HomeMy Public PortalAbout10-18-1976 177 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, OCTOBER 18, 1976 1 The Common Council of the City of Richmond, Indiana met in regular session 2 October 18, 1976 at the hour of 7:30 p.m. in the Council Chambers in the 3 Municipal Building in said City. President Mills presided with the 4 following members present: Messrs . Ahaus, Austerman, Carter, Cornett, 5 ' Elstro, Merchanthouse, ?Paust and Williams . Absent: None. The follow- 6 ing business was had, to-wit: 7 8 Councilman Williams gave devotions . 9 10 Councilman Williams moved to approve the minutes of the previous meeting 11 with a correction on line 23, page one, being Mt. Olive Baptist Church, 12 seconded by Councilman Paust and on unanimous voice vote the motion was 13 carried. 14 15 Councilman Cornett moved to suspend the rules and read Resolution No. 16 21-1976 by title only, seconded by Councilman Elstro and on unanimous 17 voice vote the motion was carried. 18 19 The Clerk read Resolution No. 21-1976 - A RESOLUTION ENDORSING THE 20 INDIANA FOOTBALL HALL OF FAME AND EXPRESSING THANKS TO THE SUPPORTERS 21 THEREOF.bby title only. , 22 23 - Councilman Paust moved to approve Resolution No . 21-1976, seconded by 24 Councilman Elstro and on unanimous voice vote the motion was carried. 25 ' 26 Mayor Dickman stated he is thankful to have the Football Hall of Fame 27 herea in Richmond, Indiana, and is hopeful it will continue to grow and 28 improve. 29 30 Councilman Elstro asked if it is legal for the Mayor- to make a blanket 31 order to burn leaves in the City of Richmond, to which the City Attorney 32 answered, "yes 33 34 Councilman Paust stated that it was not the intention of Council at the 35 time of the passage of the Ordinance controlling leaf burning that a 36 wholesale burning' permit could be authorized. He recommended that in 37 the future, Ordinances be specifically spelled out. He is of the opinion 38 that burning should hotabe ai lowed-andorecommeided the language be 39 changed in this Ordinance so that wholesale burning cannot be allowed 40 next year. 41 . 42 Speaking against leaf burning from the audience were: Dr. Carolyn Blakey, 43 687 Farlow Road, representing SPUR; Mrs . Joan Lemoine, 603 Fry Lane, 44 representing the League of Women Voters; Mrs . Hazel Pummerville, 128 So. 45 22nd Street; Matt Stegall , 403 So . 10th Street; Bertran Ward, Centervile_; 46 Cynthia Anderson, 325 So. 7th Street and John. Brown , 2016 North "E" Street. 47 48 Mayor Dickman noted that burning is for a limited trial period of two (2) 49 weeks only.- 50 III 51 Councilman Elstro moved to suspend the rules and read Ordinance No . 3143- 52 1976 on first reading by title only, seconded by Councilman Paust and on 53 unanimous voice vote the motion was carried. 54 55 The Clerk read on first reading by title only Ordinance No . 3143-1976 - 56 AN'ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING 57 ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 58 59 President Mills announced Ordinance No . 3143-1976 is referred to the Plan 60 Commission for study and recommendation . 61 ' 62 Councilman Elstro moved to suspend the rules and read Ordinance No. 3144- 63 1976 on first reading by title only, seconded by Councilman Paust and on 64 unanimous voice vote the motion was carried. 178 Common Council Minutes Cont'd October 18, 1976 Page 2 1 The Clerk read on first reading by title only Ordinance No . 3144-1976 - AN 2 ORDINANCE TO TRANSFER WITHIN THE. AIRPORT OPERATING FUND ONE HUNDRED_DOLLARS 3 ($100.00) FROM MA-18 MATERIALS TO MA-6 PUBLICATION OF LEGAL NOTICES. 11/ 5 Councilman Cornett moved to suspend the rules and read Ordinance No. 3144- . 6 1976 on second reading, seconded by Councilman Carter and on unanimous 7 voice vote the motion was carried. 