AN ORDINANCE OF THE CITY OF JEFFERSON , MISSOURI , APPROVING AN AMENDED
FINAL PUD PLAN FOR LAND ADDRESSED AS 2118 SCHOTTHILL WOODS DRIVE AND
DESCRIBED AS LOTS 95 AND 96 OF SCHOTTHILL WOODS SUBDIVISION, SECTION FOUR,
JEFFERSON CITY, COLE COUNTY, MISSOURI.
WHEREAS, Kurt and Lisa Mankin , owners of the real estate hereinafter described , having
submitted to the City Council an Amended Final PUD Plan of said real estate , being
located in Jefferson City , Cole County , Missouri , and described as follows : Lot 95
and Lot 96 of Schotthill Woods Subdivision , Section Four, per plat of record in Plat
Book 12, page 338 , Cole County Recorder 's Office , in the City of Jefferson , Cole
County , Missouri ; and
WHEREAS, it appears that the procedures set forth in the zoning code relating to zoning have in
all matters been complied with , as said property owner submitted to the Planning
and Zoning Commission and City Council an Amended Final PUD Plan for the
above referenced property .
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The previous PUD Plan for the above referenced property , approved by
Ordinance 13570 on July 21 , 2003 , is hereby amended by incorporation of the amended Final
PUD Plan (Attached as Exhibit 1) submitted by Central Missouri Professional Services , Consultant,
on file as Case No . P13004 in the Jefferson City Plann ing Division .
SECTION 2 . Common Areas and Public Land . No common areas are proposed and no
lands are dedicated to public use with this PUD Plan .
SECTION 3. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

Mr. Barron described the proposal and explained that Oscar's Restaurant caught fire on the night
of January 30, whichl destroyed the interior of the restaurant. He stated that the applicant is
requesting approval ofl an amended Final PUD Plan to construct a 1,237 square foot addition to the
building in conjunction

with the repair work. Mr. Barron explained that a paved parking lot addition is
also proposed in order~ to meet the parking requirements.
Mr. Mike Bates, Cen~ral Missouri Professional Services, 2500 E. McCarty Street, spoke regarding
this request. Mr. Bates' distributed a visual showing the proposed building and parking lot addition.
No one spoke in opp,osition to this request and no correspondence was received.

Mr. Barron gave the Planning Division staff report.
Mr. Lester moved ar;'ld Ms. Cotten seconded to recommend approval of the Amended Final PUD
Plan to the City Council. The motion passed 8-0 with the following votes:

Staff Analysis ,
Parking: The parking requirement for a restaurant is 1 space per 1 00 sf of gross floor area. After the
expansion the building would consist of a total of 5,497 sf, which would require 55 parking spaces. The
current parking lot contains 318 parking spaces. A gravel parking lot on the adjacent lot to the rear is proposed
to be paved with a minimum I of 17 parking spaces in order to meet the parking requirement.
Permitted Uses: Current use bfthe property is limited to a Restaurant with drive through window. No changes
in the permitted uses for the property are proposed.
Signs: No new signage is p~oposed. Current signage approved for the property consists of two building
mounted signs totaling 74 sf,1 a pole sign of 103 sf, and a smalll.5 sf post sign for the drive through lane.

Oscar's Classic Diner Amendment to Final PUD Plan

a. On the night of January 30th, Oscar's Classic Diner, located at 2118 Schotthill
Woods Drive had an interior fire that completely destroyed the interior of the
restaurant. Kurt and Lisa Mankin, owners of Oscar's are in the process of
rebuilding the 4,260 sf restaurant back to its original condition. With the rebuild
of the interior, the Mankins are requesting approval for a 1,23 7 sf addition onto
the rear of the existing building. The new addition will accommodate seating for
approximately 48 people with restrooms, new mechanical room and small office.
Oscar's is located on lot 95 of Schotthill Woods Subdivision-Section 4, the
Mankin's also own lot 96, which is adjacent to the rear of the existing restaurant.
With the proposed addition, an increase in the amount of parking will be required.
Currently 38 par~ng spaces serve the 4,260 sf restaurant. The proposed addition
will require an additional 17 spaces for a total of 55 spaces ( 4,260 sf+ 1,23 7 sf=
5,497 sf I 100 =55 spaces). The additional spaces are proposed to be located at
the rear of lot 95 and on lot 96 as indicated on the attachment. Lot 95 is
approximately 0.80 acres. The proposed addition will yield a floor area ratio on
lot 95 of0.16. ·
b. Final details of the plan are not complete at this time. A concept plan for the
proposed building addition and parking expansion is attached with this
application.

c. This property is already a part of Schotthill Woods Subdivision-Section 4,
therefore, a subdivision plat will not be required for this application.
d. There are no covenants, conditions or restrictions known. The original PUD site
plan will be refetred to for and specific requirements for the plan.
e. A site specific traffic impact study is not required per usage of the development.
f. No new signage is proposed at this time.
g. Any landscaping and existing trees on property will remain in place.
h. No new lighting is proposed at this time.
i. Filing fees are attached and are calculated as follows:
