HomeMy Public PortalAbout12-06-1976 191 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, DECEMBER 6, 1976 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session December 6, 1976 at the hour of 7:30 p.m, in the Council 3 Chambers in the Municipal Building in said City. President Mills 4 presided with the following members present: Messrs . Ahaus , 5 Austerman, Carter, Cornett, Elstro, Merchanthouse, Paust and 6 Williams . Absent: None. The following business was had, to-wit: 7 8 Councilman Carter gave devotions . 9 10 Councilman Williams reported he was absent from the last regular 11 meeting due to being on vacation . 12 13 Councilman Williams moved to approve the minutes of the previous 14 meeting, seconded by Councilman Paust and on unanimous voice vote 15 the motion was carried. 16 17 Councilman Austerman moved to suspend the rules and read on first 18 reading by title only Resolution No. 24-1976, seconded by Council- 19 man Paust and on unanimous voice vote the motion was carried. 20 21 The Clerk read by title only Resolution No. 24-1976 -RESOLUTION 22 AUTHORIZING THE FILING OF AN APPLICATION WITH THE DEPARTMENT OF 23 TRANSPORTATION, UNITED STATES OF AMERICA, FOR A GRANT UNDER THE 24 URBAN MASS TRANSPORTATION ACT OF 1964, AS AMENDED. 25 26 Mr. Matt Nepote, Deputy Director of Community Development, reviewed III 27 in detail project description and project justification. 28 29 Councilman Elstro moved for adoption of Resolution No. 24-1976, 30 seconded by Councilman Paust. Voting for this resolution were 31 Messrs . Ahaus, Austerman, Carter, Cornett, Elstro, Merchanthouse, 32 Paust and Williams . Councilman Cornett voted nay. 33 34 Mayor Dickman reported on his attendance at the Mayor's Conference 35 in Denver. 36 37 Mr. Meredith reported that the City of Richmond just recently 38 received $80,708.00 which is the Anti-Recession Program Funds of 39 Public Works Employment Act Title II . This represents the first 40 two quarters . One of the stipulations is that it must be 41 appropriated within a six (6) month period and must be used to 42 maintain basic services customarily provided. It is the plan at 43 this time to use this money for the Park payroll budget. 44 45 Mr. Reinke reported that the Board of Works received an offer for 46 purchase of real estate which is City owned on South 9th Street and 47 immediately east of the RP&L generating plant. Mr. Reinke 48 checked with Mr. Huffman, General Manager of RP&L, who felt RP&L 49 might possible be able to use this land. 50 51 Councilman Williams requested an accounting report of Community 52 Development funds by the end of the year. 53 54 Councilman Merchanthouse requested the Board of Works consider 55 looking at the possibility of manning the parking garage on 56 holidays, specifically the Friday after Thanksgiving. 57 58 Councilman Elstro reported it had been two (2) weeks since his area 59 has had trash pick-up. 60 61 Councilman Austerman suggested looking into the possibility of 62 contracting trash pick-up to private firms 63 64 Councilman Williams reported the alley between North 3rd and 4th 65 Streets is in bad shape. , 192 • Common Council Minutes Cont'd December 6, 1976 Page 2. 1 Councilman Elstro moved to suspend the rules and read Ordinance No. 2 3159-1976 on first reading by title only, seconded by Councilman 3 Austerman and on unanimous voice vote the motion was carried. 4 5 The Clerk read on first reading by title only Ordinance No . 3159- 6 1976 - AN ORDINANCE AMENDING ORDINANCE NO. 1594-1956 COMMONLY 7 KNOWN AS THE RULES AND REGULATIONS GOVERNING THE CONDUCT OF ALL PERSONS 8 AT THE MUNICIPAL AIRPORT OF THE CITY OF RICHMOND, INDIANA, ADOPTED 9 AUGUST 20, 1956 . 