Sure enough they have an old address listed on the first lot. The Chatham County Board of Assessors site also uses 1909 meaning we may not want to use or have the Owner's use 1923 for a number of reasons including but not limited to 911 and other emergency related reference. My reason for checking this is due to similar confusion in the past. I am using the following descriptions until you advise otherwise: 1st lot on the left as you enter the private drive serving these three lots of out there 4 -0009 -12 -004 CHATHAM AV 001909 FORAN MICHAEL 2nd lot being the middle lot 4 -0009 -12 -005 CHATHAM AV 001923 SCHIFF RYAN & KIRSTEN H* 3rd lot being the end lot or western most 4 -0009 -12 -006 No address # posted on SAGIS WORLD WHOLESALE INC (Jim Dixon's company) Based on my observations during our visit to the site Friday afternoon and prior to my reading Joe's comments, I observed the following: Foran residence - There have been no detectable changes to the site since Joe and I first visited this site. This is at least our 3rd visit. Neither of us have been able to identify any stormwater management (detention) features even vaguely similar to that shown on the approved drainage plan. At this point I do not recommend we schedule any further site visits for this lot unless an engineer representing this lot is present. Schiff residence - I observed the stone but did not consider it to be unstable. The stone is loose in that the individual stones are not bonded together. Stability was an initial concern. However, when I stood upon and kicked at the stones I did not notice the berm compromised. Obviously, vehicle tires mounting the berm could cause it to fail. I would anticipate a crossite berm could fail similarly. Joe found the stone to not be adequately stabilized to secure the berm while I did not. The first two as you enter the subdivision have been developed and there are houses on them. The western most lot is a vacant lot and drainage will be reviewed following development of that lot.. The drainage as installed differs from the approved plans. A berm on the north side of the middle lot mitigates deficiencies due to deviation from the approved plan. However, it must be stabilized to be accepted to allow Joe and I to sign off on this middle lot. The first lot on the left, the eastern lot is not in conformance with the approved plan. Those members present, in addition to Mayor Parker, were Jason Buelterman, Eddie Crone, Mallory Pearce, Shirley Sessions, Paul Wolff and Jack Youmans. City Attorney Edward Hughes and City Manager Bob Thomson were also present. Father Costigan of St. Michael' s Catholic Church gave the invocation. Everyone recited the Pledge of Allegiance to the Flag. Mayor Parker said there was a long agenda and reminded everyone to make their remarks as brief as possible. Dan Massey, Candidate for Clerk of Superior Court, spoke to the Council Members and the citizens and asked for support and votes in the November Election. He said this position was not very exciting but very important. He said he would work toward building bridges between all of the Courts and encourage more friendly cooperation. Tiffany Dennis, Director of the YMCA, spoke to Council and gave a brief report on the activities for 2004. She said this was her 71 year and the Y keeps growing. This year there was 102 different children attending. She also presented a plan for 2005. She thanked Council and the Community for their support and participation. Sessions asked how many children attended the Summer Camp. Dennis said about 40 to 47 per day. Sessions asked what was the ratio of staff to children. Dennis said the Y' s standard was 1 staff member for every 15 children. She also said for younger children, 5 to 6 year olds, it was 1 to 10. She said they use college students and each staff member has to participate in the Y' s Christian Leadership Conference and in -house training. Parker thanked Dennis for ajob well done. Rachel Perkins told Council that the Tree Removal Mitigation Schedule had expired and asked them to review and update it. Perkins said that she had seen that the Noise Ordinance was to be discussed later and offered an idea that was used in Providence. She said as in most towns, the utility poles were routinely spaced so far a part. She said the police used these poles in noise enforcement, in that if they could hear a car radio or loud mufflers within the length of so many poles, it was too loud. Amy Gaster spoke in opposition to the proposed parking regulations for rental properties. She said it should apply to all residential property and asked who would enforce this. Gaster said she as well as most of the other property management companies, set parking limits, structure capacity and other rules with the guests. She said they enforce the rules themselves. Gaster said she would like to know who complained. She said there are no complaints on 90% of the short-term renters. She said this should be dealt with on a case -by -case basis and not put another unenforceable regulation on the books. Jason Buelterman said he has some announcements to make at this time. He said there would be a blood drive on Thursday, September 16. The Fire Department would have their Boot Drive on Saturday, October 2. The Tybee Beautification Assn. would have a Low Country Boil at Memorial