APPROVING THE RENEWAL OF PLENARY RETAIL CONSUNIPTION
LIQUOR LICENSE NO. 1201 -33- 029 -007 FOR THE 2013-2014,2014-2015 &2015-
2016 LICENSE TERMS PURSUANT TO A SPECIAL RULING
WHEREAS, a Verified Petition was filed the New Jersey Division of Alcoholic
Beverage Control for a Special Ruling pursuant to the provisions of N.J.S.A. 33: 1 -12.18
requesting authorization for the Borough of Carteret ( "Borough "), the local issuing
authority, to consider the renewal of Plenary Retail Consumption Liquor License No.
1201 -33- 029 -007 ( "License ") for the 2013 -2014 & 2014 -2015 license terms by way of
the issuance of a "nerd' license therefore upon the failure to file timely renewal
applications for the aforesaid license terms, and further, for relief pursuant to N.J.S.A. 33:
1 -12.39 to subsequently consider the renewal of the subject License for the 2015 -2016
license tern in its inactive state; and
WHEREAS, according to the Director's Special Ruling, dated May 29, 2015, the
Borough has been authorized to consider the application for a new license for the above
License upon the failure to file timely renews for the 2013 -2014 & 2014 -2015 license
terms, and thereupon to grant or deny said application in the reasonable exercise of its
discretion, all in accordance with the provisions of N.J.S.A. 33: 1- 12.18; and
WHEREAS, further, in accordance with the Director's Special Ruling, relief was also
granted pursuant to N.J.S.A. 33:1 - 12.39, authorizing the Borough to consider an
application for renewal of the subject License for the 2015 -2016 license term, in its
inactive state, should the Borough act to approve the application for a new License
pursuant to the relief granted by the Director under N.J.S.A. 33:1 -12.18 .
WHEREAS, all of the requirements for the Borough to properly consider the above
actions, including the publication requirements set forth in XLA.C. 13:2 -1.5 with regard
to the application for the "need' License as set forth in the Director's Special Ruling, have
been satisfied.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of rbfiddlesex, State of New Jersey, as follows:
1. That the renewal of Plenary Retail Consumption Liquor License
No. 1201 -33- 029 -007 is hereby approved for the 2013 -2014 & 2014 -2015
license renewal terms by way of the issuance of a "new" license therefore,
as authorized pursuant to the N.J.S.A. 33: 1 -12.18 Special Ruling relief
granted by the Director on May 29, 2015.
2. That, father, upon the renewal of Plenary Retail Consumption
Liquor License No. 1201 -33- 029 -007 for the 2013 -2014 & 2014 -2015
license terrrrs as aforesaid, the renewal of the subject License for the 2015-
2016 license term, in its inactive state, in hereby approved, in accordance
with the N.J.S.A. 33:1 -12.39 relief provided for in the Director's Special
Ruling.

3. That the Municipal Clerk be and is hereby authorized and directed
to issue an A.B.C. License Renewal for Plenary Retail Consumption
Liquor License No. 1201 -33- 029 -007 for the 2013 -2014 & 2014 -2015
license terms by way of the issuance of a new License therefore, and to
issue the renewal for the same for the 2015 -2016 license term, Special
Ruling relief having been so granted.
4. That two (2) certified copies of the Resolution be forwarded to the
New Jersey Division of Alcoholic Beverage Control, Licenses Bureau as
may be required or provided for.
