PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, FEBRUARY 2, 1976
1 The Common Council of the City of Richmond, Indiana, met in
2 regular session February 2, 1976 at the hour of 7:30 p.m. in the Council
3 . Chambers in the Municipal Building in said City. President
4 Mills presided with the following members present: Messrs. Ahaus,
5 Austerman , Carter, Cornett, Merchanthouse, Paust, and W111tams,
6 Absent: Mr. Elstro. The following business =was had, to-wit:

8 Councilman Austerman gave devotions.

10 Councilman Williams moved to approve the minutes of the previous
11 meeting, seconded by Councilman Cornett and on unanimous voice vote
12 the motion was carried.

14 Councilman Cornett moved to suspend the rules and read Resolution
15 No. 5-1976 by title only, seconded by Councilman Austerman and on
16 unanimous voice vote the motion was carried.

18 The Clerk read by ti-tle only Resolution No. 5-1976 - A RESOLUTION
19 REGARDING CONVEYANCE OF FIREHOUSE NO. 3 IN THE CITY OF RICHMOND,
20 INDIANA.

22 Councilman Cornett moved to adopt Resolution No. 5-1976 , seconded
23 by Councilman Williams and on unanimous voice vote the motion was
24 carried.

26 The Clerk read Resolution No. 6-1976 - A RESOLUTION TO AUTHORIZE
27 THE FILING OF AN APPLICATION WITH THE UNITED STATES DEPARTMENT OF
28 HOUSING AND URBAN DEVELOPMENT, FOR EXISTING HOUSING ASSISTANCE
29 PAYMENTS FOR ELDERLY CITIZENS, AS PROVIDED IN SECTION 8 OF THE
30 HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974.

32 Councilman Ahaus asked for an explanation of this resolution. Mr.
33 Fienning came forward for the explanation.

35 Councilman Williams moved to adopt Resolution No. 6-1976 , seconded
36 by Councilman Cornett and on unanimous voice vote the motion was
37 carried.

39 Councilman Cornett moved to suspend the rules and read Resolution
40 No. 7-1976 by title only, seconded by Councilman Merchanthouse and
41 on unanimous voice vote the motion was carried.

43 The Clerk read, by title only, Resolution No. 7-1976 - RESOLUTION
44 AUTHORIZING THE FILING OF AN APPLICATION WITH THE DEPARTMENT OF
45 HOUSING AND URBAN DEVELOPMENT, FOR COMMUNITY DEVELOPMENT BLOCK
46 GRANT FUNDS , AS PROVIDED IN TITLE I OF THE COMMUNITY DEVELOPMENT
47 ACT 1974, P. L. 93-383.

49 Councilman Williams moved to adopt Resolution No. 7-1976 , seconded
50 by Councilman Paust and on unanimous voice vote the motion was carried.

52 Councilman Cornett moved to suspend the rules and read Resolution No.
53 8-1976 by title only, seconded by Councilman Williams and on
54 unanimous voice vote the motion was carried.

56 The Clerk read by title only Resolution No. 8-1976 - A RESOLUTION
57 REGARDING CONVEYANCE OF REAL ESTATE IN THE CITY OF RICHMOND, INDIANA.

59 Mr. Reinke stated that this Resolution was brought to Common Council
60 by the Board of Works. The Board of Works now asks Council to
61 defer action for a conference with Redevelopment. They erroneously
62 assumed everyone knew of the transaction. The purchaser concurs
63 with this request.

1 Councilman Paust moved to table this resolution , seconded by

5 Councilman Cornett moved to suspend the rules and read
6 Resolution No. 9-1976 by title only, seconded by Councilman
7 Williams and on unanimous voice vote the motion was carried.

10 RESOLUTION REGARDING TRANSFER OF MONEY IN COMMUNITY DEVELOPMENT
11 BUDGET FOR PERSONAL SERVICES.

13 Councilman Carter moved to table Resolution No. 9-1976 in view
14 of an up-coming ordinance on the agenda, seconded by Councilman
15 Austerman and on unanimous voice vote the motion was carried.

