HomeMy Public PortalAbout01-04-1977 205 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY :OF:=:RI CHMOND, _INDI-=ANA .'JANUARY. -4, _1977 Si The Common Council of the City of Richmond, Indiana, met in 2 regular session January 4, 1977 at the hour of 7:30 p.m. in the 3 Council Chambers in the Municipal Building in said City. 4 President Mills presided with the following members present: 5 Messrs. Ahaus , Austerman , Carter, Cornett, Elstro, Merchanthouse , 6 and Williams. Absent: Paust. The following business was had, 7 to-wit: 8 g Councilman Cornett gave devotions. 10 11 President Mills announced nominations open for President of 12 Common Council for the year 1977. 13 14 Councilman Cornett nominated Councilman James Carter for President 15 of Common Council , seconded by Councilman Austerman. 16 17 Councilman Ahaus moved the nominations be closed, seconded by 18 Councilman Austerman and on unanimous voice vote the motion was 19 carried. 20 21 Newly-elected President Carter complimented President Mills for 22 a job well done. 23 24 Councilman Williams moved to approve the minutes of the previous 25 meeting, seconded by Councilman Mills and on unanimous voice vote 111 26 the motion was carried. 27 28 Mayor Dickman thanked President Mills and wished President Carter 29 the best of luck. 30 31 Councilman Elstro reported there is a ti:TeAitch on the west side 32 of the street where new construction is being done on South 13th 33 below So. "Q" with only a screen over the opening. He asked if this 34 was to be left this way. Mr. Webb stated this will be corrected 35 when the project is completed. Councilman Elstro recommended 36 a guard rail be installed. 37 38 Councilman Williams asked if the fund has been exhausted for the 39 tree cutting program. He stated he is not satisfied.with this 40 program. Mr. Meredith stated funds are available in the new 41 budget of 1977 and he will get a report of this program. 42 43 President Carter announced the following committee appointments 44 for 1977: 45 46 1 . Councilman 19 Ahaus moved the nominations be closed, seconded by 20 Councilman Mills and on unanimous voice vote the motion 21 was carried. 22 23 President Carter announced Rick Ahaus would be Chairman of RP&L 24 for another year and Ken Mills President Pro-tem of Council . 25 26 President Mills thanked Council members for his year in office. 27 28 Councilman Mills moved to suspend the rules and read Ordinance No. 29 3171-1977 on first reading by title only, seconded by Councilman 30 Ahaus and on unanimous voice vote the motion was carried. 31 32 The Clerk read on first reading by title only Ordinance No. 3171- 33 1977 - AN ORDINANCE PROVIDING FOR ADDITIONAL LONGEVITY PAY FOR 34 POLICEMEN. 35 36 Councilman Mills moved to suspend the rules and move Ordinance No. 37 3171-1977 to second reading, seconded by Councilman Williams and 38 on unanimous voice vote the motion was carried. 39 40 The Clerk read on second reading Ordinance No. 3171-1977. 41 42 Councilman Mills moved for engrossment. of Ordinance No. 3171- 43 1977, seconded by Councilman Ahaus and on unanimous voice vote the 44 motion was carried. 45 46 Councilman Williams moved to suspend the rules and read Ordinance 47 No. 3171-1977 on third and final reading by title only, seconded 48 by Councilman Mills and on unanimous voice vote the motion was 49 carried. 50 51 The Clerk read on third reading by title only Ordinance No. 3171- 52 1977. 53 54 Ordinance No. 3171-1977 was placed on final passage or rejection 55 and on a call of the roll the following was recorded: Ayes: Ahaus , 56 Austerman , Carter, Cornett, Elstro, Merchanthouse , Mills and 57 Williams. Noes : None. The vote being eight (8) to zero (0) in 58 favor of passage of Ordinance No. 3171-1977. 59 60 Councilman Elstro moved to suspend the rules and read Ordinance 61 No. 3172-1977 on first reading by title only, seconded by Council- 62 man Austerman and on unanimous voice vote the motion was carried. 63 64 The Clerk read on first reading by title only Ordinance No. 3172- 65 1977 - AN ORDINANCE TO APPROPRIATE FROM THE FEDERAL REVENUE. 66 SHARING TRUST FUND. 207 Common Council Minutes Cont'd January 4, 1977 Page 3. 1 President Carter announced this ordinance has to be advertised. 2 3 Councilman Ahaus moved to suspend the rules and read Ordinance No. 4 3173-1977 on first reading by title only, seconded by Councilman 5 Mills and on unanimous voice vote the motion was carried. 6 7 The Clerk read on first reading by title only Ordinance No. 8 3173-1977 - AN ORDINANCE TO APPROPRIATE FROM ANTIRECESSION FISCAL 9 ASSISTANCE FUND. 10 11 President Carter announced this ordinance has to be advertised. 12 13 Councilman Elstro moved to suspend the rules and read Ordinance 14 No. 3174-1977 on first reading by title only, seconded by 15 Councilman Mills and on unanimous voice vote the motion was carried. 