HomeMy Public PortalAbout11-15-1976 185 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, NOVEMBER 15, 1976 1 The Common Council of .the City of Richmond, Indiana, met in regular 2 session November 15, 1976 at the hour of 7:30 p.m. in the Council 3 Chambers in the Municipal Building i.n sai.d City. President Mills 4 presided with the following members present: Messrs . Ahaus, 5 Austerman, Carter, Cornett, Elstro, Merchanthouse and Paust. 6 Absent: Mr. Williams . The following business was had, to-wit: 7 8 Councilman Austerman gave devotions . 9 10 Councilman Merchanthouse moved to approve the minutes of the previous 11 meeting, seconded by Councilman Paust and on unanimous voice vote 12 the motion was carried. 13 14 Mr. Bob Reinke reported for the Board of Works concerning a request 15 of a gentleman on N. W. 18th on truck traffic on that street 16 going to Nettle Creek and Hill 's . The Traffic Department conducted 17 research which showed from six (6) to twelve (12) semis used this 18 street during the week the count was conducted. This seems to be a 19 problem to which there is no solution, as the only other route 20 would be to use N. W. 5th Street and Peacock Road. Sgt. Ron Williams 21 will personally contact the gentleman and report the findings to him. 22 23 Councilman Cornett moved to suspend the rules and read Ordinance 24 No. 3153-1976 on first reading by title only, seconded by Councilman 25 Carter and on unanimous voice vote the motion was carried. 26 27 The Clerk read on first reading by title only Ordinance No . 3153- 28 1976 - AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN 29 AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED 30 JUNE 3, 1968. 31 1 32 • President Mills announced Ordinance No. 3153-1976 is referred to 33 the Plan Commission for study and recommendation . 34 35 Councilman Elstro moved to suspend the rules and read Ordinance No. 36 3154-1976 on first reading by title only, seconded by Councilman 37 Carter and on unanimous voice vote the motion was carried. 38 39 The Clerk read on first reading by title only Ordinance No. 3154- 40 1976 - AN ORDINANCE TO APPROPRIATE TWO THOUSAND DOLLARS ($2,000.00) 41 FROM THE FEDERAL REVENUE SHARING TRUST FUND FOR CERTAIN ORDINARY 42 AND NECESSARY MAINTENANCE AND OPERATING EXPENDITURES AND FOR 43 CERTAIN ORDINARY AND NECESSARY CAPITAL EXPENDITURES AS AUTHORIZED 44 BY THE STATE OF INDIANA AND BY THE ORDINANCES OF THE CITY OF 45 -RICHMOND, INDIANA. 46 47 President Mills announced Ordinance No. 3154-1976 has to be adver- 48 tised. 49 50 Councilman Ahaus moved to suspend the rules and read Ordinance No. 51 3155-1976 on first reading by title only, seconded by Councilman 52 Austerman and on unanimous voice vote the motion was carried. 53 54 The Clerk read on first reading by title only Ordinance No. 3155- 55 1976 - AN ORDINANCE TO TRANSFER WITHIN THE PARK AND RECREATION 56 FUND. 57 58 Councilman Elstro moved to suspend the rules and move Ordinance No. 59 3155-1976 to second reading, seconded by Councilman Paust and on 60 unanimous voice vote the motion was carried. 61 62 The Clerk read on second reading Ordinance No. 3155-1976. 186 November 15, 1976 Page 2 . 1 Councilman Paust moved for engrossment of Ordinance No. 3155-1976, 2 seconded by Councilman Carter and on unanimous voice vote the motion 3 was carried. 4 5 Councilman P,aust moved to suspend the rules and read Ordinance No. 6 3155-1976 on third and final reading by title only, seconded by 7 Councilman Carter and on unanimous voice vote the motion was 8 carried. 9 10 The Clerk read on third reading by title only Ordinance No. 3155- 11 1976. 12 13 Ordinance No . 3155-1976 was placed on final passage or rejection 14 and on a call of the roll the following was recorded: Ayes: Ahaus, 15 Austerman, Carter, Cornett, Elstro, Merchanthouse, Mills and Paust. 16 Noes: None. The vote being eight (8) to zero (0) in favor of 17 passage of Ordinance No. 3155-1976. 