10 11 President Mills announced Ordinance No. 3159-1976 will go to the 12 Committee of the Whole for study. 13 14 Councilman Elstro moved to suspend the rules and read Ordinance No. 15 3160-1976 on first reading by title only, seconded by Councilman 16 Austerman and on unanimous voice vote the motion was carried. 17 18 The Clerk read on first reading by title only Ordinance No. 3160-1976 19 - AN ORDINANCE AMENDING ORDINANCE NO . 2325-1968 COMMONLY KNOWN AS 20 THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 21 3, 1968. 22 23 President Mills announced Ordinance No. 3160-1976 will- go to the 24 Plan Commission for study and recommendation. 25 26 Councilman Ahaus moved to suspend the rules and read Ordinance N'o. 27 3161-1976 on first reading by title only, seconded 'by Councilman 28 Austerman and on unanimous voice vote the motion was carried. 29 30 The Clerk read on first reading by title only Ordinance No. 3161-1976 31 - AN ORDINANCE APPROPRIATING THE SUM OF ONE THOUSAND THREE HUNDRED 32 AND TWENTY FIVE DOLLARS ($1 ,325 .00) FROM THE SURPLUS BARRETT LAW, 33 FOR THE 1977 BUDGET OF THE BARRETT LAW DEPARTMENT. 34 35 Councilman Austerman moved to suspend the rules and read Ordinance 36 No. 3161-1976 on second reading, seconded by Councilman Merchanthouse 37 and on unanimous voice vote the motion was carried. 38 39 The Clerk read on second reading Ordinance No. 3161-1976. 40 41 Councilman Austerman moved for engrossment of Ordinance No. 3161-1976,. 42 seconded by Councilman Paust and on unanimous voice vote the motion 43 was carried. 44 45 Councilman Austerman moved to suspend the rules and read Ordinance 46 No. 3161-1976 on third and final reading by title only, seconded by 47 Councilman Ahaus and on unanimous voice vote the motion was carried. 48 49 The Clerk read on third reading by title only Ordinance No . 3161- 50 1976. 51 52 Ordinance No. 3161-1976 was placed on final passage or rejection and 53 a call of the roll the following was recorded: Ayes: Ahaus, 54 Austerman, Carter, Cornett, Elstro, Merchanthouse, Mills , Paust and 55 Williams . The vote being nine (9) to zero (0) in 23 favor of Ordinance No. 3164-1976 . 24 25 Councilman Williams moved to suspend the rules and read Ordinance 26 No. 3165-1976 on first reading by title only, seconded by Council- 27 man Elstro and on unanimous voice vote the motion was carried. 28 29 The Clerk read on first reading by title only Ordinance No. 3165- 30 1976 - AN ORDINANCE TO TRANSFER WITHIN THE PARK AND RECREATION 31 FUND. 32 33 Councilman Cornett moved to suspend the rules and move Ordinance No. 34 3165-1976 to second reading, seconded by Councilman Paust and on 35 unanimous voice vote the motion was carried. 36 37 The Clerk read on second reading Ordinance No. 3165-1976. 38 39 Councilman Paust moved for engrossment of Ordinance No. 3165-1976, 40 seconded by Councilman Elstro and on unanimous voice vote the motion 41 was carried. 42 43 Councilman Elstro moved to suspend the rules and read Ordinance No. 44 3165-1976 on third and final reading by title only, seconded by 45 Councilman Williams and on unanimous voice vote the motion. was 46 carried. 47 48 The Clerk read on third reading by title only Ordinance No. 3165- 49 1976. 50 51 Ordinance No. 3165-1976 was placed on final passage or rejection and 52 on a call of the roll the following was recorded: Ayes: Ahaus , 53 Austerman, Carter, Cornett, Elstro, Merchanthouse, Mills, Paust and 54 Williams . Noes : None. The vote being nine (9) to zero (0)` in 55 favor of passage of Ordinance No. 3165-1976. 