HomeMy Public PortalAbout09-20-1976 168 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, SEPTEMBER 20, 1976 1 The Common Council of the City of Richmond, Indiana met in regular 2 session September 20, 1976 at the hour of 7: 30 p.m. in the Council 3 Chambers in the Municipal Building in said City. President Mills 4 presided with the following members present: Messrs. Ahaus , Austerman, 5 Carter, Elstro, Merchanthouse, Paust add Williams. Absent: Cornett. 6 The ,following business Was had, to-wit: 7 8 Councilman Merchanthouse gave devotions. 9 10 Councilman Williams moved to approve the minutes of the previous 11 meeting, seconded by Councilman Paust and on unanimous voice vote 12 the motion was carried. 13 14 The Clerk read Resolution No. 20-1976 - A RESOLUTION REGARDING CON- 15 VEYANCE OF REAL ESTATE IN THE CITY OF RICHMOND, INDIANA. 16 17 Councilman Paust moved for adoption of Resolution No. 20-1976, 18 seconded by Councilman Williams and on unanimous voice vote the _ 19 motion was carried. 20 21 Mayor Clifford Dickman welcomed those in attendance. He made a brief 22 statement about the ordinances and gave hi.s views on the proposed 23 Civic Center. 24 25 Councilman Carter asked for a clarification of the September 9th Board 26 of Works minutes concerning altering the present design of the- service d, 27 drive between. North 5th and 6th Streets . City Engineer Geroge Webb 28 explained the alterations at the West end and re-designing the area 29 so that the service drive is six (6) feet wider than it is now so that 30 automobiles would be next to the north curb and cars turning east into 31 the service drive would have ample turning radius . The possibility 32 about doing something about the median strip on 5th Street to `overcome 33 the problem of turning into the Library drive is also being studied. 34 35 Councilman Elstro asked the City Attorney if he had a' ruling as to 36 whether or not the Mayor is allowed to permit burning of leaves... Mr. 37 Reinke stated any one has the right to ask the Fire and Sanitation 38 Departments for such permission. 39 40 Councilman Williams reported that during construction of sidewalks and 41 curbs at 906 North 14th a step was removed in front of this property. 42 The contractor did not replace this step and he would like this taken 43 care of. 44 45 Councilman Williams asked the Board of Works to check a request of Mr. 46 Edgar Williams at 710 North 15th Street. He is mowing weeds and there 47 are no trucks going through at this time. 48 49 Councilman Williams stated there is a lot of trash in the yard at 911 50 No. "I" and the tenant is not capable of doing anything himself. He 51 asked the City to assist in clearing this debris . 52 53 Councilman Williams asked if there is to be any increase in salary for 54 the Fire Fighters, to which the Mayor replied that there is $1100 if 55 they go back to a 56 hour week. If they do not go to 56 hour week they "' 56 do not get increase. The Mayor also pointed out the Sanitary Department 57 increase has not been settled yet either. 58 59 Councilman Elsto moved to suspend the rules and read Ordinance No. 3138- 60 1976 on first reading by title only, seconded by Councilman Williams and 61 on unanimous voice vote the motion was carried. .69 Common Council Minutes Cont'd September 20, 1976 Page 2 1 . The Clerk read on first reading by title only Ordinance No. 3138-1976 - 2 AN ORDINANCE RATIFYING AND CONFIRMING THE MAKING OF AN AGREEMENT TO 3 TRADE OR-EXCHANGE SURPLUS REAL ESTATE WITH THE BOARD OF COMMISSIONERS 4 OF WAYNE COUNTY, INDIANA. . .. . . 5 6 President Mills announced Ordinance No. 3138-1976 has to be advertised. 7 8 Councilman Merchanthouse moved' to suspend the rules and read Ordinance 9 No. 3139-1976 on first reading by title only, seconded by Councilman 10 Williams and on unanimous voice vote the motion was carried. 11 12 The Clerk read on first reading by title only Ordinance No. 3139-1976 - 13 AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE 14 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. . 15 16 President Mills announced Ordinance No. 3139-1976 will go to ,the Plan 17 ' Commission for study and recommendation. 18 19 Councilman Paust moved to suspend the rules and read Ordinance No. 20 3140-1976 on first reading by title only, seconded by Councilman 21 Elstro and on unanimous voice vote the motion was carried. 22 23 • Councilman Carter moved to amend Ordinance No. 3140-1976' to read 213 24 S. W. 2nd Street instead of N. W. . 2nd Street, seconded by Councilman 2 5' Austerman and on unanimous voice vote the motion was carried. 26 27 The Clerk read on first .reading by title only Ordinance No. 3140-1976 - 28 AN ORDINANCE. AUTHORIZING A -"SPECIAL .USE" IN AN R-3 ONE-TO-EIGHT 29 FAMILY RESIDENCE DISTRICT, OF ORDINANCE NO. 2325-1968 COMMONLY KNOWN 30 AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA,- ADOPTED 31 JUNE. 3,. 1968. . 32 33 President Mills announced Ordinance No. 3140-1976 will go to the Plan 34 Commission for study and recommendation. 35 - 36 ' Councilman Williams moved to suspend the rules and read Ordinance No. 37 3141-1976 on first reading by title only, seconded by. Councilman Paust 38 and on unanimous voice vote the motion was carried. 39 - 40 The Clerk read on first reading by title only Ordinance No. 3141-1976 41 AN ORDINANCE AUTHORIZING A "SPECIAL USE" IN AN R-3 ONE-TO-EIGHT FAMILY 42 RESIDENCE DISTRICT OF ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE 43 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA APPROVED JUNE 3, 1968. 44 45 President Mills announced Ordinance No. 3141-1976 will go to the Plan 46 Commission for study. and recommendation. 47 - 48 The Clerk read on second reading Ordinance Na. 33126-1976 - AN ORDINANCE' 49 CHANGING' THE NAME OF A PORTION OF RICH ROAD IN THE CITY OF RICHMOND, 50 INDIANA, TO N. Noes: None. 49 The vote being eight (8) to zero (0) in favor of passage of Ordinance 50 No. 3128-1976. . 51 - 52 The Clerk read on secondr2reading Ordinance No. 3129-1976 - AN ORDINANCE 53 AMENDING CHAPTER 41 , ARTICLE VII, SECTION 41 .39, ONE-WAY STREETS AND 54 ALLEYS, SCHEDULE I. 55 56 Councilman Paust moved to amend the title of Ordinance No. 3129-1976 by 57 adding the following: "AND AMENDING CHAPTER 41 , ARTICLE VII,.
