Hughes MINUTES Planning Commission Meeting February 17, 2009 – 7:00 p.m. Mayor Jason Buelterman called the February 17, 2009, Planning Commission meeting to order. He then swore-in Randi Bryan, Jay Burke and Lisa McKenzie as Planning Commission members. They had been appointed by City Council at the January 22, 2009 meeting. Their terms would end on January 31, 2011. Other Commissioners present were: James Boyle, George Dausey and Whitley Reynolds. Mayor Jason Buelterman called for nominations for the position of Chair of the Planning Commission. Whitley Reynolds nominated James Boyle. Lisa McKenzie seconded. The vote in favor of Boyle for Chair was unanimous. Buelterman called for nominations for the position of Vice Chair of the Planning Commission. Boyle nominated Reynolds. George Dausey seconded. The vote in favor of Reynolds for Vice Chair was unanimous. The Chair and Vice Chair would serve 1-year terms. James Boyle called for a motion on the Minutes of the January 20, 2009, Planning Commission meeting. Anne Miller moved to approve. Whitley Reynolds seconded. The vote in favor of the motion was unanimous. James Boyle asked if there were any Disclosures. Whitley Reynolds disclosed that he had surveyed the 1411 Jones Avenue property and would recuse himself. James Boyle opened the Public Hearing for a Zoning Variance (Section 5 -090) from Section 3-020, Continuance of Nonconforming Uses/Structures, at 1411 Jones Avenue, PIN 4-0007-20-008, Zone R-2, owned by Dan and Kay Petty. Whitley Reynolds recused himself. Dianne Ott o explained that the request was for front and rear porch additions. The rear porch addition would further expand a nonconforming side setback, and the front porch would further expand a nonconforming setback on the other side. Randi Bryan asked if there was a drainage plan. Otto stated that the Land Development Code does not require a drainage plan for an addition. Kay Petty said that she and her husband currently live in Tennessee and that they plan to move to Tybee permanently in the future. She explain ed that the house was built over fifty years ago with the front door facing the north. George Dausey said that since the porch would not be all the way across the front of the low-lying cottage it would not have a good view from the street. Petty said that they had tried hard to be complimentary to the existing roofline, and that they were open to suggestions. She discussed the plan further, and explained that they moved the front porch over on the plan to keep a grapefruit tree in the yard. After further d iscussion of the plans, Dausey asked if she considered taking the porch all the way across the front and doing away with the entry on the side. Petty said that the north entry was there when the house was built and she was trying to stay in keeping with the character of the home to promote the natural breezes. She spoke further of the windows of the house, and damage and rot that had occurred. She said that they wanted to preserve the character 2 of Tybee. Dausey said that he wanted them to move here. Boyle asked for input from the public. There being none, he called for a motion. Anne Miller motioned to approve. The motion was seconded by Lisa McKenzie. The vote in favor of the motion to approve was unanimous with Reynolds having recused. The motion to approve passed. Boyle told the petitioner that the request would be before the Mayor and City Council on March 12, 2009. James Boyle asked about a copy of the Ethics Ordinance that had been given to the Commissioners. Dianne Otto explained that it was the revised Ethics Ordinance that had been adopted by City Council. She said that it did apply to appointed positions such as Planning Commissioner members. Whitley Reynolds suggested that the Commissioners think of things that they would like to review for possible changes. James Boyle and Dianne Otto discussed that they could hold such discussions either during regular Planning Commission meetings or during scheduled work sessions. George Dausey requested that Staff provide reports on City Council votes on items sent to them by the Planning Commission. Dianne Otto agreed to provide the information. Dianne Otto reminded the Commissioners of an American Planning Association webinar scheduled for February 18, 2009, at City Hall. Whitley Reynolds motioned to adjourn. George Dausey seconded. The vote was unanimous and the meeting was adjourned.
