HomeMy Public PortalAbout05-05-1975 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MAY 5, 1975 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session May 5, 1975 at the hour of 7:30 p.m. in the Council Chambers 3 in the Municipal Building of said City. President Merchanthouse 4 presided with the following members present: Messrs. Brown, Cornett, 5 Elstro, Geier, Hilton, Marino, Mills and Williams. Absent: None. 6 The following business was had to-wit: 7 - 8 Councilman Williams moved to approve the minutes of the previous 9 meeting, seconded by Councilman Mills and on unanimous voice vote 10 the motion was carried. 11 12 The Clerk read Resolution No. 7-1975 - A RESOLUTION TO TRANSFER WITH- 13 IN THE CITY CLERK' S BUDGET THE SUM OF TWO HUNDRED DOLLARS ($200.00) 14 FROM "SERVICES CONTRACTUAL" (2-21-212) POSTAGE TO "SERVICES CONTRAC- 15 TUAL" (2-21-213) TRAVELING EXPENSES. 16 17 Councilman Geier moved for adoption of Resolution No. 7-1975, seconded 18 by Councilman Mills and on unanimous voice vote the motion was carried. 19 20 Councilman Elstro moved for suspension of the rules and read Ordinance 21 No. 2997-1975 by title only on first reading, seconded by Councilman 22 Williams and on unanimous voice vote the motion was carried. 23 24 The Clerk read by title only on first reading Ordinance No. 2997-1975- 25 AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE 26 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 27 1968. 28 29 Ordinance No. 2997-1975 was referred to Plan Commission for study 30 and recommendation. 31 32 The Clerk read on first reading Ordinance No. 2998-1975 - AN ORDINANCE 33 APPROPRIATING THE SUM OF EIGHT THOUSAND DOLLARS ($8,000.00) FROM THE 34 MOTOR VEHICLE HIGHWAY CASH OPERATING FUND TO MOTOR VEHICLE HIGHWAY 35 "SUPPLIES" (3-32-322) OIL $1 ,000.00 AND TO PROPERTIES (7-72-726) 36 OTHER EQUIPMENT $7,000.00. 37 38 Councilman Geier moved for suspension of the rules and read by title 39 only on first reading Ordinance No. 2999-1975, seconded by Councilman 40 Elstro and on unanimous voice vote the motion was carried. 41 42 The Clerk read by title only on first reading Ordinance No. 2999-1975 - 43 AN ORDINANCE OF THE CITY OF RICHMOND AUTHORIZING THE ACQUISITION 44 AND FINANCING OF INDUSTRIAL FACILITIES, THE ISSUANCE AND SALE OF 45 REVENUE BONDS TO PAY THE COST THEREOF, AND THE LEASING OF SUCH FACILITIES 46 TO HOFFCO, INC. , AND OTHER MATTERS RELATING THERETO. 47 48 Councilman Elstro moved for suspension of the rules and read on second 49 reading Ordinance No. 2999-1975, seconded by Councilman Williams and 50 on unanimous voice vote the motion was carried. 51 52 The Clerk read on second reading Ordinance No. 2999-1975. 53 54 Andrew Cecere, Attorney, appeared for the Ordinance. 55 56 Councilman Marino moved for engrossment of Ordinance No. 2999-1975, 57 seconded by Councilman Mills and on unanimous voice vote the motion 58 was carried. 59 Common Council Minutes May 5, 1975 Page 2 1 Councilman Geier moved for suspension of the rules and read Ordinance 2 No. 2999-1975 by title only on third reading, seconded by Councilman 3 Williams and on unanimous voice vote the motion was carried. 4 5 The Clerk read on third reading by title only Ordinance No. 2999-1975. 6 7 Ordinance No. 2999-1975 was placed on final passage or rejection and on 8 a call of the roll the following was recorded: Ayes; Brown, Cornett, 9 Elstro, Geier, Hilton, Marino, Mills, Williams and Merchanthouse. Noes; 10 None. The vote being nine (9) to zero (0) in favor of passage of Ordi- 11 nance No. 2999-1975. 