HomeMy Public PortalAbout05-02-1975 • PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, JUNE 2, 1975 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session June 2, 1975 at the hour of 7:30 p.m. in the Council Chambers 3 in the Municipal Building in said City. President Merchanthouse 4 presided with the following members present: Messrs. Brown, Cornett, 5 Elstro, Geier, Hilton, Marino, Mills and Williams. Absent: None. 6 The following business was had to-wit: 7 8 Councilman Mills moved to amend the minutes of the last meeting to 9 read after line 64 as follows: Robert Burton, City Attorney, examined 10 proof of publication and found it to be in order for Ordinance No. 11 3000-1975. Councilman Mills moved to accept and file proof of 12 publication, seconded by Councilman Marino and on unanimous voice 13 vote the motion was carried. 14 15 Councilman Marino moved to second the motion to amend the minutes and 16 on unanimous voice vote the motion was carried. 17 18 Councilman Mills moved to approve the minutes of the last meeting, as 19 amended, seconded by Councilman Marino and on unanimous voice vote 20 the motion was carried. 21 22 The Clerk read Resolution No. 8-1975 - A RESOLUTION AUTHORIZING THE 23 APPOINTMENT OF A BICENTENNIAL COMMISSION AND THE HANDLING OF FUNDS. 24 25 Councilman Elstro moved to adopt Resolution No. 8-1975, seconded by 26 Councilman Geier and on unanimous voice vote the motion was carried. 27 28 Councilman Geier moved to suspend the rules and read Ordinance No. 29 3001-1975 on first reading by title only, seconded by Councilman Elstro 30 and on unanimous voice vote the motion was carried. 31 32 The Clerk read on first reading by title only Ordinance No. 3001-1975 - 33 . AN ORDINANCE AMENDING ORDINANCE NO. 2518-1971 , AN ORDINANCE AUTHORIZING 34 A DEVELOPMENT UNIT PROJECT, IN ACCORDANCE WITH ARTICLE 45 OF ORDINANCE 35 NUMBER 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY 36 .OF RICHMOND, INDIANA. 37 38 Ordinance No. 3001-1975 was referred to the Plan Commission for study 39 and recommendation. 40 41 The Clerk read on second reading Ordinance No. 2992-1975 - AN ORDINANCE 42 AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE 43 OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 44 45 The Clerk read a letter from the Department of City Planning stating 46 the Plan Commission voted 6 to 0 in favor of recommending approval 47 of the rezoning. 48 49 Raymond Knoll , Attorney, representing Mr, McKinney spoke for the 50 Ordinance. 51 52 Councilman Hilton moved for engrossment of Ordinance No. 2992-1975, 53 seconded by Councilman Williams and on unanimous voice vote the motion 54 was carried. 55 56 Councilman Geier moved for suspension of the rules and place Ordinance 57 No. 2992-1975 on third reading by title only, seconded by Councilman 58 Williams and on unanimous voice vote the motion was carried. 59 60 The Clerk read on third reading by title only Ordinance No. 2992-1975. 61 e 2 Common Council Minutes June 2, 1975 Page 2 1 Ordinance No. 2992-1975 was placed on final passage or rejection and 2 on a call of the roll the following was recorded: Ayes; Brown, 3 Cornett, Elstro, Geier, Hilton, Marino, Williams and Merchanthouse. 4 Noes; Mills. The vote being eight (8) to one (1 ) in favor of passage 5 of Ordinance No. 2992-1975. 6 7 The Clerk read on second reading Ordinance No. 3000-1975 - AN ORDINANCE 8 TO APPROPRIATE THIRTY FIVE THOUSAND DOLLARS ($35,000.00) FROM THE 9 FEDERAL REVENUE SHARING TRUST FUND FOR CERTAIN ORDINARY AND NECESSARY 10 MAINTENANCE AND OPERATING EXPENDITURES AND FOR CERTAIN ORDINARY AND 11 NECESSARY CAPITAL EXPENDITURES AS AUTHORIZED BY THE LAWS OF THE STATE 12 OF INDIANA AND BY THE ORDINANCES OF THE CITY OF RICHMOND, INDIANA. 13 14 Richard Terwilliger, Architect, appeared for the Ordinance. 15 16 Charles Howell , Mayor, said, "I think this project is one many people 17 have wanted for many years; however, I would hate to see the money 18 appropriated and then the project stand there." He said he would 19 like to see Council amend the Ordinance to assure that the Park Board 20 would complete the project or otherwise the money should be used for 21 something else. 22 23 Councilman Marino moved to amend Ordinance No. 3000-1975 to read the 24 contract for the construction of the Performing Arts Center be awarded 25 within seventy-five (75) days from passage of this Ordinance or the money 26 would be returned to the Revenue Sharing Trust Fund to be used for another 27 purpose, seconded by Councilman Hilton and on a call of the roll the 28 following was recorded: Ayes; Brown, Cornett, Elstro, Geier, Hilton, 29 Marino, Mills and Williams. Noes; Merchanthouse. The vote being eight 30 (8) to one (1 ) in favor of the amendment. 31 32 Councilman Marino moved for engrossment of Ordinance No. 3000-1975, 33 seconded by Councilman Mills and on unanimous voice vote the motion was 34 carried. 35 36 Councilman Marino moved for suspension of the rules and place Ordinance 37 No. 3000-1975 on third reading by title only, seconded by Councilman 38 Mills and on unanimous voice vote the motion was carried. 39 40 The Clerk read on third reading by title only Ordinance No. 3000-1975. 41 42 Ordinance No. 3000-1975 was placed on final passage or rejection and 43 on a call of the roll the following was recorded: Ayes; Brown, Elstro, 44 Geier, Hilton, Marino, Mills, Williams and Merchanthouse.