18 19 Councilman Carter moved to suspend the rules and read Ordinance No. 20 3156-1976 on first reading by title only, seconded by Councilman 21 Cornett and on unanimous voice vote the motion was carried-. 22 23 . The Clerk read on first reading by title only Ordinance No. 3156- 24 1976 - AN ORDINANCE TO TRANSFER WITHIN THE PARKING METER FUND. 25 26 Councilman Elstro moved to correct a typographical error from 27 "water" to "wages", seconded by Councilman Ahaus and on unanimous 28 voice vote the motion was carried. 29 30 Councilman Merchanthouse moved to suspend the rules and read 31 Ordinance No. 3156-1976 on second reading, seconded by Councilman 32 Paust and on unanimous voice vote the motion was carried. 33 34 The Clerk read on second reading Ordinance No. 3156-197.6. 35 36 Councilman Carter moved for engrossment of Ordinance No. 31.56- 37 1976, seconded by Councilman Ahaus and on unanimous voice vote the 38 motion was carried. 39 40 Councilman Ahaus moved to suspend the rules and read Ordinance No. 41 3156-1976 on third and final reading by title only, seconded by 42 Councilman Paust and on unanimous voice vote the motion was. 43 carried. 44 45 The Clerk read on third reading by title only Ordinance No. 3156- 46 1976. 47 48 Ordinance No. 3156-1976 was placed on final passage or rejection 49 and on a call of the roll the following was recorded: Ayes: 50 Ahaus, Austerman, Carter, Cornett, Elstro, Merchanthouse, Mills 51 and Paust. Noes: None. The vote being eight (8) to zero (0) 23 in favor of passage of Ordinance No. 3156-1976. 24 25 Councilman Cornett moved to suspend the rules and read Ordinance 26 No. 3158-1976 on first reading by title only, seconded by 27 Councilman Ahaus and on unanimous voice vote the motion was carried. 28 29 The Clerk read on first reading by title only Ordinance No. 3158- 30 1976 - AN ORDINANCE TO TRANSFER WITHIN THE GENERAL FUND. 31 32 Councilman Ahaus moved to suspend the rules and read Ordinance 33 No. 3158-1976 on second reading, seconded by Councilman Austerman 34 and on unanimous voice vote the motion was carried. 35 36 The Clerk read on second reading Ordinance No. 3158-1976. 37 38 Councilman Elstro moved for engrossment of Ordinance No. 3158- 39 1976, seconded by Councilman Ahaus and on unanimous voice vote the 40 motion was carried. 41 42 Councilman Elstro moved to suspend the rules and read Ordinance 43 No. 3158-1976_ on third and final reading by title only, seconded 44 by Councilman Austerman and on unanimous voice vote the motion 45 was carried. 46 47 The Clerk read on third reading by title only Ordinance No. 3158- 48 1976. 49 50 Ordinance No. 3158-1976 was placed on final passage or rejection 51 and on a call of the roll the following was recorded: Ayes: III 52 Ahaus, Austerman, Carter, Cornett, Elstro, Merchanthouse, Mills 53 and Paust. Noes: None. The vote being eight (8) to zero (0) 54 - in favor of passage of Ordinance No: 3158-1976. 55 56 The Clerk read on second reading Ordinance No . 3146-1976 = AN 57 ORDINANCE TO APPROPRIATE TWENTY THOUSAND DOLLARS ($20,000 .00) 58 FROM THE CUMULATIVE CAPITAL IMPROVEMENT FUND (CIGARETTE TAX) . 59 60 Speaking for Ordinance No. 3146-1976 was Mr. Bob Brinker, who has 61 property at 10th and East Main. 188 November 15, 1976 Page 4. 1 Speaking against Ordinance No. 3146-1976 were Dr. Gertrude Ward, 2 secretary of Old Richmond; Mr. Don Bridgeford, R.R. 1 , Fountain 3 City; Laura Kennedy, 419 S.W. 18th. 4 5 Also, speaking on Ordinance No. 3146-1976 were Mr. Matt Stegall and 6 Mr. John Strain of Old Richmond. 7 8 Councilman Paust moved for engrossment of Ordinance No. 3146-1976, 9 seconded by Councilman Mills and on unanimous voice vote the motion 10 was carried. 11 12 Councilman Austerman moved to suspend the rules and read Ordinance 13 No. 3146-1976 on third and final reading by title only, seconded 14 by Councilman Elstro. Councilman Merchanthouse voted "no" . 