Park Saturday from 3 to 7 PM, with our own Eddie Crone doing the cooking. He said this is to benefit the restoration of the Cemetery. Also, he said the Beach Sweep would be held on September 25f. Lawanna Tsoulos said the Big Band Boogie would be held at the Pier on September 171 and said she had tickets. Claire Price said she had an application from the Alec Temple for a parade in November. She said Alfred Waite just brought it in on Friday and the Department Heads had not had a chance to review it yet, but the Police Department said they did not have a problem with it. Price also said that Gene Kindrick of the American Legion had applied for a special permit for the 9 -11 Celebration of Patriot' s Day on Saturday at Memorial Park. She said this had been an annual event since 2001. The County had donated the band shell. Page 1 of 11 Mayor Parker opened, asked for comments and closed the following public hearings, as required by law. Dick Smith, Chairman of the Planning Commission, presented a request for a variance to the Shore Protection Act for Sprague Exley at 1909 Chatham Avenue, PIN 4- 9 -12 -1. Smith said the PC approved the request. Smith said a petitioner has to have approval from the City before they can apply to the State. Triece Ziblut, agent for Mr. Exley, said the property is 4 parcels that total 2.46 acres. She said that they are staying out of the dunes completely and are asking for no other variance. She said they have a hardship with the topography of the property in that it forms the Southern most tip of the Island and there is no structure to measure from. Ziblut said the Exley' s want to plan the development before selling any of the land. She said they had met with DNR and asked for guidance in the planning. They have followed the suggestions, and show, not just the footprint of the structures, but all landscaping as well. Ziblut said that the development is less than '/2 acre of the entire property. She said the hearing with DNR is tomorrow morning at 9:30 AM in Brunswick. Ziblut said the DNR staff report recommends approval. She said the Tybee jurisdiction line is very unusual and more than '/2 of the developed land is landward of that line. Ziblut said that they feel they meet the uniqueness of the land and the hardship issue required in Tybee' s criteria for approving a variance. Pearce asked if the owners were willing to place the dune area in a permanent conservation easement. Ziblut said they plan to do more than that and put Lot 30 and Lot 31, which are the most beach oriented lots, into a conservation easement. She said as far as the dunes are concerned, the DNR restrictions prohibit any development. Cullen Chambers asked what were the plans for the old existing structure. Ziblut said they would like to preserve the cottage somewhere on the Island. Chambers said he would like to let the owners know that if they decide to demolish the cottage, please let the Historical Society know and they will work with them to relocate the structure. Smith presented a request a variance for 8 feet in the front setback at 1016 Laurel Avenue, PIN 4- 26 -7 -19, for Tim Roose, Darren Michaels, Agent. Smith said this request is to enlarge a deck. He said the PC voted to deny the request. Darren Michaels said that the foundation is in place, no trees would be disturbed and there would be no roof on the deck. Michaels said he has a petition, signed by all 15 of the neighbors, supporting this variance request. Sessions asked about the hardship for this property. Michaels said the existing deck is small and the stairs take up about 1/2 of the allowable existing deck. He said for safety issues and comfort for the family, a larger deck is needed. Smith presented a Text Amendment to the Land Development Code to add parking requirements for rental property. He said the PC recommends 1 parking space for each bedroom and 1 additional space off street, and that they be shown on a site plan. He said the PC approved the recommendation. Youmans said this would ruin the rental business on Tybee. Keith Gay said Amy Gaster' s comments earlier outline the general consensus of the property management companies. Gay said that all of the rental agencies that he knows of have parking requirements in their agreements. He said some of the rental properties, not handled by agencies but by the owners, do not have requirements, do not pay hotel/motel taxes. He said if this were passed, who would enforce, will it be based on complaints, what would the penalty be and who would pay the fine, the owner or the agency. Hughes said it would be based on who the violator is. Gay said he agrees that parking is a problem but there has to be another solution. Gay said he is against placing another unenforceable law on the books. Henry Levy said that he has had problems in the past at his residence with cars parking everywhere. He said some of the owners couldn' t even get to their residences because of renter' s vehicles blocking the drive. Stacye Smith said that all of us love Tybee. Page 2 of I 1 She said if anyone has a problem with one of her renters to please call her. Smith said part of the problem is that the City did not require adequate parking when building permits were issued. She said as a property manager, she takes pride in providing adequate amenities to her renters. John