RESOLUTION AUTHORIZING THE RELEASE OF
RETAINAGE AND PAYMENT IN CONNECTION WITH THE
WEST CARTERET SEWER PROJECT
WHEREAS, Marvac Construction Corporation ("Marvac") performed certain
construction work in connection with the West Carteret Sewer Project (the
"Project") and
WHEREAS, certain funds were being held as retainage pending a review and
determination by the Borough of Carteret (the "Borough Engineer") that Marvec
had complied with the terms and conditions of its construction agreement; and
WHEREAS, the Borough Engineer has reviewed the Project and determined that
it is no longer necessary for the Borough to continue to hold retainage; and
WHEREAS, there is an outstanding invoice due Marvac equal to the amount
being held as retainage; and
WHEREAS, said invoice has been authorized for payment by the Borough
Engineer.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND
COUNCIL OF THE BOROUGH OF CARTERET, that retainage of $6570.17
is hereby released and Estimate No.9 in the amount of $6570.17 is hereby
authorized to be paid to Marvac.
Adopted this 6th day of May, 1999
and Certified as a true copy of the
original on May 7, 1999.