12 13 Councilman Geier moved for suspension of the rules and read by title only 14 on first reading Ordinance No. 3000-1975, seconded by Councilman Mills 15 and on unanimous voice vote the motion was carried. 16 17 The Clerk read on first reading by title only Ordinance No. 3000-1975 - 18 AN ORDINANCE TO APPROPRIATE THIRTY FIVE THOUSAND DOLLARS ($35,000.00) FROM 19 THE FEDERAL REVENUE SHARING TRUST FUND, FOR CERTAIN ORDINARY AND NECESSARY 20 MAINTENANCE AND OPERATING EXPENDITURES AND FOR CERTAIN ORDINARY AND NECES- 21 SARY CAPITAL EXPENDITURES AS AUTHORIZED BY THE LAWS OF THE STATE OF 22 INDIANA AND BY THE ORDINANCES OF THE CITY OF RICHMOND, INDIANA. 23 24 The Clerk read on second reading Ordinance No. 2987-1975 - AN ORDINANCE 25 AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE 26 OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 27 28 The Clerk read a letter from the Department of City Planning stating the 29 Plan Commission voted five to one to recommend approval of the amendment. 30 31 Councilman Geier moved for engrossment of Ordinance No. 2987-1975, 32 seconded by Councilman Williams and on unanimous voice vote the motion 33 was carried. 34 35 Councilman Geier moved for suspension of the rules and read by title only 36 on third reading Ordinance No. 2987-1975, seconded by Councilman Williams •37 and on unanimous voice vote the motion was carried. 38 39 The Clerk read on third reading by title only Ordinance No. 2987-1975. 40 41 Ordinance No. 2987-1975 was placed on final passage or rejection and on 42 a call of the roll the following was recorded: Ayes; Cornett, Elstro, 43 Geier, Hilton, Williams and Merchanthouse. Noes; Brown, Marino, Mills. 44 The vote being six (6) to three (3) in favor of passage of Ordinance 45 No. 2987-1975. 46 47 The Clerk read on second reading Ordinance No. 2988-1975 - AN ORDINANCE 48 AUTHORIZING A SPECIAL USE IN A R-3, ONE TO EIGHT FAMILY RESIDENTIAL 49 DISTRICT, OF ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING 50 ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 51 52 The Clerk read a letter from the Department of City Planning stating 53 the Plan Commission voted five to one to recommend approval of the 54 amendment. 55 56 Councilman Williams moved for engrossment of Ordinance No. 2988-1975, 57 seconded by Councilman Geier and on unanimous voice vote the motion was 58 carried. 59 60 Paul Lingle, representing William Woehrman and John Fienning, Executive 61 ,- Director of the Housing Authority appeared in favor of Ordinance No. 62i 2988-1975. 27 Common Council Minutes May 5, 1975 Page 3 1, Councilman Williams moved for suspension of the rules and read by title 2 only on third reading Ordinance No. 2988-1975,. seconded by Councilman 3 Geier and -on unanimous voice vote the motion was carried. 4 5 The Clerk read on third reading by title only Ordinance No. 2988-1975. 6 7 Ordinance No. 2988-1975 was placed on final passage or rejection and 8 on a call of the roll the following was recorded: Ayes; Brown, Cornett, 9 Elstro, Geier, Hilton, Marino, Mills , Williams and Merchanthouse. The vote being nine (9) to zero (0) in favor of passage of 11 Ordinance No. 2988-1975. 12 13 The Clerk read on second reading Ordinance No. 2991-1975 - AN ORDINANCE 14 AMENDING SPECIAL USE ORDINANCE NO. 2456-1970 TO PERMIT THE CITY TO 15 ACQUIRE FRONT FOOTAGE TO WIDEN NORTHWEST 5TH STREET. 