Major said if anyone has a problem, they should call the agent. He asked if they were supposed to get rid of bedrooms so they would have enough parking. Pam O' Brien said that she thought legislation was not the answer to the parking problem. Smith said that City Council had asked the Planning Commission to consider the pros and cons of rezoning South Campbell Avenue from R2 to RIB. He said the PC was asked to recommend whether to go forward with this action. Smith said they had discussed this issue thoroughly, listened to residents, both of S. Campbell and other parts of the Island. He said the PC recommends that City Council take the appropriate action that they feel is warranted. Pearce asked Smith when the Planning Commission would make a proposal in regards to the Growth Control Ordinance that they have had for some time. Smith said the PC hopes to make a recommendation at the next meeting. Smith said they have asked repeatedly for information from the City and have not yet received that information. Smith said they have asked for the number of buildable lots on Tybee. Smith said he hopes that information would be available at the agenda meeting Monday night. Mayor Parker said that additional information was requested at the last meeting on several requests and he would like to hear those issues at this time. The first of these is 2 major subdivisions for Lots 6,7,8 & 9 S. Campbell Avenue for Mr. Keitzman. Harold Yellin, Agent, spoke to Council and said the changes and issues Council had, have all been addressed. He said they had redesigned the drainage to save more trees, and Davis Engineering has written a letter approving the plans. Yellin said no variances were being requested. Pearce asked if they would be willing to curve some of the drainage lines and driveways to preserve more trees. Yellin said absolutely, they would. Rusty Fleetwood said the issue here was density. He said there would be 8 lots on I of the subdivisions and 7 lots on the other. He said that issue still exists. Rachel Perkins said the plans show 2 drainage ditches side by side on the 2 subdivisions and asked why couldn' t they be combined into I to serve both subdivisions. She also suggested that the required number of trees per lot be upheld and mitigation is by lot. Several residents spoke in support of subdivisions. Roxanne Fleetwood spoke in opposition. Pearce asked if the developer would be willing to mitigate on a lot -by -lot basis, and Mr. Keitzman agreed. Sessions said that for the record and to answer Shell Solomon' s statement that Keitzman was asked to provide more than anyone else in his subdivision request, that a recent request on Bay & Byers was sent back several times. Attorney Tom Mahoney, representing Mr. Guerrard at 1009 & 1011 Jones Avenue, said this is a request for a major subdivision of 4 lots into 6 lots. Mahoney said all of the requirements have been met and the wetlands have been flagged. Sessions asked if they still were planning to ask for the 10 feet on Jones Avenue. Mahoney said that the front setback of 20 feet is being met on the access lane, which would be the front of the house. Mahoney said the edge of the pavement for Jones Avenue is 20 feet from the property line and with a 10 ft. setback, totals 30 feet from the edge of Jones Avenue. Sessions said that she believes the Council' s job is to consider all issues and decide what is best for all residents. She said the Code is open for interpretation and thinks this is a safety issue. Pearce asked if the lot sizes met our requirement and Dee Anderson said yes, they were all 4500 square feet. Page 3 of I1 Mr. Holloway spoke next regarding the request for a variance at 5 2nd Place. He thanked the Council for allowing him to come back and clear any misunderstandings. He said the neighbor to the West is right on the property line and the neighbor to the North is 3 inches off of the property line. He said he felt that his proposal was far better than anything else in the neighborhood. Holloway said that with this proposal, there would be 2 to 3 parking spaces and if they had to elevate the house they would have only 1 additional space. Holloway said he had met with Mr. Roach and felt that the 5 ft. setback was not the issue but the development of the property in any way and the possibility of renters. Holloway said that with the easement, there is 15 feet between the properties. Michael Roach, resident of 3 2nd Terrace, said he would like to see this house moved 5 feet to the South. Roach said there are 5 weekly rental units around his home and parking is a real problem during the season. He said the houses are close together and fire safety is a real issue. Sessions asked if the proposed plan would be better than it is now, especially as far as parking. Crone said when he talked to Roach, parking was not the problem. Roach said on his street it is the problem. Mayor Parker opened the meeting for business legally presented. Pearce motioned for approval of the minutes for the August 9, 2004 meeting, Wolff seconded. Vote was unanimous. Wolff motioned for approval of the Alcohol Beverage License for Morrison for a package shop at 1515 Butler Avenue, Pearce seconded. It was noted that all approvals were in place. Vote was unanimous. Pearce motioned for approval of variance to the Shore Protection Act for Exley