HomeMy Public PortalAbout03-15-1976 99 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MARCH 15, 1976 1 The Common Council of the City of Richmond, Indiana, met in 2 regular session March 15, 1976 at the hour of 7:30 p.m. in 3 the Council Chambers in the Municipal Building in said City. 4 President .Mills presided with the following members present: 5 Messrs. Ahaus, Austerman , Cornett, Elstro, Merchanthouse, 6 Paust and Williams. Absent: Carter. The following business 7 was had, to-wit: 8 9 Councilman Cornett gave devotions. 10 11 Councilman Cornett reported his absence at the last meeting 12 was due to vacation. - 13 14 Councilman Williams moved to approve the minutes of the pre- 15 vious meeting, seconded by Councilman Austerman and on 16 unanimous voice vote the motion was carried. 17 18 Councilman Merchanthouse presented 'a letter and petition to 19 the members of Council from the residents of Interfaith 20. thanking them for their decision to allocate $30,000.00 -for 21 continuing Richmond City Bus Service and their continued 22 favorable consideration in this matter. 23 24 The Cleric read Resolution No.. 11-1976 - A RESOLUTION TRANS- 25 FERRING FUNDS IN THE COMMUNITY DEVELOPMENT BUDGET. 26 27 Mr. Tim Ryder, Director of Community Development, explained 28 that this request is for.'a metal detector which would be used 29 on many street projects done by his department to discover 30 Surveyor's monuments. At the present time they are renting 31 this service. 32 33 Councilman Williams moved for the adoption of Resolution No. 34 11-1976, seconded by Councilman Austerman and on unanimous 35 -voice vote the motion was carried. 36 37 The Clerk read Resolution No. 12-1976 - A RESOLUTION REGARD- 38 ING ELIMINATION, ADDITION OF CERTAIN POSITIONS OF THE FIRE 39 DEPARTMENT AND ESTABLISHING SALARIES THEREOF IN THE CITY OF 40 RICHMOND, INDIANA. • 41 42 Chief Mullin explained there are now 3 Lieutenants in each 43 firehouse which puts no one in charge. This will establish 44 a senior officer in each firehouse. 45 46 The Captain will receive $200.00 more in salary a year. 47 48 Councilman Elstro moved to table ,Resolution No. 12-1976 , and 49 refer to the Public Safety Committee, seconded by Councilman 50 Merchanthouse and on call of the roll the following was 51 recorded: Ayes: Elstro, Merchanthouse and Mills. Noes: 52 Ahaus, Austerman , Cornett, Paust and Williams. The vote being 53 three (3) to five (5) in favor of passage, the move to table 54 . was rejected. . 55 56 Councilman Faust moved. for -the adoption of Resolution No. 12- 57. 1976, seconded by Councilman Ahaus and on a call of the roll 58 the following-was recorded: Ayes: Ahaus , Austerman , Cornett, 59 Paust and Williams. Noes: Elstro, Merchanthouse and Mills. 60 The vote being five 05) to three 03) in favor of passage. 100 Common Council Minutes Cont'd March 15, 1976 Page 2 1 Mr. Don Meredith reported for the Board of Works the following: 2 3 In response to Councilman Williams , Mr. Meredith contacted Mr. 4 Robert Goodwin Director- of Department of-City Planningivas; to 5 they_parki:ng-at-Bert_Glazeres _=Mr: ,Goodwin ..contacted:Andrew 6 Cecer..e,. Attorney_for-Mr GlazerLandy was-assuredrthat he will 7 talk to his client and correct the conditions. The parking lot 8 will be paved and the trailers parked in a manner which will not 9 disturb or disrupt traffic through the adjoining alley. 