Jones Clerk- Treasurer GREENCASTLE COMMON COUNCIL REGULAR SESSION TUESDAY, MAY 9, 2000 7:00 P.M. JONES ELEMENTARY SCHOOL The Greencastle Common Council met in Regular Session Tuesday, May 9, 2000, 7:00 p.m. at Jones Elementary School. Mayor Michael called the meeting to Order. On the Roll Call, the following were found to be present: Councilor Roach, Councilor Hammer, Councilor Crampton, Councilor Parrish and Councilor Rokicki. Also present was City Attorney Laurie Robertson. Mayor Michael thanked the School Corporation for allowing the Council to use their building for this meeting and acknowledged that Superintendent Mike Turner and Principal Alan Small are in attendance. Public Petitions and Comments Joe M. Liechty, 104 East Berry Street, presented a letter that reads as follows: ® May 9, 2000 Joe M. Liechty 104 E. Bent' Street Greencastle Concern: The property next to my home (102 E. Berry St.) has an unoccupied house and overgrown yard. During the week of April 23 -27 I called the mayor's office to inquire about what I could do to remedy the yard next to my home being overgrown. I was advised that the person who takes care of that would call. They have not as yet done so. I still want a remedy to the overgrown yard. But an even greater concern is that the property cannot sell for the value it had when purchased due to the city's sewage problem. During times of heavy rainfall sewage runs across the backyard as well as from a manhole in the street. The signs erected on our block by the city of Greencastle as compelled by the Indiana Department of Environmental Management verify this truth. As a first step in my quest for a solution I am requesting a total ban on sewage hook -ups until the problem of the city's waste disposal system being unable to handle the load is corrected. I understand that we have to "live with" the current situation for two years until it is remedied but I am not willing to live with "further damage" created by increased sewage flow from additional hook -ups. Mayor Michael stated we are on an "early sewer ban ", meaning if there is not a lateral in place we must get approval from the State for hook -ups, if a lateral is in place it is a local decision. ® Mike Tzouanakis, 1000 South Jackson Street, asked about progress of the work on South Jackson Street stating the high spots have been ground off with the 3 and 4 axel hocks going up and down the street since Hansen opened at Lone Star. Mr. Tzouanakis stated he is concerned about the safety of joggers, bicyclers and walkers in this area. Mayor Michael stated we are still on target for summer construction, further stating this is a State bid job and we have to go by their time schedule. Department Reports Council requested comparison infonnation in Building Commissioner and Sewage report. Street Commissioner Miles reported the Old Dick Brown lot has been graded and covered with #2 stone. Councilor Crampton commended Street Commissioner Miles for the signage at Arlington and Shadowlawn. Cemetery Superintendent Randy Robinson introduced Kenny Buis as the new Assistant Superintendent. Park Director Staton stated the Park Board is preparing RFP's for the Park Maintenance Buildin and requested approval from Council to proceed in order to see what the cost will be. ® Police Chief Hendrich stated he has had several complaints regarding the Noise Ordinance and how it relates to commercial establishments, ie, bars, etc. Chief Hendrich further stated there are complaints regarding the Noise Ordinance and a certain commercial establishment that runs refrigeration units which are quite noisy and disturb the neighbors. Councilor Crampton stated there should be no exceptions for businesses to break the laws and disturb the neighbors. Notify the owners and give a permitable time to rectify situation and let them know the Ordinance will be enforced, Councilor Crampton continued. Councilor Roach stated the intent was the boom boxes and loud mufflers on cars, not commercial businesses. Motion to approve Minutes from the April 11, 2000 Regular Session made by Councilor Crampton, seconded by Councilor Parrish. Vote was unanimous. Motion to approve City claims made by Councilor Parrish, seconded by Councilor Hammer. Vote was unanimous. Jeff McCall was the only applicant for the School Board appointment. Motion to reappoint Jeff McCall to the School Board made by Councilor Roach, seconded by Councilor Hammer. Vote was unanimous. Ordinance 2000 -8, An Ordinance Approving the Petition of Greencastle Community School ® Corporation to Vacate Public Right -of -Way Located in the City of Greencastle, Putnam County, Indiana, second reading. Motion to approve made by Councilor Hanuner, seconded by Councilor Roach. Vote was unanimous. Resolution 2000 -11, A Resolution Affirming Heartland Automotive, LLC, of Compliance With Statement of Benefits; Resolution 2000 -12, A Resolution Affirming H.A. Parts Products of Indiana Company of Compliance With Statement of Benefits; Resolution 2000 -13, A Resolution Affirming H.A. Parts Products of Indiana Company of Compliance With Statement of Benefits; and Resolution 2000 -14, A Resolution Affirming Lear Operations Corporation of Compliance «rith Statement of Benefits, were all approved with a motion by Councilor Roach, seconded by Councilor Rokicki. Vote was unanimous. Police Chief Hendrich presented his Police Stragetic Plan and Police Site Location to the Council and requested they look at the information and give their input. Councilor Crampton stated it is an interesting plan and he supports the decision of the Police Department not to move into the new City Hall. Councilor Crampton stated the new building lacks everything a Police Department needs. An Executive Session was set for May 31 st, 7:00 p.m. at the new City Hall. Councilor Parrish regretfully submitted her resignation letter of which is attached and will become a part of these minutes. Jones, Clerk - r asurer Corrections of the Greencastle Common Council Regular Session Meeting, April 11, 2000 Under Ordinance 2000 -4 in regard to the four stop signs at Arlington and Shadowlawn in the second paragraph beginning with the line... Chief Hendricks stated that he feels it may be more hazardous to place a stop sign in the area than to leave it s it is. Chief Hendricks states he feels there are other ways to deal with the traffic problem on Arlington Street and that at this time the numbers we have do not warrant a four -way stop.,He continued to say that if the I Council and citizens of Greencastle felt that the intersection in question was a dangerous one and a danger to public safety, regardless of the numbers, the Council should vote for the four -way stop. May 4, 2000 Greencastle City Council Members Mayor Nancy Michaels Citizens of Greencastle To All Concerned: It is with my deepest regrets that I must resign my position as the 4`s Ward Representative for the Greencastle City Council. It has conic to my attention that according to the Indiana Judicial Center, there could be a conflict with my position as Chief Probation Officer for Putnam County and with serving as an elected official. Because of this conflict, I must make a choice between the two positions. Regretfully, I must chose the position of Chief Probation Officer over that of City Council Representative due to my educational and career choices. ® I have enjoyed the short time I have been on the City Council and wish I could continue to serve the citizens of Greencastle. I want to thank all of the department heads for the time they have taken to educate me about the operations of their individual departments. I would also like to thank the members of the City Council as well as the Mayor for all of their support.