at 1909 Chatham Avenue, Crone seconded. Vote was unanimous. Youmans motioned for approval for the 8 ft. variance for a deck for Roose at 1016 Laurel Avenue, Crone seconded. Buelterman said he could not see the hardship for this. Vote was 2, Youmans and Crone, in favor, and 4, Wolff, Sessions, Buelterman and Pearce, opposed. Pearce motioned for denial, Wolff seconded. Vote was 4, Wolff, Sessions, Buelterman and Pearce, in favor of denial, and 2, Youmans and Crone, opposed. Sessions thanked the property managers who wrote letters and spoke tonight. She said the LDC does not address parking requirements for residential rentals. She said this is actually a business in a residential district. She said she thought some of the residents who are having problems with parking, and some of the property managers should meet and discuss the issues and see if they can offer some alternatives. Parker said he thought the planning firm would address that in their study and whomever is interested, could work with them on this issue. Youmans motioned to deny the proposed Text Amendment for parking requirements for rental property, Buelterman seconded. Buelterman said he would like for the planning firm to look into this and come back with some proposals. Buelterman asked what a citizen could do if someone parks on their property or blocks their access to their property. Chief Price said they could call the police and have the car towed. Parker said for anyone interested in working with the planning firm, to get their name to him. Pearce said he acknowledges the problem and thinks that we need some kind of ordinance, but not necessarily this one. Vote was unanimous to deny the amendment. Page 4 of 11 Pearce motioned for approval for the major subdivision of Lots 6 & 7 S. Campbell Avenue contingent on the developer working with staff to improve plans to save as many trees as possible and curving the drainage lines, Buelterman seconded. Wolff said he still thought this should be done as 1 major subdivision. Youmans said he had talked with some of the neighbors and they were happy that the lots would be 4500 square feet for single - family and not any larger for duplexes. Pearce said he still had some density concerns but under current ordinances could not vote to deny. Vote was 4, Youmans, Buelterman, Crone and Pearce, in favor, and 2, Wolff and Sessions, opposed. Crone motioned for approval for the major subdivision of Lots 8 & 9 S. Campbell Avenue with the same contingency as in the previous request, Buelterman seconded. Vote was 4, Youmans, Buelterman, Crone and Pearce, in favor, and 2, Wolff and Sessions, opposed. Crone motioned for approval of the major subdivision at 1009 and 1011 Jones Avenue, Buelterman seconded. Buelterman said his concern was the issue of 10 feet from Jones Avenue. Buelterman said we couldn' t force this on Mr. Guerrard but we could change the ordinance to reflect if the property is on a well - traveled street, 20 feet is required. Sessions said she thought the intent of the Code is a matter of interpretation. Vote was 3, Youmans, Buelterman and Crone, in favor, and 3, Wolff, Sessions and Pearce, opposed. Mayor Parker voted in favor and broke the tie vote. Crone motioned for approval of the variance for Holloway and Vining at 5 2 "d Place, Buelterman seconded. Vote was unanimous. Sessions asked how the noise ordinance is enforced now and how we could keep the noise more contained. She said she had talked with several residents who voiced concerns about this on Highway 80 and Butler Avenue. Chief Price said they enforce the ordinance against loud music and that doesn' t seem to be a problem. He said they are ticketing speeders and will continue to enforce the speed limit. Chief Price said he would like to address the golf cart issue. He said he is afraid this would open up a lot of problems. He said he would like to only allow the carts from sun- up to sundown. Hughes said that restriction has been added to the ordinance. Hughes said that signs, stating what the regulations are, have to be put in place. Price said when people come in for the permit, they would be given a copy of the ordinance, read it and sign, stating that they have read the ordinance, so that they would know what the rules are. Parker asked what designates a handicap decal. Price said he is going by Georgia State Law and the people would have to go to the driver' s license office to get one. That would have to be shown when they apply for a golf cart permit. He said this permit is a lot more restrictive than a handicap - parking permit. Hughes said there is a State law that designates who can get a handicap drivers license. Thomson asked if Price had any information from DOT regarding the left turn light at First Street and Campbell Avenue. Price said he had not but would check on it. Parker said he would like everyone to know that coming onto the Island, it take 14 seconds longer, driving the speed limit than speeding 10 miles over the speed limit, to reach the Post Office. Page 5 of 11 Price said that Thomson wanted to discuss the closing of bars in cases of emergencies. Thomson said that he had found a County and State law that covers this situation and the local authorities could control the situation. Jimmy Brown presented the bids for replacing the roof for the school building. He