HomeMy Public PortalAbout010-2021-Waiving Noncompliance re late-filed assessed valuation docs of Hill's PetCOMMON COUNCIL CITY OF RICHMOND, INDIANA RESOLUTION NO. 10-2021 A RESOLUTION WAIVING NONCOMPLIANCE RELATED TO LATE-FILED ASSESSED VALUATION DEDUCTION DOCUMENTS OF HILL’S PET NUTRITION INDIANA, INC. WHEREAS,On October 20, 2021, Hill’s Pet Nutrition Indiana, Inc. filed a Statement of Benefits form SB-1/Personal Property with the City of Richmond, Indiana (“City”), for certain tax deductions for new manufacturing equipment (“equipment”) located at 2325 Union Pike, in Richmond, Indiana, located in an economic revitalization area; and WHEREAS,Hill’s Pet Nutrition Indiana, Inc. installed new equipment on or about January 1, 2021, pursuant to its certified application; and WHEREAS,Pursuant to IC 6-1.1-12.1-11.3(a)(2) and (c), in the event an applicant fails to submit the completed statement of benefits form to the designating body before the installation of the new equipment, the Common Council of the City (“Common Council”) as designating body, may waive an applicant’s noncompliance resulting from the late-filing of the Statement of Benefits form, provided that Common Council conduct a public hearing on said waiver; and WHEREAS,A public hearing is scheduled to be held before the Common Council on said waiver on November 15, 2021, after publishing legal notice thereof at least ten (10) days in advance of said hearing; and WHEREAS,It is in the best interest of the City of Richmond, Indiana, to waive the noncompliance resulting from the late-filing of the Statement of Benefits form SB-1/Personal Property in order that the Common Council of the City may entertain the Statement of Benefits filed by Hill’s Pet Nutrition Indiana, Inc. NOW, THEREFORE, BE IT RESOLVED BY THE Common Council of the City of Richmond, Indiana, that: 1.The Common Council, after holding public hearing on this matter, does now waive the noncompliance resulting from the late-filing of the Statement of Benefits form SB-1/Personal Property submitted by Hill’s Pet Nutrition Indiana, Inc. as said waiver is permitted pursuant to IC 6-1.1-12.1-11.3(a)(2) and (c). 2.The presentation of a copy of this Resolution by Hill’s Pet Nutrition Indiana, Inc. to the Auditor of Wayne County, Indiana, shall constitute evidence of the waiver of noncompliance by the Richmond Common Council, as the designating body. 3.That this Resolution shall be in full force and effective immediately upon its adoption.
