WORKSHOP MINUTES
HILLSBOROUGH TOWN BOARD
September 22, 2003
7:30 PM, Town Barn
The Hillsborough Town Board held a monthly workshop on September 22,2003 at 7:30 PM in
the Hillsborough Town Barn. Present for the Board Meeting were Mayor Joe Phelps, and
Commissioners Frances Dancy, Kenneth Chavious, Evelyn Lloyd, Michael Gering and Mark
Sheridan. Staff present were Town Manager Eric Peterson, and Planning Director Margaret
Hauth.

1. Open the Workshop
Mayor Joe Phelps Opened the Workshop at 7:30 PM. He did not read the Public Charge, but
indicated that it would be followed.
2. Agenda Changes & Agenda Approval
Mayor Phelps requested to add to the Agenda a discussion of how to handle meetings with a
large number of Items for the Board's consideration (Le. the possibility of continuing Items to
the monthly Workshops).
. 3. Updates from the Mayor & Board on Key CommitteeslIssues
There were no updates presented.
4. Patty Griff"m, Communications Manager for the Chapel HiWOrange County Visitors
Bureau, will make a presentation on the Triangle Family of Communities
Patty Griffin, Communications Manager for the Chapel Hill/Orange County Visitors Bureau,
reported the "Triangle Family of Communities" is a first ever, inter-regional multi-year
communications plan created to build an image and brand that positions both The Triangle as a
"Family of Communities," and the individual cities, town and counties that make it great.
Through creating a sense of connection between the communities in the region, the campaign
will also facilitate collaboration on issues such as transportation and air and water quality.
Ms. Griffm also presented the Town with a Triangle Family of Communities flag.
5. Consider Adopting an Ordinance to Extend the 2-Hour Parking on the North Side of
the Mercantile Building in downtown to a 3-Hour Limit
.
Upon a motion by Commissioner Dancy, seconded by Commissioner Lloyd, the Board moved to
approve the Ordinance to Extend the 2-Hour Parking on the North Side of the Mercantile
Building in downtown to a 3-Hour Limit as presented by a vote of 5-0. The motion was declared

6. Consider Approval of an Ordinance to make corrections regarding Extended Care
Facilities
Upon a motion by Commissioner Sheridan, seconded by Commissioner Lloyd, the Board moved
to approve the Ordinance to make corrections regarding Extended Care Facilities as presented by
a vote of 5-0. The motion was declared passed. A copy of the Ordinance to make corrections
regarding Extended Care Facilities is hereby made a part of these official Minutes as an
Attachment.
7. Discussion of Water/Sewer Rates, Out-of-Town Multiplier, and Proposed Rate Study
Out-of- Town water customers Will Atherton and Krista Babbitt addressed the Board and
expressed their objections to the double out-of-town rates. Ms. Babbitt presented the Board with
a Citizens for Water Fairness Petition to create a policy that shares the burden of paying for
water equally among all households who use Hillsborough water and/or sewer services. A copy
of the Petition is hereby made a part of these official Minutes as an Attachment.
The Board discussed Revenue Neutral Option #3 which was presented as part of the FY04
Budget's Financial Plan for Fiscal Years 2004-2006 to Lower the Out-of-Town Multiplier from
200% to 195%. This Option is as follows:

After much discussion, and upon a motion by Commissioner Sheridan, seconded by
Commissioner Dancy, the Board moved to adopt Revenue Neutral Option #3 which was
presented as part of the FY04 Budget's Financial Plan for Fiscal Years 2004-2006 to Lower the
Out-of-Town Multiplier from 200% to 195% effective at the next possible billing date that is
most practical for the staff by a vote of 3-2 with Commissioners Sheridan, Dancy, and Chavious
voting Aye; and Commissioners Lloyd and Gering voting Nay. The motion was declared passed.
8. Discussion on Proposed Retirement Developments, if necessary
There was no discussion on this Item.

