PROCEEDINGS OF THE COMMON COUNCIL OF THE
CITY OF RICHMOND, INDIANA, JULY 7, 1975
1 The Common Council of the City of Richmond, Indiana, met in regular
2 session July 7, 1975 at the hour of 7:30 P.M. in the Council Chambers
3 inlhe Municipal Building in said City. Mr. Merchanthouse presided
4 with the following members present: Messrs. Cornett, Elstro, Hilton,
5 Marino, Mills, and Williams. Absent: Messrs. Brown and Geier. The
6 following business was had to-wit:

8 Mr. Williams moved to approve the minutes of the previous meeting,
9 seconded by Mr. Hilton and on unanimous voice vote the motion was carried.

11 The Clerk read Resolution No. 10-1975 - A RESOLUTION TO TRANSFER WITHIN
12 THE CITY ENGINEERS BUDGET THE SUM OF ONE HUNDRED DOLLARS ($100.00) FROM
13 "SERVICES CONTRACTUAL" (2-21-213) TRAVEL EXPENSE TO "SERVICES CONTRACTUAL"
14 (2-21-214) TELEPHONE AND TELEGRAPH.

16 Councilman Mills moved for adoption of Resolution No. 10-1975, seconded
17 by Councilman Hilton and on unanimous voice vote the motion was carried.

19 The Clerk read Resolution No. 11-1975 - A RESOLUTION TO TRANSFER WITHIN
20 THE POLICE DEPARTMENT BUDGET THE SUM OF THREE THOUSAND, FIVE HUNDRED
21 DOLLARS ($3,500.00) FROM "SUPPLIES" (3-32-321 ) GASOLINE TO "SUPPLIES"
22 (3-32-324) OTHER GARAGE & MOTOR SUPPLIES.

24 Councilman Marino move for adoption of Resolution No. 11-1975, seconded
25 by Councilman Hilton and on unanimous voice vote the motion was carried.

27 The Clerk read Resolution No. 12-1975 - A. RESOLUTION APPROVING A SHORT-
28 RANGE BUS TRANSPORTATION TECHNICAL STUDY FOR THE CITY OF RICHMOND, INDIANA.

30 Resolution No. 12-1975 was tabled.

32 Councilman Merchanthouse, President, set an executive meeting for
33 Monday, July 14, 1975 at 7:00 P.M. to discuss Resolution No. 12-1975
34 and Ordinance No. 3003-1975.

36 Councilman Elstro moved for suspension of the rules and read Ordinance
37 No. 3003-1975 on first reading by title only, seconded by Councilman
38 Williams and on unanimous voice vote the motion was carried.

40 The Clerk read on first reading by title only Ordinance No. 3003-1975 -
41 AN ORDINANCE FIXING SALARIES FOR APPOINTED OFFICERS AND EMPLOYEES OF THE
42 CITY OF RICHMOND, INDIANA FOR THE FISCAL YEAR BEGINNING JANUARY 1 , 1976
43 AND APPROVING THE ADDITIONAL COMPENSATION TO CERTAIN APPOINTED OFFICIALS
44 OF THE CITY, OTHER THAN GOVERNMENTAL, WHO PERFORM SERVICES FOR THE CITY,
45 WHICH SERVICES ARE. CONNECTED WITH THE OPERATION OF MUNICIPALLY-OWNED
46 UTILITY OR FUNCTIONS.

48 The Clerk read on first reading Ordinance No. 3004-1975 - AN ORDINANCE
49 TO TRANSFER WITHIN THE BOARD OF PUBLIC WORKS & SAFETY BUDGET THE SUM
50 OF SIX HUNDRED, TWENTY SEVEN DOLLARS AND EIGHTEEN CENTS ($627.18) FROM
51 "CURRENT OBLIGATIONS" (6-61 ) INTEREST/BARRETT LAW TO "SERVICES CONTRACTUAL"
52 (2-26-261 ) TREE & STUMP REMOVAL ($552.18) , TO "MATERIALS" (4-43) REPAIR
53 PARTS ($50.00) AND TO "CURRENT CHARGES" (5-57) RECORDING FEES ($25.00) .

55 Councilman Elstro moved for suspnesion of the rules and place Ordinance
56 No. 3004-1975 on second reading, seconded by Councilman Williams and on
57 unanimous voice vote the motion was carried.

1 Councilman Hilton moved for engrossment of Ordinance No. 3004-1975, seconded
2 by Councilman Williams and on unanimous voice vote the motion was carried.

4 Councilman Williams moved for suspension of the rules and place Ordinance
5 No. 3004-1975 on third reading by title only, seconded by Councilman
6 Hilton and on unanimous voice vote the motion was carried.

8 The Clerk read on third reading by title only Ordinance No. 3004-1975.

10 Ordinance No. 3004-1975 was placed on final passage or rejection and
11 on a call of the roll the following was recorded: Ayes; Cornett, Elstro,
12 Hilton, Marino, Mills, Williams and Merchanthouse. Noes; None. The
13 vote being seven (7) to zero (0) in favor of passage of Ordinance No.
14 3004-1975.

