 40 carried. 41 42 Councilman Cornett moved to suspend the rules and read Ordinance No. 43 3184-1977 on third and final reading by title only, seconded by Council- 44 man Mills. Councilman Elstro voted no. 45 46 The Clerk read on second reading Ordinance No. 3186-1977 - AN ORDINANCE 47 AUTHORIZING A "SPECIAL USE" IN A C-1 NEIGHBORHOOD BUSINESS DISTRICT, OF 48 ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE 49 CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 50 51 The Clerk read a letter from the Plan Commission stating their vote of 52 six (6) to three (3) for denial of this request. 53 54 Speaking for Ordinance No. 3186-1977 was Attorney for the petitioners 55 Mr. Bob Reinke. Mr. Clarence Dillman of Murphy Oil Co. and Mr. Richard 56 Brantner, representative of Brantner Agency were in the audience. 57 58 Mr. Reinke stated the sellers have located a new buyer (Long John Silvers) 59 for the location, who would not require the sale of beer and wine; there- 60 fore, he recommended striking this portion from the Ordinance. 61 62 City Plan Director Bob Goodwin requested attachment of certain conditions 63 to this request, including layout, landscaping, drainage plans and curb 64 cuts. 249 Common Council Minutes Cont'd June 6, 1977 Page 3 1 Councilman Mills moved to amend to strike from Section 1, line 6 the 2 words "to serve beer and wine" and to include in the ordinance the 3 conditions of the Plan Director, seconded by Councilman Cornett and 4 on unanimous voice vote the motion was carried. 5 6 Councilman Austerman moved for engrossment of Ordinance No. 3186-1977, 7 seconded by Councilman Paust and on unanimous voice vote the motion was 8 carried. 9 10 Councilman Austerman suggested that between now and the next meeting 11 this ordinance be returned to the Plan Commission for review. 12 13 Councilman Mills moved to suspend the rules and read Ordinance No. 14 3186-1977 on third and final reading by title only, seconded by Council- 15 man Cornett. Councilman Elstro voted no. 16 17 The Clerk read on second reading Ordinance No. 3193-1977 - AN ORDINANCE 18 AUTHORIZING A "SPECIAL USE" IN AN M-1 LIGHT INDUSTRIAL DISTRICT, OF 19 ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE 20 CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 21 22 The Clerk read a letter from the Plan Commission stating their vote of 23 nine (9) to zero (0) to allow this special use. 24 25 Speaking for Ordinance No. 3193-1977 was Mr. Robert O'Maley, Attorney 26 for the petitioner. 27 28 Councilman Mills moved for engrossment of. Ordinance No. 3193-1977, 29 seconded by Councilman Paust and on unanimous voice vote the motion was 30 carried. 31 32 Councilman Mills moved to suspend the rules and read Ordinance No. 3193- 33 1977 on third and final reading by title only, seconded by Councilman 34 Paust and on unanimous voice vote the motion was carried. 35 36 The Clerk read on third reading by title only Ordinance No. 3193-1977. 37 38 Ordinance No. 3193-1977 was placed on final passage or rejection and on 39 a call of the roll the following was recorded: Ayes: Elstro, Williams, 40 Ahaus, Austerman, Merchanthouse, Mills, Cornett, Paust and Carter. The vote beirng nine (9) to zero (0) in favor of the passage of 42 Ordinance No. 3193-1977. 43 44 The Clerk read on second reading Ordinance No. 3194-1977 - AN ORDINANCE 45 TO ANNEX TO THE CITY OF RICHMOND, INDIANA, CERTAIN TERRITORY CONTIGUOUS 46 THERETO, DESCRIBING THE SAME, PROVIDING FOR THE PUBLICATION THEREOF, AND 47 FIXING THE TIME WHEN THE SAME SHALL TAKE EFFECT. 48 49 The Clerk read a letter from the Plan Commission stating their vote of 50 nine (9) to zero (0) in favor of this annexation. 