HomeMy Public PortalAbout04-07-1975 2® PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, APRIL 7, 1975 1 The Common Council of the City of Richmond, Indiana, met in regular 2 session April 7, 1975 at the hour of 7:30 p.m. in the Council Chambers 3 in the Municipal Building in said City. President Merchanthouse 4 presided with the following members present: Messrs. Brown, Cornett, 5 Elstro, Geier, Hilton, Marino, Mills and Williams. Absent: None. 6 . The following business was had to-wit: 7 8 Councilman Williams moved to approve the minutes of the previous meeting, 9 seconded by Councilman Geier and on unanimous voice vote the motion 10 was carried. 11 12 Councilman Williams requested the Board of Works to check into a trash 13 problem in the 900 block of North llth Street. 14 15 Councilman Williams also received a complaint that trash has not been 16 picked up at 408 South 5th Street stating they were told to bring 17 trash out onto the street for pickup. 18 19 Councilman Marino stated a explanation should come from the Sanitary 20 District regarding the pickup at 408 South 5th Street. 21 22 Councilman Geier moved for suspension of the rules and read Ordinance 23 No. 2991-1975 on first reading by title only, seconded by Councilman 24 Mills and on unanimous voice vote the motion was carried. 25 26 The Clerk read on first"reading by title only Ordinance No. 2991-1975 - 27 AN ORDINANCE AMENDING SPECIAL USE ORDINANCE NO. 2456-1970 TO PERMIT 28 THE CITY TO ACQUIRE FRONT FOOTAGE REQUIRED TO WIDEN NORTHWEST 5TH STREET. 29 30 Ordinance No. 2991-1975 was referred to Plan Commission for study and 31 recommendation. 32 33 Councilman Elstro moved for suspension of the rules and read Ordinance 34 No. 2992-1975 on first reading by title only, seconded by Councilman 35 Geier and on unanimous voice vote the motion was carried. 36 37 The Clerk read on first reading by title only Ordinance No. 2992-1975 - 38 AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE 39 ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 40 41 Ordinance No. 2992-1975 was referred to the Plan Commission for study - 42 and recommendation. 43 44 The Clerk read on first reading Ordinance No. 2993-1975 - AN ORDINANCE 45 APPROPRIATING THE SUM OF TWELVE THOUSAND DOLLARS ($12,000.00) FROM 46 THE CUMULATIVE CAPITAL IMPROVEMENT FUND (CIGARETTE TAX) FOR STREET 47 MATERIALS. 48 49 Councilman Geier moved for suspension of the rules and read Ordinance 50 No. 2994-1975 on first reading by title only, seconded by Councilman 51 Hilton and on unanimous voice vote the motion was carried. 52 53 The Clerk read on first reading by title only Ordinance No. 2994-1975 - 54 AN ORDINANCE TO APPROPRIATE SIX HUNDRED THOUSAND DOLLARS ($600,000.00) 55 FROM THE FEDERAL REVENUE SHARING TRUST FUND, FOR CERTAIN ORDINARY AND 56 NECESSARY MAINTENANCE AND OPERATING EXPENDITURES AND FOR CERTAIN 57 ORDINARY AND NECESSARY CAPITAL EXPENDITURES AS AUTHORIZED BY THE LAWS 58 OF THE STATE OF INDIANA AND BY THE ORDINANCES OF THE CITY OF RICHMOND, 59 INDIANA. 60 Common Council Minutes April 7, 1975 Page 2 1 The Clerk read on second reading Ordinance No. 2983-1975 - AN ORDINANCE 2 AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE 3 OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. 4 5 The Clerk read a letter from the Department of City Planning stating 6 the Plan Commission voted five (5) to two (2) to recommend denial 7 of the rezoning. 8 9 Councilman Marino moved to allow Councilman Brown to abstain from 10 voting on Ordinance No. 2983-1975, seconded by Councilman Hilton and 11 on unanimous voice vote the motion was carried. 12 13 Richard Brantner, 4511 East Main Street, appeared for Ordinance No. 14 2983-1975, representing the landowners and McDonald's. He sited the 15 existing business on U.S. 40 west, employment opportunity, tax income 16 and the fact that McDonald's is a "good neighbor" as reasons for the 17 rezoning. He said new sidewalks and curbs would be installed and 18 that it will not create additional traffic problems. 19 20 In answer to a question from Councilman Geier as to why they could not 21 go six blocks farther west, Mr. Brantner said survey showed this site 22 was the best market location. 23 24 Councilman Marino inquired who would build the McDonalds and Mr. Brantner 25 replied the contractors would use Richmond union laborers. 26 27 Matthew DeGraw, Business Mgr. Laborers Local Union No. 1047 appeared 28 for the rezoning stating Richmond needs the work and McDonald's do use 29 local people. 30 31 Gilber Klose, 712 National Road West, Les_ Whipple, 720 Hidden Valley 32 Drive and Carol Bastin, 120 S.W. "A" Street, appeared against the 33 Ordinance No. 2983-1975 stating too much business is already in the 34 area, would cause conjested traffic problems and litter problems. 35 36 Robert Goodwin, Plan Director, commented the location is too small , 37 closeness of the cemetary and the trash problem are reasons for the 38 Plan Commission denial . 39 40 After considerable discussion, Councilman Cornett moved for engrossment 41 of Ordinance No. 2983-1975, seconded by Councilman Mills and on a 42 call of the roll the following was recorded: Ayes; Cornett, Elstro, 43 Geier, Hilton, Marino, Mills, Williams and Merchanthouse. Noes; None. 44 The vote being eight (8) to zero (0) in favor of engrossment. 45 46 Councilman Marino moved for suspension of the rules and place Ordinance 47 No. 2983-1975 on third reading by title only, seconded by Councilman 48 Mills and on unanimous voice vote the motion was carried. 49 50 Ordinance No. 2983-1975 was placed on final passage or rejection and 51 on a call of the roll the following was recorded: Ayes; Cornett, 52 Elstro, Marino, Mills and Williams. Noes; Geier, Hilton and Merchant- "' house. The vote being five (5) to three (3) in favor of passage of 54 Ordinance No. 2983-1975. Ordinance No. 2983-1975 was rejected due 55 to the lack of the required seven (7) yes votes needed to over-ride 56 the Plan Commission's vote for denial . 57 58 The Clerk read on second reading Ordinance No. 2989-1975 - AN ORDINANCE 59 TO APPROPRIATE THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FROM THE 60 GENERAL FUND TO THE CITY COURT BUDGET, SERVICES PERSONAL (1-12-124) 61 CORRECTION OFFICER. Common Council Minutes April 7, 1975 Page a. 1 City Attorney Robert Burton examined proof of publication and found 2 it to be in order. 3 4 Councilman Marino moved to accept and file proof of publication, 5 seconded by Councilman Hilton and on unanimous voice vote the motion 6 was carried.. 7 8 Councilman Mills moved for engrossment of Ordinance No. 2989-1975, 9 seconded by Councilman Williams and on unanimous voice vote the 10 motion was carried. 11 12 Councilman Williams moved for suspension of the rules and place Ordi- 13 nance No. 2989-1975 on third reading by title only, seconded by 14 Councilman Mills and on unanimous voice vote the motion was carried. 15 16 The Clerk read on third reading by title only Ordinance No. 2989-1975. 17 18 Ordinance No. 2989-1975 was placed on final passage or rejection and 19 on a call of the roll the following was recorded: Ayes; Brown, 20 Cornett, Elstro, Geier, Hilton, Marino, Mills, Williams and Merchant- 21 house. Noes; None.
