HomeMy Public PortalAbout02-07-1977 2 .5 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND , INDIANA, FEBRUARY 7 , 1977 1 The Common Council of the City of Richmond , Indiana , met 2 in regular session February 7 , 1977 at the hour of 7 : 30 3 p .m. in the Council Chambers in the Municipal Building 4 in said City. President Carter presided with the follow- 5 ing members present : Messrs . Ahaus , Austerman, Cornett , 6 Elstro , Merchanthouse , Mills , Paust and Williams . Absent : 7 None. The following business was had , to-wit : 8 9 Councilman Merchanthouse gave devotions . 10 11 Councilman Elstro reported he- was absent from the previous 12 meeting as he was in the hospital and Councilman 13 Merchanthouse reported he was ill. 14 15 Councilman Williams moved to approve the minutes of the 16 previous meeting , seconded by Councilman Mills and on 17 unanimous voice vote the motion was carried . 18 19 Councilman Mills moved to suspend the rules and read 20 Resolution No . 2-1977 by title only , seconded by Council- 21 man Paust and on unanimous voice vote the motion was 22 carried . 23 24 The Clerk read Resolution No . 2-1977 by title only - 25 RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION WITH 26 THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT , FOR 27 COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS , AS PROVIDED IN 28 TITLE I OF THE COMMUNITY DEVELOPMENT ACT 1974 , P .L . 93- 29 383 . 30 31 Councilman Mills moved for adoption of Resolution No . 2- 32 1977 , seconded by Councilman Ahaus and on unanimous voice 33 vote the motion was carried . 34 35 Mayor Dickman stated the City Airport Commission recently 36 received word they may be decertified . The Commission is 37 working hard to bring the Airport back to date and may 38 need funds to bring it back to standards . The Commission 39 is making plans to move ahead . 40 41 Mayor Dickman stated he is proud of our community for 42 accepting the challenge of the energy shortage . 43 44 In response to Councilman Merchanthouse ' s question concern- 45 ing the safety of the Main Street Bridge , City Engineer 46 George Webb reported a division chief from Greenfield 47 concluded the drainage system is frozen and water is 48 causing the bridge to heave . A bridge expert will be 49 here tomorrow. 50 51 Mayor Dickman stated in response to Councilman Merchanthouse ' s 52 question as to whether there is a fuel shortage in Richmond , 53 that at this moment there is no shortage but , not knowing 54 what the weather will be in Feburary, it is best to cut 55 back now. 56 57 Councilman Mills stated he had received complaints on 58 lights being left on at the basketball court at Clear 59 Creek Park. 60 61 In response to Councilman Williams ' question concerning 62 re-routing of City busses , Transportation Director 63 Jerry Haynes stated that plans are not finalized for 64 re-routing . 65 216 .d. Haynes stated that hopefully the snows are over . 2 His department is now working on the problems of 3 clearing for the flow of water when the snow melts 4 and filling chuck holes . 5 6 Councilman Austerman announced he will call a meet- 7 ing of the Transportation Committee the week of 8 February 13 . 9 10 Councilman Mills moved to suspend the rules and read 11 Ordinances Nos . 3181-1977 , 3182-1977 and 3183-1977 12 on first reading by title only, seconded by Council- 13 man Paust and on unanimous voice vote the motion was 14 carried . 15 16 The Clerk read on first reading by title only Ordinance 17 No . 3181-1977 - AN ORDINANCE AMENDING ORDINANCE NO . 18 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE 19 CITY OF RICHMOND , INDIANA, ADOPTED JUNE 3 , 1968 . 20 21 Attorney Robert L . O 'Maley gave a brief explanation of 22 this ordinance. 23 24 President Carter announced Ordinance No . 3181-1977 is 25 referred to the Plan Commission for study and recom- 26 mendation. 27 28 The Clerk read on first reading by title only Ordinance 29 No . 3182-1977 - AN ORDINANCE TO APPROPRIATE WITHIN 30 THE PARK AND RECREATION FUND . 31 32 President Carter announced Ordinance No . 3182-1977 has 33 to be advertised . 34 35 The Clerk read on first reading by title only Ordinance 36 No . 3183-1977 - AN ORDINANCE TO APPROPRIATE WITHIN 37 THE GENERAL FUND . 38 39 President Carter referred Ordinance No . 