16 17 The Clerk read on first reading by title only Ordinance No. 3174- 18 1977 - AN ORDINANCE TO APPROPRIATE FROM THE FEDERAL REVENUE 19 SHARING TRUST FUND. 20 21 President Carter announced this ordinance has to be advertised. 22 23 The Clerk read on second reading Ordinance No. 3159-1976 AN 24 ORDINANCE AMENDING ORDINANCE NO. 1594-1956 COMMONLY KNOWN AS THE 25 RULES AND REGULATIONS GOVERNING THE CONDUCT OF ALL PERSONS AT THE 26 MUNICIPAL AIRPORT OF THE CITY OF RICHMOND, INDIANA, ADOPTED AUGUST 27 20 , 1956. 28 29 Speaking for Ordinance No. 3159-1976 was Mr. Robert E. Brooks , 30 2715 Northmont Blvd. who stated that this ordinance was not in 31 violation of any contract with Sky Tech. 32 33 Councilman Mills moved for engrossment of Ordinance No. 3159- 1976 , 34 seconded by Councilman Ahaus and on unanimous voice vote the 35 motion was carried. 36 37 Councilman Mills moved to suspend the rules and move Ordinance No. 38 3159-1976 to third and final reading by title only, seconded by 39 Councilman Ahaus and on unanimous voice vote the motion was 40 carried. 41 42 The Clerk read on third reading by title onlyOrdinance-No --3159_7.1976. 43 44 Ordinance No. ' 3159-1976 was placed on final passage or rejection 45 and on a call of the roll the following was recorded: Ayes: Ahaus , 46 Austerman , Carter, Cornett, Elstro, Merchanthouse , Mills and 47 Williams. The vote being eight (8) to zero CO) in favor of 48 passage of Ordinance No. 3159-1976. 49 50 The Clerk read on second reading Ordinance No. 3166-1976 - AN 51 ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE III52 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 53 3, 1968. 54 55 President Carter read a letter from the Plan Commission stating 56 they voted unanimously, seven (7) to zero CO) to recommend 57 approval of the petition. 58 . 59 Councilman Mills moved for engrossment of Ordinance No. 3166-1976 , 60 seconded by Councilman Williams and on unanimous voice vote the 61 motion was carried. 62 • 63 Councilman Ahaus moved to suspend the rules and move Ordinance No. 64 3166-1976 to third and final reading by title only, seconded by 65 Councilman Mills and on unanimous voice vote the motion was 66 carried. 208 Common Council Minutes Cont'd January 4, 1977 Page 4. 1 The Clerk read on third reading Ordinance. The vote being eight (8) to zero (0) in 7 favor of passage of Ordinance No. 3166-1976. 8 9 The Clerk read on second reading Ordinance No. 3169-1976 - AN 10 ORDINANCE TO APPROPRIATE THIRTY SEVEN THOUSAND SIX HUNDRED AND 11 TWENTY FIVE DOLLARS AND THREE CENTS ($37 ,625.03) FROM THE FEDERAL 12 REVENUE SHARING TRUST FUND, FOR CERTAIN ORDINARY AND NECESSARY 13 MAINTENANCE AND OPERATING EXPENDITURES AND FOR CERTAIN ORDINARY 14 AND NECESSARY CAPITAL EXPENDITURES AS AUTHORIZED BY THE LAWS OF 15 THE STATE OF INDIANA AND BY THE ORDINANCES OF THE CITY OF RICHMOND, 16 INDIANA. 17 18 CoUricilman Mills moved to accept and file proof of publication of 19 Ordinance No. 3169-1976, seconded by Councilman Ahaus and on 20 unanimous voice vote the motion was carried. 21 22 Speaking for the Social Services Planning Board was Mrs. Nancy Klose, 23 Chairman. 24 25 Speaking -for Ordinance No. 3169-1976 were Darrell Beane, Judge of 26 Richmond City Court and Martin Berg, Executive Director of CARES , 27 Inc. 28 _ 29 Councilman Mills moved to approve the recommended amendment of Mr. 30 Don Meredith for a reduction in this ordinance of $13 ,877.95 in 31 . the requested amount, making it $23 ,747.08, seconded by Councilman 32 Elstro and on unanimous voice vote the motion was carried. 33 34 Councilman Mills. moved for engrossment of Amended Ordinance -No. 35 3169-1976, seconded by Councilman Ahaus and on unanimous voice vote 36 the motion was carried. 37 38 Councilman Williams moved to suspend the rules and move Amended 39 - Ordinance No. 3169-1976 to third and final reading by title only, 40 seconded by Councilman Mills and on unanimous voice vote the motion 41 was carried. 42 43 The Clerk read on third reading by title only Amended Ordinance No. 44 3169-1976 - AN ORDINANCE TO APPROPRIATE TWENTY THREE THOUSAND 45 SEVEN HUNDRED AND FORTY SEVEN DOLLARS AND EIGHT CENTS ($23,747.08) 46 FROM THE FEDERAL REVENUE SHARING TRUST FUND, FOR CERTAIN- ORDINARY 47 AND NECESSARY MAINTENANCE AND OPERATING EXPENDITURES AND FOR 48 CERTAIN ORDINARY AND NECESSARY CAPITAL EXPENDITURES AS AUTHORIZED BY 49 THE LAWS OF THE STATE OF INDIANA AND BY THE ORDINANCES OF THE CITY 50 OF RICHMOND, INDIANA. 51 0 - 52 Ordinance No. 3169-1976 was placed on final passage or rejection 53 and on a call of the roll the following was recorded: Ayes: Ahaus, 54 Carter, Cornett, Elstro, Merchanthouse, Mills and Williams. Noes: 55 Austerman. The vote being seven (7) to one (1) in favor of 56 passage of.
