HomeMy Public PortalAbout03-03-1975 PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MARCH 3, 1975 The Common Council of the City of Richmond, Indiana, met in regular session March 3, 1975 at the hour of 7:30 p.m. in the Council Chambers in the Municipal Building in said City. Mr. Merchanthouse presided with the following members present: Messrs. Brown, Cornett, Elstro, Geier, Hilton, Marino, Mills and Williams. Absent: None. The following business was had to-wit: Councilman Williams moved to approve the minutes of the previous meeting, seconded by Councilman Mills and on unanimous voice vote the motion was carried. Mr. Ralph Wright, 693 South 20th Street, appeared, before the Council concerning water problems in the 20th and 21st Street area. The Board of Works will refer the problem to the Sanitary District. The Clerk read on first reading Ordinance No. 2985-1975 - AN ORDINANCE APPROPRIATING THE SUM OF THIRTEEN THOUSAND, FIVE HUNDRED DOLLARS ($13,500) FROM THE CUMULATIVE STORM SEWER FUND FOR STORM SEWER MATERIALS. Mr. Geier moved to suspend the rules and read Ordinance No. 2986-1975 on first reading by title only, seconded by Councilman Elstro and on unanimous voice vote the motion was carried. The Clerk read on first reading by title only Ordinance No. 2986-1975 - AN ORDINANCE TO -APPROPRIATE TWENTY THOUSAND FIVE HUNDRED DOLLARS ($20, 500) FROM THE FEDERAL REVENUE TRUST FUND, FOR CERTAIN ORDINARY AND NECESSARY MAINTENANCE AND OPERATING EXPENDITURES AND FOR CERTAIN ORDINARY AND NECESSARY CAPITAL EXPENDITURES AS AUTHORIZED BY THE LAWS OF THE STATE OF INDIANA AND BY THE ORDINANCES OF THE CITY OF RICHMOND, INDIANA. The Clerk read on first reading Ordinance No. 2987-1975 - AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. Ordinance No. 2987-1975 was referred to the Plan Commission for study and recommendation. The Clerk read on first reading Ordinance No. 2988-1975 - AN ORDINANCE AUTHORIZING A "SPECIAL USE" IN A R-3 ONE TO EIGHT FAMILY RESIDENTIAL DISTRICT OF ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDI- NANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. Ordinance No. 2988-1975 was referred to the Plan Commission for study and recommendation. The Clerk read on second reading Ordinance No. 2953-1974 - AN ORDINANCE AMENDING ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, ADOPTED JUNE 3, 1968. The Clerk read a letter from the Plan Commission recommending approval of the rezoning by a vote of sib (6) to one (1 ) . Andrew Cecere, Attorney, appeared in favor of the rezoning. Councilman Elstro moved for engrossment of Ordinance No. 2953-1974, seconded by Councilman Geier and on unanimous voice vote the motion was carried. Councilman Elstro moved for suspension of the rules and place Ordinance No. 2953-1974 on third reading by title only, seconded by Councilman Williams and on unanimous voice vote the motion was carried. 1.4 March 3, 1975 Page 2 The Clerk read on third reading by title only Ordinance No. 2953-1974. Ordinance No. 2953-1974 was placed on final passage or rejection and on a call of the roll the following was recorded: Ayes; Cornett, Elstro, Geier, Hilton, Marino, Williams and Merchanthouse. Noes; Brown and Mills. The vote being seven (7) to two (2) in favor of passage of Ordinance No. 2953-1974. The Clerk read on second reading Ordinance No. 2979-1975 - AN ORDINANCE AMENDING ORDINANCE NO. 2660-1971 , AN ORDINANCE AMENDING ORDINANCE NO. 2440-1969, AN ORDINANCE AUTHORIZING A "SPECIAL USE" FOR A PLANNED UNIT DEVELOPMENT IN A R-2 SINGLE FAMILY RESIDENTIAL DISTRICT OF ORDINANCE _ NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA. The Clerk read a letter from the Department of City Planning stating the Plan Commission voted unanimously to recommend approval of the Special Use. Councilman Geier moved for engrossment of Ordinance No. 2979-1975, seconded by Councilman Hilton and on unanimous voice vote the motion was carried. Councilman Geier moved for suspension of the rules and place Ordinance No. 2979-1975 on third reading by title only, seconded by Councilman Hilton and on unanimous voice vote the mention was carried. The Clerk read on third reading by title only Ordinance No. 2979-1975. Ordinance No. 2979-1975 was placed on final passage or rejection and on a call of the roll the following was recorded: Ayes; Brown, Cornett, Elstro, Geier, Hilton, Marino, Mills , Williams and