said he had advertised for bids for the school building only and did not include the breezeway or the cafeteria. Brown said the bids included materials, labor, tools, equipment and other necessary items, as well as disposal of the old roofing debris. Brown said the work to be done was to be itemized and include prices for a 10 -year and a 20 -year roof. Brown said he had received 5 bids. Wolff asked if $66,000 was put in the current budget for this project. Thomson said Bill Epps was prepared to speak on this. Epps said $235,000 was budgeted in the General Fund for various projects, but he didn' t have the list of individual projects. Epps said he did not have any concerns regarding this project and the Line Item would be 1565. Sessions said that the Revenue over Expenditures Report she was given, indicates that the General Fund would be hit hard by other spending. Epps said about 1 million dollars of that was for the gym, which was unbudgeted. He said he would be coming forward and asking for an amendment to the budget to remedy that. Sessions asked where is that money coming from so that the General Fund can be balanced. Epps said there is a Reserve Fund established in the fund balance for the gym. Bueherman asked if the roof was in such bad shape that it couldn' t wait until 2005 to be repaired, given the nature of our current budget. Brown answered that the roof was in terrible shape and the building is being used more and more, with offices, meeting rooms and a City conference room. He said there has also been a problem with mold. Buelterman asked if it could wait until the next meeting or the meeting after that until Council can get some more firm figures from Epps. Brown said it could wait until October. Parker asked to hold off on tiling the restrooms for the same time when Mr. Epps can get the figures and report to Council. Youmans said he would like to know the cost of the tile. Pearce said there was a wide range of the bids for the roof and he would like to know if all of the bidders were reputable companies. Brown said the bids were from $61,000 down to $33,000 and he had no idea why such a difference. Wolff asked if the references had been checked and the length of time the companies had been in business. Pearce said if all were equally reputable, he thought we should go with the cheapest bid. Brown said he was waiting until the Council chose a company before checking references. Wolff said maybe he could check them while waiting for approval. Brown agreed and Wolff said check all 5 of bidders. Sessions told Brown he had done a good job in compiling all of the data and thanked him for his hard work. Buelterman said he had some concerns regarding the City' s hurricane preparedness procedures. There was a long discussion concerning this issue. It was determined that the Mayor is the only one who can call for evacuation and in his absence, the Mayor Pro Tem. The Safety Director supplies the information needed in order to make the decision. Thomson agreed to have City staff post the City' s Emergency Plan on the WEB Site. Mayor Parker reminded everyone that he is the only one who is authorized to speak with any of the media during an emergency. Sessions offered to invite Phillip Webber, Director of the Chatham Emergency Management Agency, to speak to Council at our next meeting. All agreed that would be helpful. Youmans motioned to leave S. Campbell Avenue zoned R2, Crone seconded. Wolff said there would be a proposal tonight and if approved, would be sent to the Planning Commission next week, to increase lot size requirements. Wolff said this would be a compromise to rezoning and would like to see if this won' t solve the problems rather than Page 6 of 11 going through the long process of rezoning. Wolff said he had another proposal but that he would discuss it later in the meeting. Vote was 5, Wolff, Youmans, Sessions, Buelterman and Crone, in favor, and 1, Pearce, opposed. Mayor Parker called for a 5- minute break. Mayor Parker called the meeting back to order after the break. Youmans said he wanted to know about the tile. Jimmy Brown said the bid proposal was advertised for the tile work in the 5 public restrooms. The work would include materials, tools, labor, equipment to tile the floors and 4 feet up the walls. The restrooms are located at North Beach, Jaycee Park, Tybrisa Street, Marine Science Center and Memorial Park. Brown said only 1 bid was received. Youmans asked if the right price was $30,000 and Brown said if all of the restrooms are done. Parker asked if we could use private contractors, since we only received 1 bid. Brown said he understood that anything over $5,000 should be opened for bids. Thomson said it was not a requirement but a "best practice." Brown offered some alternatives for less money to improve the restrooms. He said pressure washing, painting, replacing the urinals and some general cleaning, in his opinion, would bring the restrooms up to standard. Brown said he had checked into putting mats on the floors after removing the paint on them now. He said he thought that it was a mistake to keep painting the floors because the sand on people' s feet acted just like sandpaper on the painted floors. Brown said he thought we could make the restrooms presentable and then look at tiling next year. Buelterman said we could wait