HomeMy Public PortalAbout02-21-1977 221 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RIC MONTD, INDTANA, rEBRUARY 21, 1977 1 The Common Council of the City of Richmond, Indiana, met _in 2 regular session February 21, 1977 at the hour of 7:30 p.m. in the 3 Council Chambers in the Municipal Building in said City. 4 President Carter presided with the following members present: 5 Messrs. Ahaus , Austerman, Cornett, Elstro, Merchanthouse, 6 Mills, Paust and Williams. Absent: None. The following 7 business was had, to-wit: 8 9 Councilman Mills gave devotions. 10 11 Councilman Williams moved to approve the minutes of the previous 12 meeting, seconded by Councilman Mills and on unanimous voice vote 13 the motion was carried. 14 15 - Councilman Austerman moved to suspend the rules and read 16 Resolution No. 3-1977 and Resolution No. 4-1977 by title only, 17 seconded by Councilman Mills and on unanimous voice vote the 18 motion was carried. 19 20 The Clerk read Resolution No. 3-1977 by title only - A RESOLUTION 21 TO TRANSFER WITHIN THE GENERAL FUND BOARD OF PUBLIC WORKS AND 22 SAFETY, CURRENT CHARGES. 23 24 Councilman Mills moved for adoption of Resolution No. 3-1977, 25 seconded by Councilman Williams and on unanimous voice vote the 26 motion was carried. 27 III28 The Clerk read Resolution No. 4-1977 by title only - A RESOLUTION 29 TO TRANSFER MONEY WITHIN THE GENERAL FUND, CITY COURT, SERVICES 30 PERSONAL. 31 32 Councilman Mills moved for adoption of Resolution No. 4-1977, 33 seconded by Councilman Ahaus and the motion was carried with 34 Councilman Austerman voting no. 35 36 Mr. Meredith reported that the Police Department is checking 37 closely now the leaving on of-ahe lights at Clear Creek 38 basketball courts. 39 40 Mr. Webb stated, in response to Councilman Elstro's question 41 concerning the drain on South 13th below "Q", that nothing can 42 be done until construction season starts. 43 44 Councilman Elstro stated that the downtown area is very trashy 45 and reconmiended merchants should use containers. 46 47 City Controller Don Meredith reported his office has signed 48 and returned statements of_:assurance, to:thel Federal-=lRevenue 49 Sharing general office for EP8 allocation. For the first nine 50 (9) months of this year we will receive $558,685.00. 51 111 52 Councilman Austerman reported the Transportation Committee has 53 met and is ready to vote on the upcoming ordinance. 54 55 Councilman Paust reported the Committee of Public Safety met 56 to discuss Ordinance No. 3183-1977 and reconunends approval 57 of this ordinance. 58 59 Councilman Mills reported he received a letter from the Social 60 Planning Group. This group will meet with alcohol rehabilitation 61 and a report should be ready in the next week or so. 62 63 222 . Common Council Minutes Cont t d February 21, 1977 Page 2. 1 Councilman Mills moved to suspend the rules and read Ordinance No. 2 3184-1977 and No. 3185-1977:on first reading by title only, 3 seconded by Councilman Ahaus and on unanimous voice vote the 4 motion was carried. 5 6 The Clerk read on first reading by title only Ordinance No. 3184- 7 1977 AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968, COMMONLY 8 KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RI CHMOND, INDIANA, 9 ADOPTED .JUNE 3, 1968. 10 11 President Carter announced Ordinance No. 3184-1977 is referred to 12 the Plan Commission for study and recolmnendation. 13 14 The Clerk read on first reading by title only Ordinance No. 3185- 15 1977 - AN ORDINANCE TO APPROPRIAl'h FROM THE FEDERAL REVENUE 16 SHARING TRUST FUND. 17 18 President Carter announced Ordinance No. 3185-1977 has to be 19 advertised. 20 21 The Clerk read on second reading Ordinance No. 3182-1977 - AN 22 ORDINANCE TO APPROPRIATE WITHIN THE PARK AND RECREATION FUND. 23 24 Councilman Mills moved to accept and file proof =of publication 25 of Ordinance No. 3182-1977, seconded by Councilman Elstro and on 26 unanimous voice vote the motion was carried. 