PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, DECEMBER 20, 1976
1 The Common Council of the City of Richmond, Indiana, met in
2 regular session December 20, 1976 at the hour of 7:30 p.m. in the
3 Council Chambers in the Municipal Building in said City. President
4 Mills presided with the following members present: Messrs. Ahaus ,
5 Austerman, Carter, Elstro, Merchanthouse, Paust and Williams .
6 Absent: Cornett. The following business was had, to-wit:

8 Councilman Elstro gave devotions.

10 Councilman Williams moved to approve the minutes of the previous
11 meeting, seconded by Councilman Paust and on unanimous voice vote
12 the motion was carried.

14 Councilman Austerman moved to suspend the rules and read Resolution
15 No. 25-1976 by title only, seconded by Councilman Elstro and on
16 unanimous voice vote the motion was carried.

18 The Clerk read by title only Resolution No. 25-1976 - A RESOLUTION
19 APPROVING THE USE OF LOCAL OPTION FUNDS OF THE COMMUNITY DEVELOP-
20 MENT BLOCK GRANT FOR THE ACQUISITI-0N ,'OF THE':FOLLOWING TRACTSAF
21 LAND WITHIN THE CITY OF RICHMOND: LOTS 41 ,42,43,44 JESSE IDEN'S
22 ADDITION TO THE CITY OF RICHMOND COMMONLY KNOWN AS: 415 and 419
23 NORTH D STREET.

25 Mr. Tim Ryder spoke for and explained this resolution .

27 Councilman Elstro moved to table this resolution until the
28 executive meeting. The motion died for lack of a second.

30 Councilman Paust moved to approve Resolution No. 25-1976, seconded
31 by Councilman Williams and on unanimous voice vote the motion
32 was carried.

34 Mayor Dickman made the following comments :

36 (1 ) He feels the Alcoholic Rehabilitation Programs
37 in the City should be consolidated into one fine
38 program.
39 (2) He thanked the Wayne County Commissioners and
40 Wayne County Council for fixing the bridge on
41 Sim Hodgin Parkway.
42 (3) He would like to see the Human Relations Commission
43 reinstated. The Ordinance creating this was passed
44 in 1968 and has been dormant for at least two (2)
45 years . His recommendations to serve on this
46 commission are Rev. O. W. Barber, Mrs . William
47 Rodefeld, reappointment of Dr. William Christopher.

49 Councilman Elstro moved to accept the Mayor's recommendation to
50 the Human Relations Commission , seconded by Councilman Paust and
51 on unanimous voice vote the motion was carried.

53 , President Mills announced the Mayor has appointed Ralph Pyle to
54 Redevelopment Commission.

56 Director of Community Development Tim Ryder in response to a
57 request from Councilman Williams for an accounting report of
58 Community Development funds asked for more time in preparing
59 this report as his office is in the process of compiling reports .

1 City Controller Don Meredith reported that the State Board of Tax
2 Commissioners raised a technical question as to having ordinances
3 on the table appearing on the agenda at each and every meeting
4 after them being placed on the table. The concern is that
5 citizens are not b-ein=g made aware of the ordinance and where it
6 stands .

8 The State Board of Tax Commissioners warned that in the future
9 any ordinance placed on the table should come on the agenda the
10 following meeting and every meeting thereafter until removed from
11 the table with a note by the President that it is being continued
12 on the table if there was not a motion to bring it off.

14 Mr. Meredith announced there is a regular scheduled meeting of
15 the Plan Commission on December 28, 1976; however, the property
16 at 18th and Main will not be considered at this time .

18 Mr. Meredith stated that for the first time two (2) Councilmen
19 elected to go under the Public Employees Retirement Fund at the
20 beginning of the year. This raised a question in the Controller's
21 Office because once a position is placed under this fund, you can
22 only stay off of this fund for one year, which means that starting
23 January 1 , all the Councilmen would have to go on PERF. The
24 ordinance states that all elected officials will be under PERF,
25 but there is also a requirement by PERF as to full time and part
26 time employment. This puts Council in a grey area. PERF says
27 Council should pass an Ordinance either electing to go under PERF
28 or not to go under PERF. If Council elects to go under this plan
29 and then decide not to, they must remain on the retirement plan
30 for seven (7) years after electing not to do it. If Council
31 elects at this time not to go under this plan, the two (2)
32 Councilmen now under this plan will be refunded their money.

34 President Mills announced there will be a Committee of the Whole
35 meeting Monday, January 3 at 7:30 p.m. in the Board of Works Room
36 and•..the next regular Council meeting will be January 4.

38 Councilman Elstro moved to suspend the rules and read Ordinance No.
39 3166-1976 on first reading by title only, seconded by Councilman
40 Ahaus and on unanimous voice vote the motion was carried.

43 1976 - AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY
44 KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA,
45 ADOPTED JUNE 3, 1968.

47 President Mills announced this ordinance will go to the Plan
48 Commission for study and recommendation .

50 Councilman Ahaus moved to suspend the rules and read Ordinance No.
51 3167-1976 on first reading by title only, seconded by Councilman
52 Paust and on unanimous voice vote the motion was carried.

54 The Clerk read on first reading by title only Ordinance No. 3167-
55 1976 - AN ORDINANCE FIXING THE NUMBER OF POLICE RESERVES OF THE
56 CITY OF RICHMOND, INDIANA.

58 Chief of Police Charles Chris spoke for and explained this
59 ordinance.

20 Councilman Williams and on unanimous voice vote the motion was
21 carried.

4 Councilman Merchanthouse moved to suspend the rules and read Ordinance
5 No. 317071976 on first reading by title only, seconded by Councilman
6 Paust and on unanimous voice vote the motion was carried.

41 Councilman Paust moved for engrossment of Ordinance No. 3140-1976,
42 seconded by Councilman Williams and on unanimous voice vote the

46 3140-1976 on third reading by title only, seconded by Councilman
47 Williams and on unanimous voice vote the motion was carried.

15 passed the meeting was adjourned.