10 - 11 In response to Councilman Elstro, Mr. -Meredith contacted the 12 State Board of Accounts and Mr. Bob Reinke , city attorney, about 13 the proper disposition of city owned cars. After reviewing the 14 answers which included that if its estimated value exceeds $500 15 you must advertise and sell by public auction , Mr. Meredith 16 announced that these cars will be sold at public auction 17 instead of private sale. 18 19 In response to Councilman Paust, Mr. Meredith contacted Charles 20 Roberts , Building Commissioner, in regard to the Old School 21 Administration Building. Mr. Roberts contacted Mr. Sherman 22 Fleming, owner of the property and he has been ordered to have 23 something constructive done to the property by dune 1st or it 24 will be demolished and the city will put a lien on the property. 25 26 Councilman Elstro recommended part of the proposed Bike Route 27 be through Sim Hodgin Parkway from the Boulevard to U.S. 27. 28 29 Councilman Elstro brought to the attention of the Board the 30 condition of South 12th Street from "J" to "L" , which has been 31 torn up due to the construction of the new Hibberd School . . He 32 recommended that Richmond Community Schools should be responsi- ble for putting the street back in proper condition. 34 35 Councilman Williams , Red Devil basketball fan , moved for the 36 record to show that Council go on record of supporting their 37 team in Indianapolis this week-end, seconded by Councilman 38 Mills and on unanimous voice vote the motion was carried. 39 - 40 Councilman Merchanthouse asked the Board of Works if there would 41 be an annual report. Mayor Dickman said that as soon as the 42 report is complete it will be given to Council . 43 44 Councilman Cornett moved to suspend the rules and read on first 45 reading by title only, Ordinance No. 3066-1976, seconded by 46 Councilman Elstro and on unanimous voice vote the motion was - 47 carried. 48 50 The Clerk read on first reading by title only Ordinance No. 51 3Q66-1976 T AN ORDINANCE TO APPROPRIATE FORTY-SIX THOUSAND, 52 THREE HUNDRED THIRTY-SEVEN DOLLARS AND THIRTY-THREE CENTS 53 - ($46,337.33) FROM THE FEDERAL REVENUE SHARING TRUST FUND, FOR 54 CERTAIN ORDINARY AND NECESSARY: MAINTENANCE AND OPERATING 55 EXPENDITURES AND FOR CERTAIN ORDINARY AND NECESSARY CAPITAL 56 EXPENDITURES ASAUTHORIZED BY THE STATE OF INDIANA AND-BY THE 57 ORDINANCES OF THE CITY OF RICHMOND, INDIANA. 58 59 President Mills. announced this ordinance will have to be ad- 60 vertised and will be turned over to the Community Service 61 Committee for study and recommendation. 101 Common Council Minutes Cont'd March 15, 1976 Page. 3 1 Councilman Elstro moved to suspend the rules and read on first 2 reading by title only Ordinance No. 3067-1976, seconded by 3 Councilman Williams and on unanimous voice vote the motion 4 was carried. 5 6 The Clerk read on first reading by title only Ordinance No. 7 3067-1976 - AN ORDINANCE TO ESTABLISH TWO (2) MORE FIRE 8 FIGHTERS AND TO TRANSFER FOURTEEN THOUSAND ONE HUNDRED AND 9 THIRTY-EIGHT DOLLARS AND FORTY-FOUR CENTS ($14,138.44) FROM 10 MAYOR'S OFFICE , SERVICES PERSONAL, SALARY ADMINISTRATIVE 11 ASSISTANT TO DEPARTMENT OF PUBLIC SAFETY-FIRE DEPARTMENT, 12 SERVICES PERSONAL, FIREFIGHTERS , TO ESTABLISH SALARIES FOR 13 THE REMAINING CALENDAR YEAR 1976 OF TWO (2) ADDITIONAL FIRE 14 FIGHTERS. 15 16 Councilman Mills announced this ordinance will have to be 17 advertised and will be turned over to the Public Works and 18 Sanitation Committee. 19 20 Councilman Ahaus moved to suspend the rules and read on 21 first reading by title only Ordinance No. 3068-1976, seconded 22 by Councilman Austerman and on unanimous voice vote the motion 23 was carried. 24 25 The Clerk read on first reading by title only Ordinance No. 26 3068-1976 - AN ORDINANCE TO APPROPRIATE FIVE THOUSAND THREE III 27 HUNDRED DOLLARS ($5,300.00.) FROM THE FEDERAL REVENUE SHARING 28. TRUST FUND, FOR CERTAIN ORDINARY AND NECESSARY MAINTENANCE 29 AND OPERATING EXPENDITURES AND FOR CERTAIN ORDINARY AND 30 NECESSARY CAPITAL EXPENDITURES AS AUTHORIZED BY THE LAWS OF - 31 THE STATE OF INDIANA AND BY THE ORDINANCES OF THE CITY OF 32 RICHMOND, INDIANA. 