27 28 Councilman Mills moved for engrossment of Ordinance No. 3182- 29 1977, seconded by Councilman Paust and on unanimous voice vote 30 the motion was carried. 31 32 Councilman Merchanthouse moved to suspend the rules and read 33 Ordinance No. 3182-1977 on third and final reading by title only, 34 seconded by Councilman Ahaus and on unanimous voice vote the 35 motion was carried. 36 37 The Clerk read on third reading by title only Ordinance No. 3182- 38 1977. 39 40 Ordinance No. 3182-1977 was placed on final passage or rejection 41 and on a call,of the roll the following was recorded: Ayes: 42 Ahaus , Austerman, Carter, Cornett, Elstro, Merchanthouse, Mills, 43 Paust and Williams. Noes: None. The vote being nine (9) to 44 zero CO) in favor of passage of Ordinance No. 3182-1977. 45 46 The Clerk read on second reading Ordinance No. 3183-1977 - AN 47 ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND. 48 49 Councilman Mills moved to accept and file proof of publication 50 of Ordinance No. 3183-1977, seconded by Councilman Paust and 51 on unanimous voice vote the motion was carried. 52 53 Councilman Williams moved for engrossment of Ordinance No. 3183- 54 1977, seconded by Councilman Ahaus and on unanimous voice vote 55 the motion was carried. 56 57 Councilman Williams moved to suspend the rules and read Ordinance 58 No. 3183-1977 on third and final reading by title only, seconded 59 by Councilman Mills and on unanimous voice vote the motion was 60 carried. 61 62 The Clerk read on third reading by title only Ordinance No. 3183- 63 1977. 64 65 Ordinance No. 3183-1977 was placed on final passage or rejection 66 and on a call of the roll the following was recorded: Ayes : 223 Common Council Minutes Conttd February 21, 1977 Page 3. 1 Ahaus, Austerman, Carter, Elstro, Mills, Paust and Williams. Noes: 2 Cornett and Merchanthouse. The vote being seven (7) to two (2) III3 in favor of passage of Ordinance No. 3183-1977. 4 5 Councilman Mills moved to suspend the rules and read Ordinance Nos. 6 3160-1977, 3178-1977 on third reading by title only, seconded by 7 Councilman Paust and.on unanimous voice vote the -motion was 8 carried. 9 10 The Clerk read on third reading by title only Ordinance No. 3160- 11 1977 - AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY 12 KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, 13 ADOPTED JUNE 3, 1968. 14 15 Ordinance No. 3160-1977 was placed on final passage or rejection and 16 on a call of the roll the following was recorded: Ayes: Carter, 17 Elstro and Paust. Noes: Ahaus, Austerman, Cornett, Merchanthouse, 18 Mills and Williams. The vote being three (3) to six (6) in 19 favor of passage of Ordinance NO. 3160-1977; ;therefore, Ordinance 20 No. 3160-1977 was rejected. 21 22 The Clerk read on third reading by title only Ordinance No. 3178- 23 1977 - AN ORDINANCE TO AMEND THE RULES OF COMMON COUNCIL. 24 25 Ordinance No. 3178-1977 was placed on final passage or rejection 26. and on a call of the roll the following was recorded: Ayes: 27 Ahaus, Aus.terman, Carter, Cornett, Mills and Paust. Noes: 28 Elstro, Merchanthouse and Williams. The vote being six (6) to 29 three (3) in favor of passage of Ordinance No. 3178-1977. 30 31 The Clerk read on third reading by title only Ordinance No. 3179- 32 1977 - AN ORDINANCE`.TO APPROPRIATE FROM THE FEDERAL REVENUE 33 SHARING TRUST FUND. 34 35 Ordinance No. 3179-1977 was placed on final passage or rejection 36 and on a call of the roll the following was recorded: Ayes: 37 Ahaus , Austerman, Carter, Elstro, Merchanthouse, Mills, Paust 38 and Williams. Noes: Cornett. The vote being eight (8) to 39 one (1) in favor of passage of Ordinance No. 3179-1977. 40 41.