Merchanthouse. Noes; None. The vote being nine (9) to zero (0) in favor of passage of Ordinance No. 2979-1975. The Clerk read on second reading Ordinance No. 2980-1975 - AN ORDINANCE AMENDING ORDINANCE NO. 2508-1970, AN ORDINANCE AUTHORIZING A "SPECIAL USE" IN A R-3 ONE TO EIGHT FAMILY RESIDENTIAL DISTRICT OF ORDINANCE NO. 2325-1968 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA. A letter was read from the Department of City Planning stating the Plan Commission voted unanimously to recommend approval of the amendment of the Ordinance. Councilman Marino moved for engrossment of Ordinance No. 2980-1975, seconded by Councilman Mills and on unanimous voice vote the motion was carried. Councilman Williams moved for suspension of the rules and place Ordinance No. 2980-1975 on third reading by title only, seconded by Councilman Mills and on unanimous voice vote the motion was carried. The Clerk read on third reading by title only Ordinance No. 2980-1975. Ordinance No. 2980-1975 was placed on final passage or rejection and on a call of the roll the following was recorded: Ayes; Brown, Cornett, Elstro, Geier, Hilton, Marino, Mills, Williams and Merchanthouse. Noes; None. The vote being nine (9) to zero (0) in favor of passage of Ordinance No. 2980-1975. The Clerk read on second reading Ordinance No. 2981-1975 - AN ORDINANCE FIXING THE ANNUAL SALARIES OF ALL ELECTED OFFICERS OF THE CITY OF RICHMOND, INDIANA, PAYABLE FROM THE GENERAL FUND, EFFECTIVE AT THE COMMENCEMENT OF THE TERMS OF SUCH OFFICERS SUCCEEDING THE GENERAL ELECTION OF 1975, AS PROVIDED FOR BY CHAPTER 107 OF THE ACTS OF 1959. 15 March 3, 1975 Page 3 Kenneth Paust, 221 South 19th. Street, appeared in favor of the ordinance • saying, "elected salaries have to keep pace with the economy". James Weichman appeared against the proposed salary increases with the following recommendation: Mayor $20,000, Clerk $11 ,000, Judge $10,000, and Council $3,200.00. Bob Rosa, 806 Keyser Lane and Pauline Rhoades of Centerville appeared against the salary increase. Councilman Brown moved to amend Ordinance No. 2981-1975 as follows, seconded by Councilman Hilton: Mayor $19,250 - 1976 $20,250 - 1977 $21 ,200 - 1978 $22,230 - 1979 Judge $12,350 - 1976 ' .13,000 - 1977 13,775 - 1978 14,750 - 1979 Clerk $ 9,000 - 1976 9,500 - 1977 10,000 - 1978 10,500 - 1979 On a call of the roll the following was recorded: Ayes; Brown, Hilton, and Williams. Noes; Cornett, Elstro, Geier, Marino, Mills and Merchant- house. The vote being three (3) to six (6) in favor of rejection the amendment to amend Ordinance No. 2981-1975. Councilman Cornett moved for engrossment of Ordinance No. 2981-1975, seconded by Councilman Mills and on unanimous voice vote the motion was carried. The Clerk read on second reading Ordinance No. 2982-1975 - AN ORDINANCE APPROVING THE PAYMENT OF ADDITIONAL COMPENSATION TO CERTAIN ELECTED OFFICALS OF THE CITY OF RICHMOND, INDIANA OTHER THAN GOVERNMENTAL, WHO PERFORM SERVICES FOR THE CITY, WHICH SERVICES ARE CONNECTED WITH THE MUNICIPAL ELECTRIC LIGHT AND POWER PLANT, AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH. Councilman Geier moved for engrossment of Ordinance No. 2982-1975, seconded by Councilman Elstro and on unanimous voice vote the motion was carried. The Clerk read on second reading Ordinance No. 2984-1975 - AN ORDINANCE TO APPROPRIATE FIFTY THOUSAND DOLLARS ($50,000.00) FROM THE CUMULATIVE CAPITAL IMPROVEMENT FUND (CIGARETTE TAX) TO CONSTRUCT AND EQUIP A NEW NO. 2 AND NO. 3 FIRE STATION. Assistant City Attorney, Donald Simkin, examined proof of publication, and found it to be in order. Councilman Geier moved to accept and file proof of publication and seconded by Councilman Marino and on unanimous voice vote the motion was carried. Councilman Geier moved for engrossment of Ordinance No. 2984-1975, seconded by Councilman Elstro and on unanimous voice vote the motion was carried. Councilman Geier moved for suspension of the rules and place Ordinance No. 2984-1975 on third reading by title only, seconded by Councilman Hilton and on unanimous voice vote the motion was carried. 1.6 March 3, 1975 Page 4 The Clerk read on third reading by title only Ordinance No. 2984-1975. Noes; None. The vote being nine (9) to zero (0) in favor of passage of Ordinance No. 2984-1975. There being no further business on motion duly made, seconded and passed, the meeting was adjourned.
