A RESOLUTION AUTHORIZING THE MAYOR
TO SIGN AN AGREEMENT FOR DEFERRAL OF PLANT INVESTMENT FEES WITH 406
ZEREX, LLC FOR THE PROPERTY KNOWN AS 406 ZEREX STREET
WHEREAS, the Town of Fraser has adopted Fraser Municipal code Section 2-2-10(d) to
encourage, in part, the establishment and expansion of new retail sales tax generating
businesses within the Town of Fraser and to further other public purposes; and
WHEREAS, Byson Investments, on behalf of 406 Zerex, LLC made a request to the
Town of Fraser Board of Trustees at the October 4th, 2023 Board meeting for economic
incentives for the Koselig on Main project (406 Zerex); and
WHEREAS, the Economic Development Advisory Committee recommended to the Town
Board that they approve some level of economic incentives for Koselig on Main due to
extenuating communication issues around economic incentive requests previously made to prior
Town staff;
THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF
FRASER, COLORADO THAT:
The Town of Fraser Board of Trustees authorizes the Town Mayor to sign an
agreement for certain economic inducement and incentives to include deferral of
plant investment fees to allow the deferred payment of water and wastewater plant
investment fees, which are normally payable at the time of issuance of certificate of
occupancy to instead be paid in eight (8) equal quarterly installments, without
interest, with the first installment payable within fifteen (15) days of January 1St, 2024.
