HomeMy Public PortalAbout11-01-1976 181 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, NOVEMBER 1, 1976 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session November 1, 1976 at the hour of 7:30 p.m. in the Council Chambers 3 in the Municipal Building in said City. President Mills presided with 4 the following members present: Messrs. Ahaus, Austerman, Carter, 5 Cornett, Elstro, Merchanthouse, Paust and Williams. Absent: None. 6 The following business was had, to-wit: 7 8 Councilman Ahaus gave devotions. 9 10 Councilman Williams moved to approve minutes of the previous meeting, 11 seconded by Councilman Ahaus and on unanimous voice vote the motion 12 was carried. 13 14 The Clerk read Resolution No. 22-1976 - A RESOLUTION AUTHORIZING THE 15 FILING OF AN APPLICATION WITH THE DEPARTMENT OF COMMERCE, ECONOMIC 16 DEVELOPMENT ADMINISTRATION, FOR A GRANT UNDER TITLE I OF THE PUBLIC 17 WORKS EMPLOYMENT ACT OF 1976, P.L. 93-369, SEC. 107. 18 19 Mr. Matt Nepote spoke for this resolution explaining this will be done 20 with a one hundred percent (100%) Federal grant. 21 22 Councilman Paust moved for adoption of Resolution No. 22-1976, seconded 23 by Councilman Elstro and on unanimous voice vote the motion was carried. 24 25 Speaking against this resolution was Ms. Pauline Rhoades, Centerville, 26 who owns property at 736-738 So. "A". 27 28 Mr. Bob Reinke, City Attorney, announced there will be a special meeting 29 of the Board of Public Works and Safety immediately after Council meeting 30 tonight. 31 32 Mr. Don Meredith, City Controller, read letters ,from the State Board of 33 Accounts and State Board of Tax Commissioner concerning two (2) ordin- 34 ances that were voted on previously dealing with purchase of real estate 35 in a blighted area in Richmond. 36 37 Councilman Merchanthouse read a letter from the State Board of Accounts. 38 39 Councilman Mills gave a letter to the Board concerning trucks still 40 traveling on N. W. 18th Street. 41 42 Mr. Reinke announced that due to the letters received from the SBA and 43 SBTC, the City will not exercise the options to purchase the properties 44 between 10th and 11th Streets except property located at 33-35 North 45 10th Street. 46 47 Mr. Richard Young, 37 So. 19th, accompanied by a group of other property 48 owners in the area surrounded by 16th Street on the west, "A" Street on 49 the north, 23rd Street on the east and Reeveston Rd. on the south who 50 have formed a committee to keep the residential status of the neighborhood. 51 52 Councilman Elstro moved to suspend the rules and read Ordinance No. 3148- 53 1976 on first reading by title only, seconded by Councilman Paust and 54 on unanimous voice vote the motion was carried. 55 56 The Clerk read on first reading by title only Ordinance No. 3148-1976 - 57 AN ORDINANCE OF THE CITY OF RICHMOND AUTHORIZING THE ACQUISITION AND 58 FINANCING OF ECONOMIC DEVELOPMENT FACILITIES, THE ISSUANCE AND SALE OF 59 REVENUE BONDS TO PAY THE COST THEREOF, AND THE LEASING OF SUCH FACILITIES 60 TO EIIPCO REALTY, AND OTHER MATTERS RELATING THERETO. 61 62 Mr. Andrew Cecere, Attorney for the Economic Development Commission, spoke 63 for this ordinance. Mr. Allan Rosar and Mr. James Rush were in attendance 64 for this ordinance. 182 Common Council Minutes Cont'd November 1, 1976 Page 2 1 Councilman Paust moved for suspension of the rules and read Ordinance No. 2 3148-1976 on second reading, seconded by Councilman Ahaus and on unanimous 11/ 3 voice vote the motion was carried. 4 5 The Clerk read on second reading Ordinance No. 3148-1976. 6 7 Councilman Elstro moved for engrossment of Ordinance No. 3148-1976, 8 seconded by Councilman Williams and on unanimous voice vote the motion was 9 carried. 10 11 Councilman Williams moved for suspension of the rules and place Ordinance 12 No. 3148-1976 on third and final reading by title only, seconded by 13 Councilman Paust and on unanimous voice vote the motion was carried. 14 15 The Clerk read on third reading by title only Ordinance No. 3148-1976. 16 17 Ordinance No. 3148-1976 was placed on:final passage or rejection and on a 1 call of the roll the following was recorded: Ayes: Ahaus, Austerman, 8 Carter, Cornett, Elstro, Merchanthouse, Mills, Paust and Williams. Noes: 19 None. The vote being nine (9) to zero (0) in favor of passage of Ordinance 20 No. 3148-1976. 