17 Councilman Carter brought a matter to the attention of the
18 Board of Works as to flooding of basements in the area known
19 as Peacock Terrace. He feels it is responsibility of the city
20 to solve this problem. He would like the Board of Works to
21 compile a solution and cost estimates. Councilman Merchanthouse
22 I stated that the problem has existed for years and extends on
23 east beyond Long's Supermarket. Regular cleaning of sewer seems
24 to help. A possible suggested solution would be to re-route
25 John Manville 's water drainage line. Councilman Williams
26 stated that where there is a problem it should be solved.

28 President Mills read the following correspondence:

30 On January 20, 1976 in the Richmond Police Department
31 Classroom, this Department invited the county law
32 enforcement people to attend in the Squad Room, a session
33 to trade ideas and methods on police work. This was the
34 first time for this session and in the end we hope to
. 35 . show a great improvement in relationship between the
36 county and the city. This first session had 36 men in
37 ,7.'_.52Attendance.

45 I The Richmond League of Women Voters would like togive
46 each of you one of our "Reduce" booklets. We hope that
47 this discussion of solid waste production resource recovery
48 and methods to reduce the amount of solid waste generated
49 will be helpful to you in making the decisions relating
50 to solid waste problems that will be forthcoming.

52 We are grateful to the citizens of Richmond and Wayne
53 County who support the League of Women Voters financially
54 and thereby make it possible to give pertinent educational
55 information to community officials and citizens.

57 Councilman Cornett moved to suspend the rules and read Ordi-
58 nance No. 3057-1976 on first reading by title only, seconded
59 by Councilman Williams and on unanimous voice vote the motion
60 was carried.

64 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND,

2 Plan Commission for study and recommendation.

4 Councilman Cornett moved to suspend the rules and read Ordinance
5 No. 3059-1976 on first reading by title only, seconded by
6 Councilman Williams and on unanimous voice vote the motion was
7 carried.

9 The Clerk read on first reading by title only Ordinance No.
10 3059-1976 - AN ORDINANCE TO APPROPRIATE SIXTY THOUSAND DOLLARS
11 ($60,000.00) FROM THE FEDERAL REVENUE SHARING TRUST FUND, FOR
12 CERTAIN ORDINARY AND NECESSARY MAINTENANCE AND OPERATING EX-
13 PENDITURES AND FOR CERTAIN ORDINARY AND NECESSARY CAPITAL EX-
14 PENDITURES AS AUTHORIZED BY THE LAWS OF THE STATE OF INDIANA
15 AND BY THE ORDINANCES OF THE CITY OF RICHMOND, INDIANA.

17 President Mills announced that this ordinance has to be
18 advertised.

20 Councilman Austerman moved that the Transportation Committee
21 of Council get with the City Controller and Transportation
22 Director on this matter and report back to Council , seconded
23 by Councilman Carter and on unanimous voice vote the motion
24 was carried.

26 Councilman Austerman moved to suspend the rules and read Ordinance
27 No. 3060-1976 on first reading by title only, seconded by
28 Councilman Carter and on unanimous voice vote the motion was
29 carried.

31 The Clerk read on first reading by title only Ordinance No.
32 3060-1976 - AN ORDINANCE AMENDING ORDINANCE NO. 3003-1975, AND
33 CREATING THE POSITION OF DEPUTY DIRECTOR FOR THE DEPARTMENT OF
34 COMMUNITY DEVELOPMENT AND FIXING THE SALARY THEREOF.

36 Councilman Cornett moved to suspend the rules and read Ordinance
37 No. 3056-1976 on third reading by title only, seconded by
38 Councilman Carter and on unanimous voice vote the motion was
39 carried.

41 The Clerk read on third reading by title only Ordinance No.

44 A letter was read from Mr. Charles F. Bradley, 105 N.W. 18th
45 Street, against this ordinance.

47 Ordinance No. 3056-1976 was placed on final passage or rejec-
48 tion and on a call of the roll the following was recorded:
49 Ayes: Ahaus , `Austerman , Carter, Cornett, Paust. goes: Mer-
50 chanthouse, Williams , Mills. Absent: Elstro. The vote being
51 five (5) to three (3) in favor of passage.