8 9 The Clerk read on second reading Ordinance No. 3144-1976. 10 11 Councilman Williams moved for engrossment of Ordinance No. 3144-1976, 12 seconded by Councilman Ahaus and on unanimous voice vote the motion was 13 carried. 14 15 Councilman Williams moved to suspend the rules and read Ordinance No . 16 3144-1976 on third reading by title only, seconded by Councilman Paust 17 and on unanimous voice vote the motion was carried. 18 19 The Clerk read on third reading by title only Ordinance No . 3144-1976 . 20 21 Ordinance No . 3144-1976 was placed on final passage or rejection and on a 22 call of the roll the following was recorded: Ayes: Ahaus, Austerman, 23 Carter, Cornett, Elstro, Merchanthouse, Mills, _Paust and Williams . Noes: 24 None. The vote being nine (9) to zero (0) in favor of passage of Ordinance 25 No. 3144-197.6. 26 27 Councilman Elstro moved to suspend the rules and read Ordinance No. 3145- 28 1976 on first reading by title only, seconded by Councilman Paust and on 29 unanimous vOice vote the motion was carried. 30 31 The Clerk read on first reading by title only Ordinance No. 3145-1976 - AN 32 ORDINANCE TO APPROPRIATE THE SUM OF TEN THOUSAND ONE HUNDRED DOLLARS 33 ($10,:100.00) FROM THE GENERAL FUND CASH OPERATING TO THE GENERAL FUND 34 DEPARTMENT OF PUBLIC SAFETY-FIRE DIVISION M-14, FIRE PROTECTION, RENTAL 35 OF HYDRANTS AND LINES. 36 37 President Mills announced Ordinance No . 3145-1976 has to be advertised. 38 39 Councilman Elstro moved to suspend the rules and read Ordinance No. 3146- 40 1976 on first reading by title only, seconded by Councilman Carter and 41 on unanimous voice vote the motion was carried. 42 43 The Clerk read on first reading by title only Ordinance No. 3146-1976 - 44 AN ORDINANCE TO APPROPRIATE TWENTY THOUSAND DOLLARS ($20,000 .00) FROM THE 45 CUMULATIVE CAPITAL IMPROVEMENT FUND (CIGARETTE TAX) . 46 47 President Mills announced Ordinance No. 3146-1976 has to be advertised. 48. 49 Speaking on the condition of the property involved in this Ordinance were 50 Matt Stegall and Laura Kennedy. 51 52 Councilman Ahaus moved to suspend the rules and read Ordinance No. 3147111 - 53 1976 on first reading by title only, seconded by Councilman Cornett and on 54 unanimous voice vote the motion was carried. 55 56 The Clerk read on first reading by title only Ordinance No . 3147-1976 - 57 AN ORDINANCE TO APPROPRIATE TWENTY THOUSAND THREE HUNDRED EIGHTY THREE 58 DOLLARS ($20,383 .00) FROM FEDERAL REVENUE SHARING TRUST FUND FOR CERTAIN 59 ORDINARY AND NECESSARY MAINTENANCE AND OPERATING EXPENDITURES AS AUTHOR- 60 IZED BY THE LAWS OF THE STATE OF INDIANA AND THE ORDINANCES IN THE CITY OF 61 RICHMOND, INDIANA. 62 63 President Mills announced Ordinance No. 3147-1976 has to be advertised. 179 Commoh Council Minutes Cont'd • October 18, 1976 • Page 3 1 President Mills asked the Community Service Committee to study for 2 recommendation Ordinance No . 3147-1976. . 3 4 President Mills announced each Council member has received a copy of - 5 the Richmond City CourtAlcohol Education and -Rehabilitation Program • 6 _ 1977 Budget Proposal and Progress Report prepared by L. Martin Berg, 7 Director. He asked the Community Service .Committee study this report 8 for recommendation. 9 - 10 The Community Development Committee is requested by President Mills 11 to study proposals for extending the mall from 6th to 5th Streets . 12 13 President Mills announced plans to have an ordinance presented on 14 December 6, 1976 concerning busses and benches and asked the Trans- 15 portation to being study of this ordinance for recommendation at 16 that time. • 17 18 There being no further business on motion duly made, seconded and 19 passed the meeting was adjourned. 20 21 Kenneth Mills 22 President 23 24 ATTEST: JoEllen Trimble 25 City Clerk 180 I