33 34 Councilman Mills announced this ordinance will have to be 35 , advertised. 36 . 37 The Clerk read on second reading Ordinance No. 3063-1976 - 38 AN ORDINANCE TO APPROPRIATE EIGHTEEN THOUSAND DOLLARS 39 ($18,000.00) FROM THE LOCAL ROAD AND STREET FUND FOR R & S 40 #14. 41 42 Councilman Elstro moved to accept and file proof of publica- 43 tion , seconded .by Councilman Williams and on unanimous voice 44- vote the motion was carried. 45 46 - City Engineer George Webb spoke for the Ordinance. 47 48 Councilman .Elstro moved for engrossment of Ordinance No. :3063- 49 1976, seconded by Councilman Paust and on unanimous voice 50 vote the motion was carried. - 51 52 Councilman Cornett moved to suspend the rules and read on• third 53 reading by title only Ordinance No. 3063-1976, seconded by 54 Councilman Elstro and on unanimous voice vote the motion was 55 carried. 56 57 The Clerk read on third reading by title only Ordinance No. 58 3063-1976 59 60 102 Common Council Minutes Cont'd March 15, 1976 Page 4 1 Ordinance 3063-1976 was placed on final passage or rejection 2 and on a call of the roll the following was recorded: Ayes: 3 Ahaus., Austerman , Cornett, Elstro ,, Merchanthouse , Mills, Paust 4 and Williams. The vote being eight (8) to zero 5 (0) in favor of passage of Ordinance No. 3063-1976. 6 7 The Clerk read on second reading Ordinance No. 3064-1976 - AN .8 - ORDINANCE TO APPROPRIATE TWO THOUSAND DOLLARS ($2,000.00) FROM 9 CUMULATIVE CAPITAL IMPROVEMENT FUND (CIGARETTE TAX FUND) . 10 11 Councilman Cornett .moved to accept and file proof of publica- 12 tion , seconded by Councilman Paust and on unanimous voice vote 13 the motion was carried. 14 .15 . Councilman Elstro moved for engrossment of Ordinance No. 3064- 16 1976, seconded by Councilman Ahaus and on unanimous voice vote 17 the motion was carried. 18 19 Councilman Elstro moved to suspend the rules and read on third 20 reading by title only Ordinance No. 3064-1976 , seconded by 21 Councilman Williams and on unanimous voice vote the motion was 22 - carried. 23 24 The Clerk read on third reading, by title only Ordinance No. 25 3064 r1976: 26 27 Ordinance No. 3064-1976 was placed on final passage or rejec- 111 28 tion and on a call of the roll the. following was recorded: Ayes: 29 Ahaus, Austerman , Cornett, Elstro, .Merchanthouse, Mills, Paust 30 and Williams. Noes: None. The vote being eight (8) to zero (0) 31 in favor of passage of Ordinance No. 3064-1976. 32 33 The. Clerk read on second reading Ordinance No. 3065-1976 - AN 34 ORDINANCE TO APPROPRIATE THE SUM OF FOUR THOUSAND DOLLARS 35 ($4,000.00) FROM THE GENERAL FUND CASH OPERATING TO THE DEPART- 36 MENT OF PUBLIC SAFETY-, POLICE' DIVISION, OTHER GARAGE AND MOTOR 37 SUPPLIES. 38 39 Councilman Cornett moved to accept and file proof of publication , 40 seconded by Councilman Paust and on unanimous voice vote the 41 motion was carried. 42 43 Councilman Faust moved to engrossment of Ordinance No. 3065-1976, 44 seconded by Councilman Williams and on unanimous voice vote the. 45 motion was carried. 46 47 Councilman Williams moved to suspend the rules and read on third 48 reading by title only Ordinance No. 3065-1976 , seconded by 49 Councilman Williams and on unanimous voice vote the motion was 50 carried. 51 52 The Clerk read on third reading, by title only Ordinance No. 53 30651976. .: 54 55 Ordinance No. 3065-1976 was placed on final passage or rejection 56 and on a call of the roll , the following was recorded: Ayes: 57 Ahaus , Austerman , Cornett, Elstro, Merchanthouse , Mills , Paust 58 and Williams. Noes: None.