56 57 Mr. Roland Robbins , a member of the Computer Task Force Committee, 58 reported the Committee makes the following recommendations: (1 ) 59 leasing instead of purchasing for a five (5) year period, which 60 would include maintenance, NCR 8200 system. (2) additional monies 61 to cover the program. (3) expanding the Committee to include other 62 governing bodies in Wayne County. (4) Committee will present a 63 full report to Council outlining details. (5) cost will be 64 $21 ,460.00 for 1977 eight (8) months of rental . 65 66 Councilman Ahaus moved to take Ordinance No. 3084-1976 off the table 195 Common Council Minutes Cont'd December 6, 1976 Page 5. 1 seconded by Councilman Austerman and on unanimous -voice vote the 2 motion was carried. II/ 3 4 Councilman Ahaus moved to amend the amount of Ordinance No. 3084- 5 1976 to twenty one thousand four hundred sixty dollars ($21 ,460.00) 6 in the title and insert leasing and the above amount in Section 2, 7. seconded by Councilman Merchanthouse and on unanimous voice vote the 8 motion was carried. 9 10 The Clerk read on second reading Amended Ordinance No. 3084-1976 - 11 AN ORDINANCE TO APPROPRIATE TWENTY ONE THOUSAND FOUR HUNDRED SIXTY 12 DOLLARS ($21 ,460.00) FROM THE FEDERAL REVENUE SHARING TRUST FUND, 13 FOR CERTAIN ORDINARY AND NECESSARY MAINTENANCE AND OPERATING 14 . EXPENDITURES AND FOR CERTAIN ORDINARY AND NECESSARY CAPITAL EXPEN- 15 ' DITURES AS AUTHORIZED BY THE LAWS OF THE STATE OF INDIANA AND BY 16 THE ORDINANCES" OF THE CITY OF RICHMOND, INDIANA. 17 18 Councilman Cornett moved for engrossment of Amended Ordinance Na. 19 3084-1976, seconded. by Councilman Paust and on unanimous voice vote 20 the motion was carried. . 21 22 Councilman Cornett moved to suspend the rules and read Amended 23 Ordinance No. 3084-1976 on third and final reading by title only, 24 seconded by Councilman Carter and on unanimous voice vote the motion 25 was carried. 26 27 The Clerk read on third reading by title only Amended Ordinance No. 28 3084-1976. 29 30 Amended Ordinance No. 3084-1976 was placed on final passage or 31 rejection and on a call of the roll the following was recorded: 32 Ayes : Ahaus, Austerman, Carter, Cornett, Elstro, Merchanthouse, 33 Mills , Paust and Williams . ; Noes : None. The vote being nine (9) 34 to zero (0) in favor of passage of Ordinance No. 3084-1976. 35 36 The Clerk read on second reading Amended Ordinance No. 3137-1976 - 37 AN ORDINANCE AMENDING ORDINANCE No. 2325-1968, COMMONLY KNOWN AS 38 THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 39 3, 1968. - 40 : 41 The Clerk read a letter from the Plan Commission stating they 42 voted five (5) to three (3) to deny the petition . 43 44 Councilman Elstro moved for engrossment of Amended Ordinance No. 45 3137-1976, seconded by Councilman Carter and on unanimous voice vote 46 the motion was carried. 47 48 President Mills announced Amended Ordinance No. 3137-1976 will be 49 held until the next meeting. 50 51 The Clerk read on second reading Ordinance No. 3139-1976 - AN III52 ORDINANCE AMENDING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE 53 - ZONING .ORDINANCE OF THE CITY OF RICHMOND,INDIANA, ADOPTED JUNE 3, 54 1968. 55 56 The Clerk read a letter from the Plan Commission stating that after 57 due consideration the Planning Commission voted eight (8) to zero 58 (0) to amend the petition to include only the site legally described 59 as Lot #3 Mapletonc• Addition being 82.5 feet in width along the north 60 side of N. W. L and extending north from N.W. Noes: 26 Ahaus , Austerman, Carter, Cornett, Elstro, Mills and Paust. The 27 vote being seven (7) to two (2) to deny this motion. III 28 29 Ordinance No. 3146-1976 was placed on final passage or rejection 30 and on a call of the roll the following was recorded: Ayes : Ahaus , 31 Austerman, Carter, Cornett, Elstro, Mills and Paust. Noes : 32 Merchanthouse and Williams .