16 17 The Clerk read a letter read from the Department of City Planning. stating 18 the Plan Commission voted nine to zero to recommend approval of the 19 amendment. 20 21 Councilman Brown moved for engrossment of Ordinance No. 2991-1975, 22 seconded by Councilman Hilton and on unanimous voice vote the motion 23 was carried. 24 25 Councilman Geier moved for suspension of the rules and read by title only 26 on third reading Ordinance No. 2991-1975, seconded by Councilman Hilton 27 and on unanimous voice vote the motion was carried. 28 29 The Clerk read on third reading by title only Ordinance No. 2991-1975. 30 31 Ordinance No. 2991-1975 was placed on final passage or rejection and on 32 a call of the roll the following was recorded: Ayes; Brown, Cornett, 33 Elstro, Geier, Hilton, Marino, Mills, Williams and Merchanthouse. 34 Noes; None. The vote being nine (9) to zero (0) in favor of passage 35 of Ordinance No. 2991-1975. 36 37 The Clerk read on second reading Ordinance No. 2995-1975 - AN ORDINANCE 38 TO APPROPRIATE SEVENTY EIGHT THOUSAND, FIVE HUNDRED DOLARS ($78,500.00) 39 FROM THE CUMULATIVE CAPITAL IMPROVEMENT FUND (CIGARETTE TAX) TO BE 40 USED FOR R & S #11 , RIGHT OF WAY, ENGINEERING AND CONSTRUCTION OF 41 WILLIAMSBURG PIKE. 42 43 City Attorney Robert Burton examined proof of publication and found it 44 to be in order. 45 46 Councilman Geier moved to accept and file proof of publication, seconded 47 by Councilman Hilton and on unanimous voice vote the motion was carried. 48 49 Councilman Cornett moved for engrossment of Ordinance No. 2995-1975, 50 seconded by Councilman Elstro and on unanimous voice vote the motion 51 was carried. 52 11/ 53 Councilman Geier moved for suspension of the rules and read by title 54 only on third reading Ordinance No. 2995-1975, seconded by Councilman 55 Hilton and on unanimous voice vote the motion was carried. 56 57 The Clerk read on third reading by title only Ordinance No. 2995-1975. 58 59 Ordinance No. 2995-1975 was placed on final passage or rejection and 60 on a call of the roll the following was recorded: Ayes; Brown, Cornett, 61 Elstro, Geier, Hilton, Marino, Mills, Williams and Merchanthouse. Noes; 62 None. The vote being nine (9) to zero (0) in favor of passage of 63 Ordinance No. 2995-1975. Common Council Minutes May 5, 1975 Page 4 1 The Clerk read on second reading Ordinance No. 2996-1975 - AN ORDINANCE 2 TO APPROPRIATE SEVEN HUNDRED SIX THOUSAND, FIVE HUNDRED DOLLARS ($706, 3 500.00) FROM THE LOCAL ROAD AND STREET FUND FOR R & S #11 , RIGHT OF WAY, 4 ENGINEERING AND CONSTRUCTION OF WILLIAMSBURG PIKE. 5 6 City Attorney Robert Burton examined proof of publication and found 7 it to be in order.' 8 9 Councilman Marino moved to accept and file proof of publication, seconded 10 by Councilman Mills and on unanimous voice vote the motion was carried. 11 12 Councilman Brown moved for engrossment of Ordinance No. 2996-1975, 13 seconded by Councilman Cornett and on unanimous voice vote the motion 14 was carried. 15 16 Councilman Elstro moved for suspension of the rules and read Ordinance 17 No. 2996-1975 by title only on third reading, seconded by Councilman 18 Hilton and on unanimous voice vote the motion was carried. 19 20 The Clerk read on third reading by title only Ordinance No. 2996-1975. 21 22 Ordinance No. 2996-1975 was placed on final passage or rejection and on 23 a call of the roll the following was recorded: Ayes; Brown, Cornett, 24 Elstro, Geier, Hilton, Marino, Mills, Williams and Merchanthouse. Noes; 25 None.
