A RESOLUTION APPROVING PARTICIPATION IN A MASS DENSITY STUDY FOR
SOUTHERN SPANISH VALLEY LAND IN SAN JUAN COUNTY
WHEREAS, the Governing Body of the City of Moab has determined that the proliferation of
septic tanks in the City's Dnnkmng Water Source Protection Area may have an adverse effect on
the City's drinking water, and
WHEREAS, a Mass Density Study of Southern Spanish Valley Land in San Juan County will
provide the City information regarding the effects of the proliferation of septic tank installation,
and
WHEREAS, the Interlocal Agreement for the Participation in a Mass Density Study of Southem
Spanish Valley Land in San Juan County by and Between Grand County, the City of Moab,
Grand Water and Sewer Service Agency and School and Institutional Trust Lands
Admimstratton is attached hereto
NOW, THEREFORE, we, the Governing Body of the City of Moab do hereby approve
aforementioned agreement in substantially the form presented to this meeting of the Moab City
Council, and authorize the appropnate officials to sign and execute said agreement
This resolution shall take effect immediately upon passage
Passed and adopted by action of the Governing Body of the City of Moab in open session

INTERLOCAL AGREEMENT FOR PARTICIPATION IN A MASS
DENSITY STUDY OF SOUTHERN SPANISH VALLEY LAND IN
SAN JUAN COUNTY
This agreement is made pursuant to the Interlocal Cooperation Act (Sections 11-
13-1 et seq UCA) for the mutual benefit of tht citizens and inhabitants of Grand County,
(the County), Moab City, (the City), Grand Water and Sewer Service Agency, (GWSSA)
and the School and Institutional Trust Lands Administration, (SITLA)
1 Whereas County Council signed a Memorandum Agreement m June 2001 with
the Utah Geologic Survey (UGS), agreeing to pay to UGS the sum of $22,528
in FY 2002 for conduct of a Mass Density Study in the portion of Southern
Spanish Valley located in San Juan County, and
2 Whereas the study will assess the volume of groundwater in that portion of
Spanish Valley, subdivided into "cells" based on common groundwater
charactenstics and calculate the number of septic tanks in each cell, the
effluent from which would raise nitrate concentration in groundwater by 1
milligram per liter, and
3 Whereas the purpose of the study is to determine the limits on residential
development in Southern Spamsh Valley which can occur without a sanitary
sewer bemg provided, and
4 Whereas, other participants m this agreement have a stake in developing this
information for use in planning land use and public utility development and
have informally committed to sharing the costs of the study,
NOW THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS
5 It is understood that UGS total cost will be $27,034 and that UGS will be
Fundmg $4,506 of that amount leaving a balance of S22,528 to be paid by the
parties hereto
6 County agrees to pay $3,003 67 in cash and will receive and hold the funds for
for the study for disbursement from a special project account in the Clerk's
Office County will update the County Capital Infrastructure Plan and impact
fees in FY 2002 as part of the revision of the 1996 Grand County
Comprehensive General Plan
7 SITLA will pay S13,517 in cash into the account SITLA has approximately
2,300 acres of land within the study area, development of which may depend
upon the UGS study results
8. City will pay $3,003.67 into the fund. City has commissioned the design of a
new wastewater treatment plant of larger capacity than the current one, and
needs the study information to determine design and financial needs to
accommodate wastewater treatment from outside Grand County.
9. GWSSA will pay S3,003.66 into the fund. GWSSA has a need for the study
information to determine whether it will be expanding its service boundaries
into San Juan County and for planning of its distribution, collection and fee
systems.
10. This Agreement shall become effective immediately upon its approval by
Resolutions of their respective Governing Councils or Boards. This
Agreement shall remain in effect until 90 days after written notice of
termination is given by any party hereto to the other parties.
11. Executed copies of this agreement shall be filed with the respective Clerks
or Secretaries of the parties hereto.