until we hear the roof bids again next month. Buelterman said he had been pushing this for over a year and he was glad it was going forward, but he would like to make sure we have the money and where it would come from. Sessions said that some SCAD students painted the Marine Science Center restroom and it was very colorful. She said we could contact SCAD and see if some students wanted to take a project like this on for their project. She told Brown that she would get him some contacts. Wolff motioned to approve the contract with Phillips & Jordan for debris clean -up, Buelterman seconded. Vote was unanimous. Buelterman said that when the Seafood & Music Festival was approved at the last meeting, he had asked for a report regarding any problems so that a decision could be made whether to allow this festival next year and to allow it in the North Beach area. He said his main concern was parking in Jaycee Park. He said if it had rained, the park would have been torn up with all of the cars driving on the grass. He said there was a lot of traffic. Sessions said she agreed, and the traffic, parking and noise in the residential area were the reason she opposed allowing the festival. She said she still has concerns regarding using that residential area for this kind of event. Cullen Chambers said that he would like to clarify 2 things. He said the Tybee Island Historical Society is not opposed to a music festival on Tybee. He said the word on the street is that the Historical Society is opposed to a music festival on Tybee because they refused to allow parking on the Lighthouse grounds. He said the Board of Directors would work with any non - profit group that holds an event. Secondly, Chambers said the Friends of the Tybee Theatre has taken no position whatsoever on the music festival. He said one of the board members had received a call, saying that if anyone with that group opposed the festival, it would come back on them when they held an event to raise money for the theatre. He said that was petty politics and he didn' t want to get into that, and it serves no useful service. Chambers cited several problems he had encountered with the festival. Most of these problems dealt with traffic, Page 7 of 11 parking, noise, trash and lack of personnel to help and direct the attendees. He said cars were parked on the easement along Meddin Drive, on the grass median on Solomon and there were no signs directing traffic to Miller Avenue for parking. There were no signs directing traffic to the Lighthouse, as was promised. He said Meddin Drive is narrow and dangerous for that much traffic. He said the chief complaint was the noise and thought the residents should not be abused in this way. Jack Boylston, one of the promoters for the festival, told Council that he agreed with about 90% of what Chambers had said. Boylston said he had 8 staff members parking cars at the North Beach lot to maximize the parking. He said the City received revenue from parking and parking citations. He said people were parking every which way at Jaycee Park. He said people are people and they are going to do whatever they think they can get away with. He said he had paid over $2,000 for police to direct the traffic to the appropriate parking area. He said he had 2 directional signs made and took them to the parking supervisor, who he said was not there. He said he put the signs up. Boylston said he paid over $4,000 for parking to the City and $1,200 to DPW for trash pick -up. Boylston said as far a the noise, we had a 30 to 35 mph wind blowing inland, which pushed the noise toward the homes. Boylston said he was sorry but people are people and not robots. Buelterman said the Water /Sewer Committee had been discussing the work that needed to be done on the Butler Avenue lines, the ones on the beach side of Butler and Ft. Screven. Buelterman said this has been talked about for a long time and it was now time to move forward. He said it was going to cost a lot of money. Buelterman said before we spent the City' s money, he wanted the citizens to know what was going on. Buelterman proposed a meeting on September 21, 2004, which would be before the next Council meeting. He said the City staff would prepare a power point presentation, explaining what we are going to do, how long it will take, how much it will cost, how we are going to pay for it and let everyone know what the City is doing. Youmans asked why even talk about it until we know where the money is coming from. Buelterman said Thomson and Epps would have all of that information at the meeting. Crone said that we were doing everything we could to conserve water. He asked why did we have to wash items before putting them in the recycling bins. He said he thought that was defeating the purpose. Wolff said he agreed and that it was not necessary to rinse the recycling items. Waste Management said that they just recommended rinsing and this might cut down on insects. Sessions said she would like to know what we could do to have DOT put in a cross walk at 2nd Street and Butler Avenue. She said this intersection was just past the curve and she said she has seen some near accidents there. Sessions said several residents, who live in the area, had voiced some concern. Thomson said we could tell DOT what we want. Thomson added that while we were asking