21 22 Councilman Elstro moved to suspend the rules and read Ordinance No. 3149- 23 1976 on first reading by title only, seconded by Councilman Paust and 24 on unanimous voice vote the motion was carried. 25 26 The Clerk read on first reading by title only Ordinance No. 3149-1976 - 27 AN ORDINANCE TO APPROPRIATE TWENTY THOUSAND DOLLARS ($20,000.00) FROM THE 28 FEDERAL REVENUE SHARING TRUST FUND FOR CERTAIN ORDINARY AND NECESSARY 29 MAINTENANCE AND OPERATING EXPENDITURES AS AUTHORIZED BY THE LAWS OF THE 30 STATE OF INDIANA AND BY THE ORDINANCES OF THE CITY OF RICHMOND, INDIANA. 31 32 President Mills announced Ordinance No. 3149-1976 has to be advertised 33 and will go to the Transportation Committee for study and recommendation. 34 35 Councilman Merchanthouse moved to suspend the rules and read Ordinance No. 36 3150-1976 on first reading by title only, seconded by Councilman Williams 37 and on unanimous voice vote the motion was carried. 38 39 The Clerk read on first reading by title only Ordinance No. 3150-1976 - 40 AN ORDINANCE TO TRANSFER WITHIN THE .GENERAL FUND ONE HUNDRED DOLLARS 41 ($100.00) FROM _I-9 SUBSCRIPTIONS AND DUES, CITY ATTORNEY TO I-7 STATIONERY 42 AND PRINTING, CITY ATTORNEY. 43 44 Councilman Elstro moved to suspend the rules and move Ordinance No. 3150- 45 1976 to second reading, seconded by Councilman Williams and on unanimous 46 voice vote the motion was carried. 47 48 The Clerk read on second reading Ordinance No. 3150-1976. 49 50 Councilman Williams moved for engrossment of Ordinance No. 3150-1976, 51 seconded by Councilman Paust and on unanimous voice vote the motion was 52 carried. 53 54 Councilman Williams moved to suspend the rules and read Ordinance No. 3150- 55 1976 on third reading by title only, seconded by Councilman Elstro and 56 on unanimous voice vote the motion was carried. 57 58 Ordinance No. 3150-1976 was placed on final passage or rejection and on a 59 call of the roll the following was recorded: Ayes: Ahaus, Austerman, 60 Carter, Cornett, Elstro, Merchanthouse, Mills, Paust and Williams. Noes: 61 None. The vote being nine (9) to zero (0) in favor of passage of 62 Ordinance No. 3150-1976. 183 Common Council Minutes Cont'd November 1, 1976 Page 3 1 Councilman Ahaus moved to suspend the rules and read Ordinance No. 3151 2 1976 on first reading by title only, seconded by Councilman Williams 3 and on unanimous voice vote the motion was carried. 4 5 The Clerk read on first reading by title only Ordinance No. 3151-1976- 6 AN ORDINANCE TO APPROPRIATE THE SUM OF THREE HUNDRED SIXTY ONE DOLLARS 7 AND EIGHTEEN CENTS ($361.18) FROM THE GENERAL FUND CASH OPERATING TO 8 THE GENERAL FUND COMMUNITY DEVELOPMENT D-31, REPAIR PARTS. 9 10 President Mills announced Ordinance No. 3151-1976 has to be advertised. 11 12 Councilman Elstro moved to suspend the rules and read Ordinance No. 13 3152-1976 on first reading by title only, seconded by Councilman Paust 14 and on unanimous voice vote the motion was carried. 15 16 The Clerk read on first reading by title only Ordinance No. 3152-1976 - 17 AN ORDINANCE AMENDING CHAPTER 41, ARTICLE XI, SECTION 41.71 (s) , RIDING 18 ON SIDEWALKS. 19 20 The Clerk read on second reading Ordinance No. 3124-1976 - AN ORDINANCE 21 AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE 22 OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 23 24 The Clerk read a letter from the Plan Commission stating they voted 25 seven (7) to zero (0) in favor of Ordinance No. 3124-1976. 26 27 Councilman Austerman moved for engrossment of Ordinance No. 3124-1976, 28 seconded by Councilman Williams and on unanimous voice vote the motion 29 was carried. 30 31 Councilman Austerman moved to suspend the rules and read Ordinance No. 32 3124-1976 on third reading by title only, seconded by Councilman 33 Williams and on unanimous voice vote the motion was carried. 34 35 The Clerk read on third reading by title only Ordinance No. 3124-1976. 36 37 Ordinance No. 3124-1976 was placed on final passage or rejection and on 38 a call of the roll the following was recorded: Ayes: Ahaus, Austerman, 39 Carter, Cornett, Elstro, Merchanthouse, Mills, Paust and Williams. Noes: 40 None. The vote being nine (9) to zero (0) in favor of passage of 41 Ordinance No. 3124-1976. 