16 Councilman Hilton moved to amend Ordinance No. 2997-1975 as presented
17 with a change on page three (2) d. to read: If Wernle Children§ Home,
18 Inc. or its successors in title, fails to comply with any of the condi-
19 tions set forth in this section, or with any requirement provided for
20 by Article 45 of Ordinance 2325-1968, or with any requirements provided
21 for by the Plan Commission as condition of approval of any allocation
22 plan for any phase, this Ordinance shall be void, seconded by Councilman
23 Mills and on unanimous voice vote the motion was carried.

25 The Clerk read on second reading Ordinance No. 2997-1975 as amended -
26 AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE
27 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968,
28 AND BEING AN ORDINANCE REZONING A PART OF THE NORTHEAST QUARTER OF
29 SECTION NINE (9) , TOWNSHIP THIRTEEN (13) NORTH, RANGE ONE WEST FROM R-2
30 (SINGLE FAMILY RESIDENTIAL) TO R-3 (ONE TO EIGHT FAMILY RESIDENTIAL)
31 CLASSIFICATION PROVIDING FOR A RESIDENTIAL DEVELOPMENT UNIT PROJECT
32 PURSUANT TO ARTICLE 45 OF ORDINANCE 2325-1968, AND PROVIDING FOR A SPECIAL
33 USE PURSUANT TO ARTICLE 48 OF ORDINANCE 2325-1968 COMMONLY CALLED THE
34 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, APPROVED JUNE 3, 1968.

36 The Clerk read a letter from the Plan Commission stating they voted
37 six (6) to zero (0) to recommend approval of the amended ordinance with
38 the following conditions:

40 a. The first five (5) units to be constructed by Wernle Children's
41 Home, Inc. , as shown on the allocation plan, may be built with
42 a septic system approved by the City Engineer, the Board of
43 Commissioners of Wayne Sanitary District, and by the Wayne County
44 Health Department;

46 b. A temporary access drive may be installed in the area shown on
47 the allocation plan for Phase I , provided that the temporary
48 access drive shall have a dust-free surface;
49
50 c. The septic system provided for the first five (5) units shall
51 be removed and all units connected to approved sanitary sewers
52 . prior to the issuance of improvement location permits for any
53 additional structures in Phase I ;

55 d. The temporary access drive shall be removed, and all units con-
56 nected to the access drive system shown on the allocation plan
57 prior to the occupancy of the next 15 units prescribed by the
58 allocation plan.

3 Councilman Cornett moved for engrossment of Ordinance No. 2997-1975,
4 seconded by Councilman Elstro and on unanimous voice vote the motion
5 was carried.

7 Councilman Elstro moved for suspension of the rules and place Ordinance
8 No. 2997-1975 on third reading by title only, seconded by Councilman
9 Hilton and on unanimous voice vote the motion was carried.

13 Ordinance No. 2997-1975 was placed on final passage or rejection
14 and on a call of the roll the following was recorded: Ayes; Cornett,
15 Elstro, Hilton, Marino, Mills, Williams and Merchanthouse. Noes;

18 The Clerk read on second reading Ordinance No. 3001-1975 - AN ORDINANCE
19 AMENDING ORDINANCE_ NUMBER 2518-1971 , AN ORDINANCE AUTHORIZING A DEVELOP-
20 MENT UNIT PROJECT, IN ACCORDANCE WITH ARTICLE 45 OF ORDINANCE NUMBER
21 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF
22 RICHMOND, INDIANA.

24 The Clerk read a letter from the Plan Commission stating they voted
25 six (6) to zero (0) to recommend approval of Ordinance No. 3001-1975
26 with the following conditions:

11/ 28 1 . Prior to occupancy of the building on Tract #1 , the access
29 drive from University Blvd. to the supermarket parking lot
30 must be constructed in accordance with provision for access
31 drives in Article 45 of Ordinance #2325-1968, commonly known
32 as the Zoning Ordinance of Richmond, Indiana.

34 2. The radii at the intersection of access drive and University
35 Blvd. shall be the same as the radii of the access drive
36 immediately south of University Blvd.

38 - 3. Tract #1 is defined as the area west of the Eastern edge of
39 the access drive to U.S. #27 and is 79.45 feet wide.
40 Tract #2 is the area east of the eastern edge of the access
41 drive.

43 4. No development shall take place on Tract #2 until specific
44 plans are presented to the Plan Commission for approval .

46 Councilman Elstro moved for engrossment of Ordinance No. 3001-1975,
47 seconded by Councilman Mills and on unanimous voice vote the motion
48 was carried.

50 Councilman Cornett moved for suspension of the rules and place
51 Ordinance No. 3001-1975 on third reading by title only, seconded by
52 Councilman Elstro and on unanimous voice vote the motion was carried.

54 The Clerk read on third reading by title only Ordinance No. 3001-1975.

56 Ordinance No. 3001-1975 was placed on final passage or rejection and
57 on a call of the roll the following was recorded: Ayes; Cornett,
58 Elstro, Hilton, Marino, Mills, Williams and Merchanthouse. Noes; None.
59 The vote being seven (7) to zero (0) in favor of passage.

61 There being no further business on motion duly made, seconded and
62 passed, the meeting was adjourned.