3183-1977 to 40 the Public Safety Committee and announced this 41 ordinance has to be advertised . 42 43 The Clerk read on second reading Ordinance No . 3160- 44 1977 - AN ORDINANCE AMENDING ORDINANCE NO . 2325-1968 45 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF 46 RICHMOND , INDIANA, ADOPTED JUNE 3 , 1968 . 47 48 The Clerk read a letter from the Plan Commission 49 stating their vote of seven (7) to zero (0) to deny 50 Ordinance No . 3160-1977 . 51 52 Speaking for Ordinance No . 3160-1977 were : Attorney 53 Robert Burton, 1010 So . Common Council Minutes Cont ' d Page 3 . 1 Councilman Mills moved for engrossment of Ordinance No . 2 3160-1977 , seconded by Councilman Cornett and on 3 unanimous voice vote the motion was carried . 4 5 Councilman Austerman moved to suspend the rules and 6 move Ordinance No . 3160-1977 to third and final read- 7 ing by title only , seconded by Councilman Mills and on 8 a call of the roll , Councilman Elstro voted no . 9 10 The Clerk read on second reading Ordinance No . 3175-1977 11 - AN ORDINANCE AMENDING ORDINANCE NO . 2325-1968 12 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF 13 RICHMOND , INDIANA, ADOPTED JUNE_ 3 , 1968 . 14 15 The Clerk read a letter from the Plan Commission stating 16 their vote of seven (7) to zero (0) in favor of Ordinance 17 No . 3175-1977 . 18 19 Speaking for Ordinance No . 3175-1977 was Mr . Ronald 20 ' Maze , Jacobs-Maze Associates , 111 So . 10th Street . 21 22 Councilman Mills moved for engrossment of Ordinance No . 23 3175-1977 , seconded by Councilman Paust and on unanimous 24 voice vote the motion was carried . 25 26 Councilman Cornett moved to suspend the rules and 27 read Ordinance No. 3175-1977 on third and final reading 28 by title only, seconded by Councilman Williams and on 29 a call of the roll the following was recorded : Ayes : 30 Ahaus , Austerman, Carter , Cornett , Elstro , Merchanthouse, 31 Mills , Paust and Williams . Noes : None . The vote 32 being nine (9) to zero (0) in favor of the suspension. 33 34 The Clerk read on third reading by title only Ordinance 35 No . 3175-1977 . 36 37 Ordinance No . 3175-1977 was placed on final passage or 38 rejection and on a call of the roll the following was 39 recorded : Ayes : Ahaus , Austerman, Carter , Cornett , 40 Elstro , Merchanthouse, Mills , Paust and Williams . Noes : 41 None. The vote being nine (9) to zero (0) in favor of 42 passage of Ordinance No . 3175-1977 . 43 44 The Clerk read on second reading Ordinance No . 3177-1977 45 - 'AN ORDINANCE TO ANNEX TO THE CITY OF RICHMOND , INDIANA, 46 CERTAIN TERRITORY CONTIGUOUS THERETO , DESCRIBING THE 47 SAME, PROVIDING FOR THE PUBLICATION THEREOF , AND FIXING 48 THE TIME WHEN THE SAME SHALL TAKE EFFECT . 49 50 The Clerk read a letter from the Plan Commission stating 51 their vote of seven (7) to zero (0) in favor of 52 Ordinance No . 3177-1977 . 53 54 Speaking for Ordinance No . 3177-1977 was Mr . Rick Freeman. 55 56 Councilman Mills moved to correct the legal description 57 on Tract 5 , line 18 . from 142 . 11 to 2-4.2 . 11; .seconded by" 58 Councilman Paust -and on unatimous •voice vote the motion 59 was carried . 60 61 Councilman Elstro moved for engrossment of Ordinance No . 62 3177-1977 , seconded by Councilman Williams and on 63 unanimous voice vote the motion was carried . 64 65 Councilman Cornett moved to suspend the rules and move 66 Ordinance No . 3177-1977 to third and final reading by 67 title only , seconded by Councilman Elstro and on a call 68 of the roll the following was recorded : 69 218 Common Council Minutes Cont ' d. Noes : Elstro , Merchanthouse and 23 Williams . W. 3rd Street . 8 9 Councilman Cornett moved for engrossment of Ordinance 10 No . 3180-1977 , seconded by Councilman Mills and on 11 unanimous voice vote the motion was carried . 12 13 Councilman Austerman moved to suspend the rules and 14 move Ordinance No . 3180-1977 to third and final read- 15 ing by title only, seconded by Councilman Mills and 16 on unanimous voice vote the motion was carried . 17 18 The Clerk read on third reading by title only 19 Ordinance No . 3180-1977 . 20 21 Ordinance No . 3180-1977 was placed on final passage or 22 rejection and on a call of the roll the following was 23 recorded : Ayes : .Ahaus , Carter , Cornett , Mills and 24 Paust . Noes : Austerman, Elstro , Merchanthouse and 25 Williams .