for this, he would like for Council to consider asking DOT to install larger signs at the crosswalk in front of City Hall. He said the signs are small and are hard to read. Thomson suggested Council motion for a resolution to get things started and he would get the resolution to the district engineer at DOT. All agreed and Thomson said he would make up the resolution and get it signed. Parker said DOT may or may not do this. Sessions asked what could we do to convince them to do it. She said it seemed to be a real safety issue. Parker said we would just explain the issue to them. Sessions told Parker he had some good connections and wrote good letters, so everyone would just count on him. Page 8 of 11 Wolff said that he had a Text Amendment to increase water rates for irrigation water meters and require them to have a rain sensor. He said this was discussed at the last meeting and Hughes had put it in ordinance form, which Council had in front of them. Wolff motioned for approval of this ordinance on 151 reading, Pearce seconded. Buelterman asked if this required 2 readings and Hughes said yes. Buelterman said he would support it now but had a few questions. Vote was unanimous. Wolff said there was some confusion on the pick -up dates for the beginning of recycling, and he apologized. He said the problems have been worked out and they are now picking up according to the schedule on the refrigerator magnets. Wolff said extra bins are available at City Hall. Parker said for those people who have lids, it is nice to use the lids while the bin is inside the house. Crone said one of the problems with pick -ups could have been the hard rain we had. Wolff said he would like to nominate Sally Jett to serve on the Audit Committee to replace Jan Fox, who resigned. Crone seconded, and the vote was unanimous. Hughes said the next item was misnamed and should be for the removal of the trash carts out of the City right of way after 24 hours of being picked up. Hughes said he thought that was probably longer than Council wanted. Council agreed that 24 hours was a fair amount of time. If someone was going to be out of town, Parker said a good neighbor could bring the cart in. Buelterman asked that status of the MRS issue with water access. Hughes said he is working with Chuck Eaton on that. Parker asked for a motion to put Chandler Kinsey on the Citizens Advisory Committee for CUTS. Parker said he would replace Henry Levy. Parker said Levy had been on the committee for a long time and thought we should have someone new serve. Buelterman so moved, Pearce seconded. Vote was unanimous. Pearce asked to discuss giving the Planning Commission time on their agenda to start planning the public hearing on the Control Growth Ordinance. Buelterman said he thought they were to get the information from City staff about the maximum build out. Pearce said they had been procrastinating but he thought we could wait until the next Council meeting. Pearce said if they continue to sit on it, he felt at some point Council should take some action. Pearce asked if there was a draft and Hughes said yes. Thomson said a gap was found in the Erosion and Sediment Enforcement in our enforcement capability when the legislature was passed. Thomson said he had a meeting scheduled for this week with DNR so they could explain how the State could authorize us to be our own enforcement authority. John Wynn had a mix up in his scheduling and could not come this week but has rescheduled for next week. Thomson said Wynn would explain what City staff has to do to enforce the erosion and sediment control, silt fencing and that sort of thing. Thomson said that it would be on the next agenda. Wolff said he has learned that Mark Williams and Chuck Bargeron are both certified. Pearce said he thought local control would be a good thing as the DNR grants variances from time to time. Hughes said we were 30 days into a 60 -day moratorium on applications for subdivisions. Hughes said one issue with this moratorium was whether it prohibited the issuance of building permits for the construction of duplexes. Hughes said he looked at the videotape Page 9 of 11 of the meeting and it was clear that it did not. The moratorium was only for accepting applications for subdivisions. Hughes said it should be made clear that the reason for the moratorium was the density issue while the proposal for increasing the minimum lot size was being discussed and the limitations on water capacity. Wolff said he would like the Planning Commission to consider, at Council' s request, the increase in lot sizes in R2 and C2. Wolff said he would like for this to come back to Council as soon as possible, during the period of the moratorium, so that we could act on it. Wolff said, as a separate issue, he would like the Planning Commission to consider eliminating private drives, which have proven to be a disaster in most cases, and requiring all major subdivisions to include either marginal or minor City streets as a part of the subdivision, meeting all City specifications, and at the end of one year, inspected and turned over to the City for maintenance. Youmans said he had a problem with this and that more of the people' s property was being taken away. Wolff motioned for approval, Pearce seconded. Buelterman asked Wolff to repeat the motion. Wolff said