15 16 Councilman Cornett moved to bring Ordinance No. 3147-1976 off the 17 table, seconded by Councilman Paust and on unanimous• voice vote 18 the motion was carried. 19 20 The Clerk read on second reading Ordinance No. 3147-1976 - AN 21 ORDINANCE TO APPROPRIATE TWENTY THOUSAND THREE HUNDRED EIGHTY THREE 22 DOLLARS ($20,383.00) FROM FEDERAL REVENUE SHARING TRUST FUND FOR 23 CERTAIN ORDINARY AND NECESSARY MAINTENANCE AND OPERATING EXPENDITURES 24 AS AUTHORIZED BY THE LAWS OF THE STATE OF INDIANA AND THE ORDINANCES 25 IN THE CITY OF RICHMOND, INDIANA. 26 27 Speaking against Ordinance No. 3147-1976 were Mr. Rick Freeman, 28 2104 Autumn Way; Ms . Ann Brown; and Mr. Frank Pummerville, 128 So-. 29 22nd Street. Mr. Freeman and Ms. Brown represent Social Planning 30 Services Board who recommend tabeling this ordinance. 31 32 Councilman Cornett moved for engrossment of Ordinance No. 3147- 33 1976, seconded by Councilman Paust and on unanimous voice vote the 34 motion was carried. 35 36 Councilman Mills announced Ordinance No. 3147-1976 will be on third 37 reading at the next regularily scheduled Council meeting. 38 39 The Clerk read on second reading Ordinance No . 3149-1976 - AN 40 ORDINANCE TO APPROPRIATE TWENTY THOUSAND DOLLARS ($20,000 .00) FROM 41 THE FEDERAL REVENUE SHARING TRUST FUND FOR CERTAIN ORDINARY AND 42 NECESSARY MAINTENANCE AND OPERATING EXPENDITURES .AS AUTHORIZED BY 43 THE LAWS OF THE STATE OF INDIANA AND BY THE ORDINANCES OF THE CITY 44 OF RICHMOND, INDIANA. 45 46 Councilman. Elstro moved to accept and file proof of publication of 47 Ordinance No. 3149-1976, seconded by Councilman Paust and on 48 unanimous voice vote the motion was carried. 49 50 Speaking for Ordinance No. 3149-1976 were Mr. Bill Richardson, 1881 51 S.W. "I" Court, Administrator at I . .U. East and Mr. John Abrahms, 52 representing the Student Senate at I U. East. 53 54 Councilman Elstro moved for engrossment of Ordinance No. 3149-1976 55 seconded by Councilman Paust and on unanimous voice vote the motion 56 was carried. . 57 58 Councilman Paust moved to suspend the rules and read Ordinance No. 59 3149-1976 on third and final reading by title only-, seconded by 60 Councilman=_`Elstro. Councilman Cornett voted "no" . 189 Common Council Minutes Cont'd November 15, 1976 Page 5 . 1 The Clerk read on second reading Ordinance No. 3151-1976 - AN 2 ORDINANCE TO APPROPRIATE THE SUM OF THREE HUNDRED SIXTY ONE DOLLARS 3 AND EIGHTEEN CENTS ($361 .18) FROM THE GENERAL FUND CASH OPERATING 4 TO THE GENERAL FUND COMMUNITY DEVELOPMENT D-31 , REPAIR PARTS. 5 6 Councilman Paust moved to accept and file proof of publication of 7 Ordinance No. 3151-1976, seconded by Councilman Ahaus and on unani- 8 mous voice vote the motion was carried. 9 10 Councilman Elstro moved for engrossment of Ordinance No. 3151-1976, 11 seconded by Councilman Mills and on unanimous voice vote the motion 12 was carried. 13 14 Councilman Elstro moved to suspend the rules and read Ordinance No. 15 3151-1976 on third and final reading by title only, seconded by 16 Councilman Paust and on unanimous voice vote the motion was carried. 17 18 The Clerk read on third reading by title only Ordinance No. 3151- 19 1976. 20 21 - Ordinance No. 3151-1976 was placed on final passage or rejection 22 and on a call of the roll the following was recorded: Ayes : 23 Ahaus, Austerman, Carter, Cornett, Elstro, Merchanthouse, Mills and 24 Paust. The vote being eight (8) to zero (0)in favor 25 of passage of Ordinance No. 3151-1976. 26 27 The Clerk read on second reading Ordinance No. 3152-1976. 28 29 Councilman Elstro moved to amend Ordinance No. 3152-1976 Section (1) 30 after business district ", except in those portions of sidewalks 31 designated by the Board as "bicycle routes" which portions shall be 32 appropriately signed and marked as portions of such bicycle routes ." , 33 seconded by Councilman Paust and on unanimous voice vote the motion 34 was carried. 35 36 Speaking for Ordinance No. 3152-1976 were Ms .
