Closed Session Minutes officiaf!y 'Unseafed'I'Q . on February 14,2005 '{J6ned by TOItfI Board Action ~P~/ Town of Hillf CLOSED SESSION MINUTES HILLSBOROUGH TOWN BOARD June 9, 2003 7:30 PM, Town Barn The Hillsborough Town Board met in Closed Session on June 9, 2003 at 7:30 PM in the Hillsborough Town Barn for the purpose of discussing two legal matters. Present for the Board Closed Session were Mayor Joe Phelps, and Commissioners Mike Gering, Mark Sheridan, Frances Dancy, and Evelyn Lloyd. Absent was Commissioner Kenneth Chavious. Staff present were Town Manager Eric Peterson, Town Clerk Donna Armbrister, Assistant Town Manager/Public Works Director Demetric Potts, Management Intern Kent Wyatt, and Town Attorney Bob Hornik. Mayor Joe Phelps called the meeting to order at 7:32 PM. SCOTT TREE Town Manager Eric Peterson updated the Board on the issue of Mr. Kent Scott's Tree, which the Town had cut down in error. Mr. Scott now claims that the Hackberry Tree was not worth the $30,000 he originally stated, but more like $60,000 and that he is giving the Town a break. The League of Municipalities is handling the insurance claim and has informed the Town that they determine the amount of loss by appraising the property with the tree and again without the tree. The difference is the value of the tree. The League has also interviewed numerous persons involved including an arborist and had determined that the tree was diseased and would have had to be removed by Mr. Scott soon anyway. The League has recommended the Town made a good faith $1,000 offer to Mr. Scott. The Manager approved for this offer to be made by the League. Mr. Scott declined the offer and the League had advised the Town to expect a lawsuit The League will represent the Town in this matter if such lawsuit arises. CARUTHERS RESERVOIR CASE Town Attorney Hornik reported that the original Caruthers case agreed to the Town building a road connecting two pieces of the property separated by the reservoir. They now wish to build the road themselves and are asking $20,000 to settle the case.