this was 2 separate issues, increasing minimum lot size in R2 and C2, and eliminating private drives in subdivisions and requiring the streets in major subdivisions to be turned over to the City at the end of one year for maintenance. Wolff said he would also like to have a minimum length on these streets and drives but that could wait. Youmans said Rachel Perkins conducted a study years ago on buildable lots left and there were 67 lots of 6000 square feet or less in RI. Youmans said all of these lots would be unbuildable. Wolff said they would be lots of record and grandfathered. Crone said the moratorium started out to be 1 thing and now it has grown into a book. Crone said none of this was discussed. Vote was 3, Wolff, Sessions and Pearce, in favor of sending to Planning Commission, and 3, Youmans, Buelterman and Crone, opposed. Parker voted in favor of sending to Planning Commission for recommendation, breaking the tie. Pearce motioned for approval on 2' reading for the ordinance for use of golf carts by the handicapped, Wolff seconded. There was discussion about the problems this ordinance could cause. It would be hard to enforce. Parker said because of all of the traffic here, he has opposed golf carts. Crone said anyone could get a handicap decal or tag. Sessions asked how the Mayor would fairly address the issue of handicapped people getting around. Parker answered to get our sidewalks fixed and use motorized wheelchairs along the sidewalks. Parker said he thought it was dangerous. Vote was 4, Wolff, Sessions, Buelterman and Pearce, in favor, and 2, Youmans and Crone, opposed. Mayor Parker called for the Action Items. Buelterman asked what was the status of deck safety. Thomson said he didn' t know if the Planning Commission had acted on this or not. He said the only way to certify the safety of a deck was to hire a structural engineer. Buelterman said he had initially asked for someone on City staff contact another community and find out how they handled a similar situation. Then, the Planning Commission could make a proposal. Buelterman said he felt sure there were other communities up and down the coast that have had this same problem. Thomson said he would find out where it stands. Buelterman said he had asked for a regular maintenance schedule for the recreation facilities. He said he had suggested keeping a log. He said it was supposed to be the YMCA' s responsibility to maintain the recreation facilities. Thomson said he thought we were doing a better job of maintenance but he didn' t know if they were keeping a log. Thomson said it almost took an act of Congress to get the softball field done, and the County finally put some dirt on it. He said if Buelterman wanted to see a routine Page 10 of 11 maintenance log, he would get it done. Buelterman said he wanted to see something from the Y showing they were complying with their contract. Sessions asked about the letter that was to be sent to the Chamber of Commerce requesting information per the contract. She said we have never received a budget from them, never received any information for review of how they are marketing Tybee, as well as other information we were supposed to be us. She asked Hughes if he was the person that to write the letter. Hughes said he thought he was supposed to help the Mayor write the letter. Sessions asked if they would have a letter to review by the next meeting. Parker said yes. Crone motioned to go to Executive Session to discuss litigation, personnel and real estate, Sessions seconded. Vote was unanimous. Wolff motioned to return to Regular Session, Pearce seconded. Although Mark has demonstrated ISO required fire flow is available, he is providing a clearer worksheet on the fire flow calculations The Owner advised the maintenance responsibilities for the common driveway, drainage swales and storm water retention areas are covered in the recently prepared covenants and instruments related to the property owner's association. It is the City's decision as to whether recording of these documents is required concurrent with the recording of the final plat, prior to any building permits being issued, prior to any certificates of occupancy being issued or prior to a different time in the progress of this development. Reference is made to seaward toe of dunes flagged by Sligh Environmental, landward toe of dunes and post demolition DNR JD line. Mark Boswell has advised that he cannot get a suitable answer on: a) Why the dunes limits are noted as being by Sligh and not reference to any governmental agency is noted. b) What the designation post demolition is used. As these are setback issues I am merely calling them to your attention. I recommend your office be satisfied with these statements prior to proceeding further. Our review is limited to engineering issues. We have not attempted to duplicate the work of the Planning Commission or City staff with regard to setbacks, density or other zoning or subdivision regulation issues. To the best of my knowledge and belief, these plans meet the requirements of the Land Development Code of the City of Tybee Island. Any recommendations do not relieve the project of the requirement to obtain any other required permits, approvals, etc... by any other governmental body or authority having jurisdiction over any portion of this project.
