MINUTES
Planning Commission Meeting
September 15, 2009 – 7:00 p.m.
Vice Chair Whitley Reynolds called the September 15, 2009, Planning Commission meeting to order.
Other Commissioners present were Randi Bryan, Jay Burke, George Dausey, and Lisa McKenzie. Absent
were Chair James Boyle and Anne Miller.
Vice Chair Whitley Reynolds asked for a motion on the Minutes of the August 18, 2009, meeting. George
Dausey motioned to approve. Randi Bryan seconded. The vote was unanimous.
Vice Chair Whitley Reynolds asked if there were any Disclosures. Reynolds disclosed that for items 2 and
5 he would step out. Lisa McKenzie stated that she had a business relationship with Mack Kitchens but it
would not be an issue.
Vice Chair Whitley Reynolds opened a Public Hearing for Special Review at 24 Van Horn, PIN 4-0002-
22-002, Zone R-1. The petitioner was Cathleen Kilday. The request was for special events for up to 20
people at an existing residential bed and breakfast. Jonathan Lynn said that the Character Area was North
Beach Neighborhood. He said that the petition had been heard by the Commission in July and by City
Council in August. He said that Council requested that it come back to the Commission. Lynn said that
since then the applicant had revised the parking plan based upon comments made by Council, one of
which was that, including guests, they could have no more than 20 people at the bed and breakfast at any
given time. Lisa McKenzie and Lynn discussed a letter from the Fire Marshal. Randi Bryan asked how
many parking spaces were needed. Lynn said that based upon 20 people, 9 spaces. He said the plan
showed 10. Kilday said they took the parking out of the rear of the property, and that takes 30 feet out of
the garden in the front. George Dausey asked how many spaces were at the adjacent nursing home. Kilday
said none. She and Dausey discussed. Bryan asked about ADA parking. Downer Davis, the City’s
consulting engineer, said he spoke with Chatham County’s building office and on a project this size they
would probably not deem the ADA space to be a requirement. Bryan asked about vehicles backing into
the street. Davis said that there were 8 spaces existing, partly in right-of-way and partly on the property.
He and Bryan discussed parking. Davis stated that if they left the 8 spaces in front then he had no
comment because it was existing but if they wanted to add to it, it would be noncompliant. McKenzie said
that there were 10 spaces. Davis said that he had not concurred with that. He stated that you do not do
angled parking with backing out. McKenzie asked what other parking plan they could come up with.
Davis said that he was not the designer and he had not played with the dimensions. He said that there
were other alternatives but it would certainly butcher the front of the propert y. Parking was discussed by
the group. Reynolds asked for public input. He closed the Public Hearing. Bryan motioned to approve
with 8 spaces in the front, not requiring the fence be moved, and no more than 2 parking spaces in the
back. McKenzie seconded. Voting in favor were Bryan, Burke and McKenzie. Dausey voted against. The
motion to approve with 8 parking spaces in the front, not requiring that the fence be moved, and no

more than 2 parking spaces in the back passed with a 3-0 vote. City Council would hear the Special
Review petition on October 8.
Acting Chair George Dausey opened a Public Hearing for Zoning Variance at 17 Izlar Avenue, Units A,
B and C, PIN 4-0008-05-014, Zone C-1/SE. The petitioner was Mack Kitchens. The request was for a
driveway width of 29 feet. Whitley Reynolds recused. Jonathan Lynn said that the Character Area was
The Strand Historic Downtown Business District. He said that the lot was very shallow. He referred to a
front setback variance at the site that had been approved in May of 2008. Dausey called for public input.
Dausey closed the Public Hearing. Jay Burke moved to approve. Lisa McKenzie seconded. Voting in
favor were Bryan, Burke and McKenzie. Reynolds had recused. The motion to approve passed with a 3-
0 vote. The request would be heard by City Council on October 8.
Vice Chair Whitley Reynolds opened a Public Hearing for a Zoning Variance at 16 Taylor Street, PIN 4-
0001-02-013, Zone R-1. The petitioner was David Paddison. The request was for driveway additions.
Jonathan Lynn said that the Community Character Area was the North Beach Neighborhood, and the
applicant was requesting an additional 2 feet of brick pavers and continuing the driveway on the Taylor
Street side. He said the current access was Pulaski Street. Lynn said that according to the Land
Development Code no driveway opening could be closer than 25 feet to the road. The proposal was
discussed. Reynolds asked for public input and then closed the Public Hearing. Lisa McKenzie motioned
to approve. George Dausey seconded. Voting in favor were Bryan, Burke, Dausey, and McKenzie. The
motion to approve passed 4-0. City Council would hear the item on October 8.
Vice Chair Whitley Reynolds opened a Public Hearing for a Site Plan at 4 Old Highway 80, PIN 4-0024-
01-005, Zone M-D. The petitioner was Lazaretto Development. The request was for additional parking
area and a concrete pad for a fuel tank. Jonathan Lynn said that the Character Area was Lazaretto Creek
Maritime District. He noted that there was not a 25-foot buffer shown on the plan but that Kern-Coleman,
the applicant’s engineer, was willing to do that. The 25-foot buffer requirement was discussed. George
Dausey asked if there was an ordinance requiring a containment wall around the fuel tank pad. Downer
Davis, the City’s consulting engineer, said that there used to be but double-walled tanks were used now,
which was a better method of containment. Phil McCorkle, attorney for the applicant, explained the
request and said that the only new thing was the fuel tank. Reynolds closed the Public Hearing. Dausey
moved to approve. Jay Burke seconded. Randi Bryan asked why Tybee needed to approve it since it was
already approved by the State. Lynn said that although the State gives approval the applicant still needs
local permits. Davis said that there were things that Tybee reviewed that the State did not. Lisa McKenzie
requested that the motion be amended to require that the buffer be shown on the Site Plan. Dausey and
Burke agreed to the amendment. Bryan, Burke, Dausey, and McKenzie voted in favor. The motion to
approve with condition that the 25 foot buffer be shown on the Site Plan passed with a 4-0 vote. The
petition would be heard October 8 by City Council.
Acting Chair George Dausey opened a Public Hearing for a Zoning Variance at 148 Lewis Avenue, PIN
4-0004-14-016, Zone R-1-B. The petitioners were Melissa Turner and Thomas Oliver. The request was
for a rear porch addition. Whitley Reynolds recused. Jonathan Lynn said that the Character Area was
Marshfront Neighborhood. He said the existing front porch encroached into the setback which made the
house a nonconforming use and expansion was not allowed without a variance. The plan was discussed.
Dausey asked for public input. He closed the Hearing. Lisa McKenzie motioned to approved and Randi
Bryan seconded. Voting in favor were Bryan, Burke and McKenzie. Reynolds had recused. The motion
to approve passed with a 3-0 vote. The Public Hearing before City Council would be on October 8.
Vice Chair Whitley Reynolds asked for a motion to adjourn. Lisa McKenzie so moved. George Dausey
seconded. The vote was unanimous. The meeting adjourned.