9. Other
The Board discussed the purchase of generators for the Old Town Hall, the Hassell Street Pump
Station, and the Mayo Pump Station.
Upon a motion by Commissioner Sheridan, seconded by Commissioner Dancy, the Board moved
to approve the purchase of generators for the Old Town Hall, the Hassell Street Pump Station,
and the Mayo Pump Station with an expenditure of up to the $51,042 amount proposed by a vote
of 5-0. The motion was declared passed. A copy of the bids submitted for consideration are
hereby made a part of these official Minutes as an Attachment.
By consensus, the Board agreed to continue meetings with a large number of Items for the
Board's consideration the monthly Workshop as suggested by Mayor Phelps.
Commissioner Gering suggested that the Board make an effort to meet with various Boards to
open up dialogue. He suggested targeting some workshops to meet with the Tourism Board, the
Parks & Recreation Board, and the Tree Board. By consensus, the Board agreed.
10. Adjourn
Upon a motion by Commissioner Dancy, seconded by Commissioner Lloyd, the Board moved to
adjourn at approximately 9:30 PM by a vote of 5-0. The motion was declared passed.

AN ORDINANCE AMENDING CHAPTER 6, MOTOR VEmCLES AND TRAFFIC
APPENDIX ~ SECTION 6A-16 OF THE HILLSBOROUGH TOWN CODE
The Board of Commissioners of the Town of Hillsborough ordains:
SECTION I. All section references below refer to the Town of Hillsborough Code, Chapter 6,
Appendix A, and the addition of Section 6A-16B Three Hour Parking.
SECTION 2. Section 6A-16B
Three Hour Parkin!: Allowed
In accordance with Section 6A-16B the Town Code is hereby amended designate specific
parking spaces in the Town Parking Lot as 3 hour parking spaces having signs that read "3 Hour
Parking - Subject to Fine and Towing"

AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF THE TOWN OF HILLS BOROUGH
THE BOARD OF COMMISSIONERS OF THE TOWN OF IDLLSBOROUGH ORDAINS:
Section 1. Section 3.4.1 of the Zoning Ordinance of the Town of Hillsborough is amended to permit
"Extended Care Facilities" in AR, R-40, R-20, R-15, and R-IO as Special Uses.
Section 2.
Section 4.48 of the Zoning Ordinance is amended to add subsection m as follows:
4.48.4.mExtended Care Facility
1) The fallawing additianal infarmatian shall be submitted as part .of the applicatian:
a. Detailed written descriptian .of the services .offered to residents both an-site and thr.ough ather arrangements and
which services are included in the base fee and which are available a Ia carte .or as needed.
b. Written descriptian .of the category .of facility that is propased under the appr.opriate state regulatary auth.ority
and relevant license, certificate .of need, .or ather appr.oval needed fram the appropriate state agency.
c. Written descriptian of staff levels and training expected in the positi.ons.
d. Expected peak haur traffic to/from the site and anticipated number .of residents with personal vehicles.
2) The praposed snuctures appear residential in character.
3) The standards f.or building setbacks, landscaping, buffering, starmwater cantral, imperviaus surface limits, signage,
parking, lighting, refuse callectian and recycling shall apply as if the site were zaned Office Institutianal.
4) Na less than 10% .of the grass parcel size shall be maintained as autdaar .open space .or park space. Areas dedicated
ta required buffers, starm drainage .or detentian are nat cansidered .open .or park space.
Section 3.

The second two paragraphs of Section 4.38 of the Zoning Ordinance are amended to read as
follows. No changes are made to paragraph one.

Section 4. The definition is Section 25 of Extended Care Facility is amended to read as follows:
A facility licensed by the appropriate state agency, as a facility far fifteen (15) or mare unrelated individuals (excluding
supervisory persannel) wha are mentally .or physically handicapped, aged, .or disabled and are undergaing rehabilitatian
.or extended care. This includes, but is nat limited to, nursing hames, rest homes, hospices far the aged .or tenninally ill,
adult cangregate, and assisted living facilities. Adult congregate and assisted living are used with the definitions
established by the Narth Carolina Division .of Facilities Management.
Section 5.
Section 6.
All provisions of any town ordinance in conflict with this ordinance are repealed.
This ordinance shall become effective upon adoption.
The foregoing ordinance having been submitted to a vote, received the following vote and was duly
adopted this 2200 day of September, 2003.

same exact service. The Town of Hillsborough's Board of Commissioners has had 3 years to respond
to the Water & Sewer Advisory Committee recommendation stating that this practice is "unjustified."
Yet the town board has repeatedly failed to act to change the double multiplier.
What We Want From You
Whether you live in-town or out-of-town, pay for water and/or sewer or use a well, we ask you to take
a stand against such a discriminatory policy by signing this petition. Your signature says to the board
that you believe it is unfair to ask some citizens to pay more for the same access to water based only
on an arbitrary line drawn by the town.