51 52 Speaking for Ordinance No. 3194-1977 was Mr. Robert Burton, Attorney 53 for the petitioner. 54 55 Councilman Elstro moved for engrossment of Ordinance No. 3194-1977, 56 seconded by Councilman Mills and on unanimous voice vote the motion was 57 carried. 58 59 Councilman Williams moved to suspend the rules and read Ordinance No. 60 3194-1977 on third and final reading by title only, seconded by Council- 62 man Merchanthouse and on unanimous voice vote the motion was carried. 63 63 The Clerk read on third reading by title only Ordinance No. 3194-1977. 250 Common Council Minutes Cont'd June 6, 1977 Page 4. 1 Ordinance No. 3194-1977 was placed on final passage or rejection and 2 on a call of the roll the following was recorded: Ayes: Elstro, 3 Williams, Ahaus, Austerman, Merchanthouse, Mills, Cornett, Faust= and 4 Carter. The vote being nine (9) to zero (0) in favor 5 of passage of Ordinance No. 3194-1977. 6 7 City Plan Director Bob Goodwin stated he received a letter from the 8 petitioner to strike Ordinance No. 3195-1977. 9 10 Councilman Mills moved Ordinance No. 3195-1977 be stricken, seconded 11 by Councilman Ahaus and on unanimous voice vote the motion was carried. 12 13 The. Clerk read on second reading Ordinance No. 3200-1977. 14 15 The Clerk summarized a letter from the Plan Commission, noting a 16 unanimous vote in favor of this request. 17 18 Councilman Mills moved for engrossment of Ordinance No. 3200-1977, 19 seconded by Councilman Austerman and on unanimous voice vote the 20 motion was carried. 21 22 Councilman Williams moved to suspend the rules and read Ordinance 23 No. 3200-1977 on third and final reading by title only, seconded by 24 Councilman Austerman and on unanimous voice vote the motion was 25 carried. 26 27 The. Clerk read on third reading by title only Ordinance No. 3200- 28 1977. 29 30 Ordinance No. 3200-1977 was placed on final passage or rejection 31 and on a call of the roll the following was recorded: Ayes: 32 Elstro, Williams, Ahaus, Austerman, Merchanthouse, Mills, Cornett, 33 Paust and Carter. The vote being nine (9) to zero 34 CO) in favor of passage of Ordinance No. 3200-1977. 35 36 The Clerk read on second reading Ordinance No. 3201-1977 - AN 37 ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE 38 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 39 1968. 40 41 Councilman Austerman moved to dispense with reading the letter 42 from the Plan Commission noting a nine (9) to zero (0) vote in 43 favor of rezoning, seconded by Councilman Williams and on unanimous 44 voice vote the motion was carried. 45 46 Councilman Austerman moved for engrossment of Ordinance No. 3201- 47 1977, seconded by Councilman Williams and on unanimous voice vote 48 the motion was carried. 49 50 Councilman Austerman moved to suspend the rules and read Ordinance 51 No. 3201-1977 on third and final reading by title only, seconded 52 by Councilman Mills and on unanimous voice vote the motion was 53 carried. 54 55 The Clerk read on third reading by title only Ordinance No. 3201- 56 1977. 57 58 Ordinance No. 3201-1977 was placed on final passage or rejection 59 and on a call of the roll the following was recorded: Ayes: 60 Elstro, Williams, Ahaus, Austerman, Merchanthouse, Mills, Cornett, 61 Paust and Carter. No. 3204-1977 - AN 6 ORDINANCE TO APPROPRIATE FROM THE FEDERAL REVENUE SHARING TRUST 7 FUND. The vote being nine (9) to zero (0) in favor 57 of passage of Ordinance No. 3209-1977. 58 - 59 The Clerk read on second reading Ordinance No. 3210-1977. 60 61 Councilman Faust moved to amend Ordinance No. 3210-1977 to reduce 62 the amount from seven thousand dollars ($7,000.00) to three thousand 63 five hundred dollars ($3,500.00) , seconded by Councilman Elstro.
