HomeMy Public PortalAbout06-28-2001 BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, JUNE 28, 2001 The Board of Public Works and Safety of the City of Richmond, Indiana, met at 5 p.m. Thursday, June 28, 2001, in the Community Room in the Municipal Building. Chairperson Bob Goodwin presided with Bruce Metzger, Robin Henry, and Assistant City Attorney Steve Rabe present. The following business was conducted: APPROVAL OF MINUTES Metzger moved to approve, second by Henry and the motion was carried on a voice vote. CLAIMS FOR PAYMENT Henry presented claims submitted by the Finance Department in the amount of $71,764.32 and moved for approval, second by Metzger and the motion was carried on a voice vote. REQUESTS A. Goodwin presented an access permit at 2120 South 16th Street which all departments have approved. Henry moved to approve, second by Metzger and the motion was carried on a voice vote B. Captain Don Ponder requested approval for a handicap sign for Albert Lee Doyle at 726 South 12th Street. Metzger so moved, second by Henry and the motion was carried on a vice vote. C. Captain Ponder requested permission for Lainey Mahaffey of 33 South 13tn Street, to close the 1st block of South 13th Street for a block party on June 30, 2001 from 5:00 p.m. to 8:00 p.m. Henry moved to approve, second by Metzger and the motion was carried on a voice vote. D. Ponder requested a handicap parking space be approved for Billy McNamara at 113 South 5th Street. Metzger moved to approve, second by Henry and the motion was carried on a voice vote. Goodwin read a letter from Fire Chief Mike Allen requesting the promotion of Probationary Firefighters Doug Dillman, Jerry Miller and Shawn Phenis to 1st Class Firefighters effective June 26, 2001. Metzger moved to approve, second by Henry and the motion was carried on a voice vote. F. Joanne Smith owner of Jo's Salon on South 10th Street said she was not notified when South 10th Street was closed during the Rod Run Show. She also stated that several on the street had not been notified and felt that is was not properly taken care of. She requested in the future that all residents be notified in a timely manner of any street closing. AMENDMENT TO DEFERRED COMPENSATION PLAN DOCUMENT A. Henry presented to the board an amendment to the workman's compensation plan concerning language when a divorce takes place and how assets are transferred over from the compensation program. Metzger moved to approve, second by Henry and the motion was carried on a voice vote. AGREEMENT A. Rabe presented an order on CSX Transportation which deals with the repair of the railroad tracks on South "L" Street. When the agreement was originally presented it contained the wrong address, saying it was in the 1200 block of South "L" Street when actually it is the 600 block of South "L" Street. Metzger moved to approve the amended order, second by Henry and the motion was carried on a voice vote. HEARING ON REQUEST A. Jody Snyder of 224 Northwest 16th Street came forward and told of her experience of being attacked by a dog residing next door to her at 228 Northwest 16th Street. She was trying to protect her dogs and a boxer dog in question came into her yard and she put her hand up to stop him and he came across her arm and bit her on the lip. She had pictures showing her injury that required several stitches. She went on to say that she is not asking for the dog to be destroyed, but that the dog be declared a vicious dog. Kim Sullivan, owner of the dog, and several relatives and friends came forward in defense of the dog and said that he was not a vicious dog and anybody could pet him and they would not be harmed. They said it was her dogs that provoked the attack. BOW Minutes Cont'd June 28, 2001 Page 3 Two Police officers who were on the scene after the incident occurred said that the dog is a vicious animal. After the discussion, the board made a decision to declare the dog vicious. Rabe referred to the city code 91.97 which defines a vicious dog. Henry moved to declare the boxer dog vicious, second by Metzger and the motion was carried on a voice vote. This tape, the minutes and the city code is on file in the Clerk's office for reference. REQUEST A. Goodwin read a letter from Lynn Johnston, Executive Director of Urban Enterprise Association, Richmond Inc. requesting the use of the municipal parking lot on North 7th for the Farmer's Market. This will be every Saturday from 7:00 to 11:00 A.M. beginning June 30th and ending October 27, 2001. Henry moved to approve, second by Metzger and the motion was carried on a voice vote. ADJOURNMENT There being no further business, on a motion duly made, seconded and passed, and carried on a voice vote, the meeting was adjourned.
