HomeMy Public PortalAbout02-16-1976 9-1 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, FEBRUARY 16 , 1976 1 The Common Council of the City of Richmond, Indiana , met in 2 regular session February- 16, 1976 at the hour of 7:30 p.m. in 111 3 the Council Chambers in the Municipal Building in said City. 4 President Mills presided with the following members present: 5 Messrs. Ahaus, Austerman ,. Carter, Cornett, Elstro, Merchanthouse , 6 Paust and Williams. The following business was had, to-wit: 7 - 8 Councilman Carter gave devotion$. 9 10 Councilman Elstro asked to be excused from the previous meet- 11 ing due to being in the hospital . 12 13 Councilman Williams moved to approve the minutes of the prey- 14 ious meeting, seconded by Councilman Paust and on unanimous 15 voice vote the motion was carried. 16 17 The Clerk read, by title only, Resolution No. 9-1976 - A 18 RESOLUTION REGARDING TRANSFER OF MONEY IN COMMUNITY DEVELOPMENT 19 BUDGET FOR PERSONAL SERVICES. 20 21 Councilman Cornett moved that this resolution be removed from 22 the table and put back on the agenda, seconded by Mr. Elstro and 23 on unanimous voice vote the motion was carried. 24 25 Councilman .Cornett moved totstriWReseluti-on}No::n9•-1=976 , 26 seconded by-Coun'eilmanbearterrandThn unanimous voi ce:voteun 27 thetmotion.:was:;carri;ed:-v c. . i^ 7�`:. :�r I28 - - - 29 Councilman Austerman moved to suspend the rules and read 30 Resolution No. 10-1976 by title only, seconded by Councilman 31 Elstro and on unanimous voice vote the motion was carried. 32 33 The Clerk read, by title only, Resolution No. 10-1976 - A 34 I RESOLUTION REGARDING TRANSFER OF MONEY IN COMMUNITY DEVELOPMENT 35 BUDGET FOR PERSONAL SERVICES. 36 37 Councilman Carter moved to table Resolution No. 10-1976 until 38 Ordinance No. 3060-1976 is approved or disapproved, seconded 39 by Councilman Williams and onrunanimous voice vote the motion 40 was carried. 41 .. 42 Councilman Williams reported a situation to the Board of Works 43 concerning Glazer's and Mosey's.,buying, parcels of land in 44 North Richmond around North 8th, Street. He stated they are 45 blocking off people in their homes: in order to make appraisal 46 prices go down so they can purchase additional property at a 47 low price. He stated these companies are parking trailers and 48 cars and these areas have not been zoned for this use. He 49 feels the zoning ordinances should be enforced. Mr. Reinke 50 stated he will report this to the Plan Commission and report 51 back to Council. 52 11/ 53 . Councilman Cornett asked if other firms were involved before the 54 - IBoard of Works ;entered into an agreement with Butler, Fiarman 55 & Seufert, Inc. , and what the cost of the project will be. Mr. 56 Reinke stated that one other firm had indicated an interest; 57 however, BF&S was selected because they are experts in this area 58 and will be dealing with both the City and County. The cost 59 will be an hourly rate. The intention is to ask for $20,000.00. 92 Common Council Minutes Cont'd February 16, 1976 Page 2 1 Councilman Ahaus reported to the Board that the Parking Lot gates 2 - had closed on two cars. The Board will make a report to Mr. Ahaus. 3 4 Councilman Merchanthouse reported that he received a telephone call 5 saying a street had not been swept since October. Mr. Jerry 6 Haynes , Director of Transportation , said that it had been 7 announced through the news media from the previous administration 8 that there would be no sweeping schedule from November until 9 February 28; therefore , the sweeping program will go back on 1.0 regular posted schedule as of March 1st. 11 . 12 . Councilman Cornett stated that he is proud to represent Council 13 on Reid Hospital Board and is overwhelmed with the professional 14 and various people involved with this Board. 15 16 Councilman Elstro moved to suspend the rules and read by title 17 only Ordinance No. 3061-1976, seconded by Mr. Merchanthouse and 18 on unanimous voice vote the motion was carried. 19 20 The Clerk read on first reading, by title only, Ordinance No. 21 3061-1976 - AN ORDINANCE AMENDING ORDINANCE 2325-1968, COMMONLY 22 KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, 23 ADOPTED JUNE 3, 1968. 