42 43 The Clerk read on second reading Ordinance No. 3143-1976 - AN ORDINANCE 44 AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE 45 OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 46 47 The Clerk read a letter from the Plan Commission stating they voted 48 seven (7) to zero (0) in favor of Ordinance No. 3143-1976. 49 50 Councilman Austerman moved for engrossment of Ordinance No. 3143-1976, III 51 seconded by Councilman Paust and on unanimous voice vote the motion 52 was carried. 53 54 Councilman Austerman moved to suspend the rules and read Ordinance No. 55 3143-1976 on third reading by title only, seconded by Councilman Williams; 56 and on unanimous voice vote the motion was carried. 57 58 The Clerk read on third reading by title only Ordinance No. 3143-1976. 59 60 Ordinance No. 3143-1976 was placed on final passage or rejection and on 61 a call of the roll the following was recorded: Ayes: Ahaus, Austerman, 62 Carter, Cornett, Elstro, Merchanthouse, Mills, Paust and Williams. Noes: 63 None. GENERAL FUND CASH OPERATING TO THE GENERAL FUND DEPARTMENT OF 4 PUBLIC SAFETY-FIRE DIVISION M-14, FIRE PROTECTION, RENTAL OF HYDRANTS 5 AND LINES. 6 7 Councilman Puast moved to accept and file proof of publication of Ordin- 8 ance No. 3145-1976, seconded by Councilman Ahaus and on unanimous voice 9 vote the motion was carried. 10 11 Councilman Elstro moved for engrossment of Ordinance No. 3145-1976, 12 seconded by Councilman Paust and on unanimous voice vote the motion was 13 carried. - 14 15 Councilman Paust moved to suspend the rules and read Ordinance No. 3145- 16 1976 on third reading by title only, seconded by Councilman Elstro and 17 on unanimous voice vote the motion was carried. 18 19 The Clerk read on third reading by title only Ordinance No. 3145-1976. 20 21 Ordinance No. 3145-1976 was placed on final passage or rejection and on 22 a call of the roll the following was recorded: Ayes: Ahaus, Austerman, 23 Carter, Cornett, Elstro, Merchanthouse, Mills, Paust and Williams. Noes: 24 None. The vote being nine (9) to zero (0) in favor of passage of 25 Ordinance No. 3145-1976. 26 27 The Clerk read on second reading Ordinance No. 3146-1976 - AN ORDINANCE 28 TO APPROPRIATE TWENTY THOUSAND DOLLARS ($20,000.00) FROM THE CUMULATIVE 29 CAPITAL IMPROVEMENT FUND (CIGARETTE TAX) . 30 31 Councilman Paust moved to accept and file proof of publication of Ordin- 32 ance No. 3146-1976, seconded by Councilman Ahaus and on unanimous voice 33 vote the motion was carried. 34 35 Speaking against Ordinance No. 3146-1976 were Gertrude Ward, R. R. 1, 36 Centerville and Argus Osborne, 258 No. 22nd. 37 38 Councilman Paust moved for engrossment of Ordinance No. 3146-1976. This 39 motion died for lack of a second. 40 41 The Clerk read on second reading Ordinance No. 3147-1976 - AN ORDINANCE TO 42 APPROPRIATE TWENTY THOUSAND THREE HUNDRED EIGHTY THREE DOLLARS ($20,383.00) 43 FROM FEDERAL REVENUE SHARING TRUST FUND FOR CERTAIN ORDINARY AND NECESS' 'Y 44 MAINTENANCE AND OPERATING EXPENDITURES AS AUTHORIZED BY THE LAWS OF THE 45 STATE OF INDIANA AND THE ORDINANCES IN THE CITY OF RICHMOND, INDIANA. 46 47 Councilman Paust moved to accept and file proof of publication of Ordin- 48 ance No. 3147-1976, seconded by Councilman Cornett and on unanimous voice 49 vote the motion was carried. 50 51 Councilman Cornett, Chairman of the Community Service Committee, reported 52 his committee sees far reaching possibilities with this ordinance, many 53 of which are controversial. It is the unanimous committee agreement 54 that this ordinance be presented to the Committee of the Whole. 55 56 Councilman Paust moved to table Ordinance No. 3147-1976, seconded by 57 Councilman Merchanthouse and on unanimous voice vote the motion was 58 carried. 59 60 President Mills announced there will be a Committee of the Whole meeting 61 on Thursday, November 4 at 7:30 p.m. in the Board of Works Room. 62 63 There being no further business on motion duly made, seconded and passed, 64 the meeting was adjourned. 65 Kenneth Mills 66 President 67 ATTEST: JoEllen Trimble City Clerk