24 - 25 President Mills announced that this ordinance will go to the 26 Plan Commission for study and recommendation. 27 28 The clerk read on second reading Ordinance No. 3058-1976 - AN 29 ORDINANCE AMENDING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS 30 THE ZONING,ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED 31 JUNE 3, 1968. 32 33 The Clerk read a letter from the Departrient of City Planning 34 stating their vote of 7 to 0 approving this rezoning. 35 36 Speaking for this ordinance was Mr. Kent Klinge, representing 37 Mr. Fred Adelsperger, hopeful purchaser of this property. He stated 38 there will be no body work or' maintenance on outside of auto- 39 mobiles. The sole purpose of this garage will be to work in 40 interior of building of interior of automobiles. 41 42 Councilman Paust moved fo.r engrossment of Ordinance No. 3058- 43 1976 , seconded by Councilman Cornett and on unanimous voice vote 44 the motion was carried. 45 46 Councilman Williams moved to suspend the rules and read on third 47 reading by title only Ordinance No. 3058-1976 , seconded by 48 Councilman Paust and on unanimous voice vote the motion was 49 carried. 50 - 51 The Clerk read on third reading, by title only, Ordinance No. 52 3058-1976. 53 54 Ordinance No. 3058-1976 was placed on final passage or rejection and 55 on a call of the roll the following was recorded: Ayes: Ahaus , 56 Austerman , Carter, Cornett, Elstro, Merchanthouse , Paust, 57 Williams and Mills. Noes: None. The vote being nine (9) to zero 58 (0) in favor of passage. 9� Common Council Minutes Cont'd February 16, 1976 Page3 1 The Clerk read on second reading Ordinance No. 3059-1976 - AN 2 ORDINANCE TO APPROPRIATE SIXTY THOUSAND DOLLARS ($60 ,000.00) 3 FROM THE FEDERAL REVENUE SHARING TRUST FUND, FOR CERTAIN 4 ORDINARY AND NECESSARY MAINTENANCE AND OPERATING EXPENDITURES 5 AND FOR CERTAIN ORDINARY AND NECESSARY CAPITAL EXPENDITURES 6 AS AUTHORIZED BY THE LAWS OF THE STATE OF INDIANA AND BY THE 7 ORDINANCES OF THE CITY OF RICHMOND, INDIANA. 8 9 Councilman Carter, Chairman of Transportation Committee of 10 Common Council , read the report of his Committee which met on 11 February 4, 1976. 12 13 Councilman Cornett moved to accept and file proof of publication 14 for Ordinance No. 3059-1976, seconded by Councilman Elstro and 15 on unanimous voice vote the motion was carried. 16 17 Rev. Robert Girten , Mt. Moriah Church and' Rev. Barber, 2nd 18 Baptist Church, spoke for the ordianance. 19 20 Councilman Carter_moved to amend Ordinance Uo , 3059-1976 `to ,read 21 $30,000 .in- lieu .of; $60,000, seconded by,:Councilman -Austerman_ and 22 on"a call -of,th&,rol-1_the;.fol lowing-:was=recorded: , {yes ..,AhLaus , 23 Austerman; CarterrCor--nett;_Merchanthouse,r‘Taust°and -Mi llS. Noes: 24 Elstro and Williams. . The vote-being .seven_ (7_) to two._(2):-in 25 favor.1of passage. 26 27 Councilman Merchanthouse moved for engrossment of Ordinance No. 28 3059-1976, seconded by Councilman Paust and on unanimous voice 29 the motion was carried. 30 31 Councilman Merchanthouse moved to suspend the rules and place 32. Ordinance No. 3059-1976 on third reading by title only, seconded 33 by Councilman Paust. Councilman Cornett voted no. 34 35 The Clerk read on second reading Ordinance No. 3060-1976 - AN 36 ORDINANCE AMENDING ORDINANCE NO. 3003-1975, AND CREATING THE 37 POSITION OF DEPUTY DIRECTOR FOR THE DEPARTMENT OF COMMUNITY 38 DEVELOPMENT AND FIXING THE SALARY THEREOF. 39 40 Councilman Cornett moved to amend Ordinance No. 3060-1976 to 41 $13 ,595 from $15,000, seconded by Councilman Austerman and on 42 a call of the roll the following was recorded: Ayes : Ahaus , Auster- 43 man , Cornett, Elstro, Merchanthouse , Paust, Williams and Mills. 44 Noes: Carter. The vote being eight (8) to one (1 ) . 45 46 Councilman Cornett moved for engrossment of Ordinance No. 3060- 47 1976, seconded by Councilman Paust with the vote being eight (8) 48 to one (1 ) in favor of passage. Councilman Carter voted no. 49 50 Councilman.,Cornett moved to suspend the rules and move to 51 third reading, by title only Ordinance No. 3060-1976, seconded 52 by Councilman Paust.
